The Petitioners proposed to demolish an existing one-story single-family cottage on a lot containing less than 10,000 square feet and construct a new 2,434 sq.ft, 1 %story, four-bedroom, single-family dwelling in conformance with current setback requirements. The subject property is a corner lot with frontage on Commerce Road and Second Way containing 9,193 sq.ft(all upland). The parcel is located across the street from a salt marsh, putting the building envelope within 100 feet of a coastal bank. The property is currently within the 100-year floodplain with a base flood elevation (BFE)of 11'. The property was improved with a 1,252 gross sq.ft, two-bedroom, one-story single-family dwelling, constructed in 1952. The house did not conform to the required 10' side yard setback to the western property line. There was a small shed located on the northwest corner of the property. The lot was served by public water and sewer. Procedural & Hearing Summary Special Permit No. 2014-017 to allow for the demolition and rebuilding on a lot less than 10,000 square feet was filed at the Town Clerk's office and office of the Zoning Board of Appeals on March 27, 2014. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters and interested parties in accordance with MGL Chapter 40A. The hearing was opened on April 23, 2014 at which time the Board found to grant the special permit subject to conditions. Board Members deciding this appeal were Craig G. Larson, Brian Florence, Alex M. Rodolakis, George T. Zevitas and David A. Hirsch. Steven H. Cook represented the Petitioners before the Board, who were also present. He provided an overview of the property and the proposed construction. Mr. Cook confirmed approvals had been granted by the Old Kings Highway Regional Historic District Commission and the Conservation Commission. He confirms all FAR, coverage and height requirements would be met. The Board Chair requested public comment and no one spoke. Findings of Fact At the hearing on April 23, 2014, the Board unanimously made the following findings of fact for Appeal No. 2014-017, a request for a special permit filed by Richard and Catherine Ventura to demolish and rebuild a dwelling at 64 Commerce Road, Bamstable: 1. Richard and Catherine Ventura petitioned for a Special Permit pursuant to§240-91(H)— Demolition and rebuilding on nonconforming lots. The petitioners are proposing to demolish an f Town of Barnstable Zoning Board of Appeals—Decision and Notice Special Permit No.2014-017—Ventura existing one-story single-family cottage on a lot containing less than 10,000 square feet and construct a new, larger, 1 1/2 story single-family dwelling in conformance with current setback requirements. The property is located at 64 Commerce Road, Barnstable, MA as shown on Assessor's Map 301 as Parcel 051. It is in the Residence B Zoning District. 2. The application falls within a category specifically excepted in the ordinance for a grant of a special permit. Section 240-91(H)(3)allows for the complete demolition and rebuilding of a residence on a nonconforming lot containing less than 10,000 square feet of contiguous upland by Special Permit. 3. Site Plan Review is not required for single-family residential dwellings. 4.
