The current exemption for"homeowners"was extended to include owner-occupied dwellings of six units or less and
to allow homeowners to engage an individual for hire who does not possess a license,provided that the owner acts as
supervisor.
DEFINITION OF HOMEOWNER •
Person(s) who owns a parcel of land on'which he/she resides or intends to reside, on which there is,or is intended to
be, a one or two-family dwelling,attached or detached structures accessory to such use and/or farm structures. A
person who constructs more than one home in a two-year period shall not be considered a homeowner. Such
"homeowner" shall submit to the Building Official on a form acceptable to the Building Official, that he/she shall be
responsible for all such work performed under the building permit. (Section 109.1.1) • , ' .

applicable codes,bylaws,rules and regulations.

State Building Code Section 127.0 Construction Control.
HOMEOWNER'S EXEMPTION
' The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions
of this section(Section 109.1.1-Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such
work,that such Homeowner shall act as supervisor."
Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q,
Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly
when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed
Supervisor. The homeowner acting as Supervisor is ultimately responsible.
To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application,
that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by
several towns. You may caret amend and adopt such a form/certification for use in your community.

Dear Mr. Holland,
On September 26,2007 a Certificate of Appropriateness was issued for your property at 94
Commerce Road,Barnstable. As of this date no permit has been issued by the Building Department
for either the interior or exterior work that has been performed on your shed. Your removal of the
four Stop Work Orders does not mean that no permit is necessary to complete this project. Please
be advised that a full building permit must be issued before the expiration of the certificate or it will
be voided and the process must begin again.
In your email of July 19, 2007 you wrote of a"...personal vendetta against me and my project."
This office is interested in only compliance with the State Building Code and the regulations of the
Town of Barnstable.
In that same email and in your email of May 28,2008 you wrote that you"...have no alternative
except to take my permitting and building department issues to the state for resolution."As you
know this,will be a lengthy process to bring about resolution. The quickest way to bring your
project to completion will be to get the proper permits in the proper time frame and then pursue
your complaints with the State.
In the meantime,the Stop Work Orders are in effect.

I was before OKH in September and received approval for the work on the shed. Inaddition :
I received approval from OKH and was issued a permit by your department in March 2006 for
the same work. Inspector LeBoeuf was at the OKH meeting in September where I received my
most recent approval. I understand Inspector Roma was at the meeting in February 2006 and
that there are tape recordings of the meeting. I have avoided using the tapes to press my
permiting case because it would only generate work for the OKH staff member: Ms. Macky.
For the record she was willing to sign off on the building remodels when they became an
issue with your department in May 2007 and she was obstructed by your inspectors in front
of my employee Mr. Smith. To be frank we both know the work at 94 Commerce Road was a
maintenance project and maintenance can not be restricted by local zoning. OKH is an
excuse for your department to interfere with my work and the enjoyment of my property.
This is just latest example of your department continuing to obstruct my obligation and
right to the protection of my property.
My company has 50 employees and we work all over the state without problems. I am not
sure what additionally needs to be done to work in Barnstable but I have no intention of
Spending another summer being harassed by Mr. LeBoeuf. I also have no intention of
removing drywall and opening my house to another finish inspection.
I have asked to meet several times with all of the inspectors for the last time I have no
alternative except to take my permiting and building department issues to the state for
resolution.
In the mean time if you or your inspectors trespass my property I will take action to
