The discontinuance of the way was intended to be followed by a conveyance of rights in the way by the abuttors, (all of which is in place and ready to go to record). However, the Land Court has recently ruled that the abandoned part of the way will still need to be labeled "private way" on the plan until or unless it is determined by the Court that no other parties can claim rights in the abandoned parcel. Payson's were not planning on going to that effort and further delay and it would seem at first reading that their Land Court effort has not advanced their cause, namely, acquiring the abandoned parcel such that it could be added to their lot to expand the area from which sideline setbacks would be measured. I suggested to counsel that she take a look at the sub-division and ZBA ordinances, including waiver and variance provisions, to see if there is any relief available. I will do the same but my preliminary thought is that if the abandoned property is still part of the"Way' per Land Court direction, the setback will be measured from the sideline of the way, absent relief from the ZBA. The existing single-family dwelling is a 672-sq. ft. two-bedroom, one- story ranch type structure built in 1940. The lot is an undersized, non-conforming lot. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. At the continuance, Attorney Bruce Gilmore represented the petitioners. He gave a brief history of the property. A new plan for the reconstruction was submitted that would meet all setbacks except one on Meridian Way. In that instance, the front yard would be 12 feet rather than the required 20 feet. The latest proposal would triple the living space. The new home would be 1459-sq. ft. on the first floor and 840-sq. ft. on the second. The house will be 27 feet to the ridge. It was noted that the plans submitted to the Board appeared to be different from the ones approved by the Old Kings Highway Historic District Commission. Mr. Payson stated that the plans submitted to the Zoning Board have been modified since he received Historic District Certificate of Appropriateness. The hearing was continued to allow the applicant time to submit a filing to the Historic District for the modification. Public comment was requested. Mr. Fletcher, Mr. Metcalf, Wayne Bassett, and Edward Cosgrove spoke in favor. At the November 06, 2002 continuance, the Board noted that two plans were presented for their approval. Payson, the owner of property located at 110 Commerce Road, Barnstable, MA as shown on Assessor's Map 319, Parcel 041. The property is zoned Residential B. Zoning District. 2. The applicant is seeking Special Permit in accordance with Section 4-4.3 and Chapter 40A, Section 6 for the demolition of an existing non-conforming single-family dwelling on an undersized non-conforming lot and the construction of a new dwelling. 3. The Residential B Zoning District requires a lot area of 1-acre of upland, 20-foot front yard setbacks and a 10-foot side and rear yard setback. 4. The property at issue is a 0.21-acre lot, developed with a single-family dwelling. The structure is a 672-sq. ft. two-bedroom, one-story ranch type structure built in 1940. The lot is undersized. The applicant is proposing to raze the existing dwelling and reconstruct a two story, Colonial dwelling consisting of 2,055 sq. ft of living area with an attached two-car garage. No portion of the original structure is to be preserved. This property is located in a flood zone and a crawl space foundation is proposed. The first floor elevation is 11.5 and conforms to the flood area provisions in the ordinance. The floor plans propose three- bedrooms, 3 '/2 baths, a family room and an office. 3 r r� 6. A plan reflecting compliance with the Residential B District setbacks has been submitted and referred to as Plan No. 3. That plan is entitled "Site Plan of#110 Commerce Road, in the Town of Barnstable (Village) prepared for Lois M. Payson dated December 10, 2001, last revised date of 9/4/02, scaled 1" = 20' and drawn by Arne H. Ojala, Down Cape Engineering. That plan shows the proposed new dwelling conforming to all setback requirements for the district. A 20.1 front yard setback off of Meridian Way, 28.03 from Commerce Road and a 10.1-foot side yard setback from the easterly side lot line. This Plan No. 3 does not intensify the degree of non-conformity, in fact conforms to all of today's required setbacks for the district. As such, it would not constitute a substantial detriment to the neighborhood. 7. The proposed reconstruction of the dwelling in accordance with Plan No. 3 vwas issued a Certificate of Appropriateness on Feb. 27, 2002 from the Old Kings Highway Historic District Committee for plans identified as 2002-047 and dated August 15, 2001. Construction of the new dwelling shall be substantially in conformance with plans presented as drawn by D.
