Dear Ralph: I write to you in followup to our discussion of last week regarding the above referenced property. In 1976 Mr. Tassinari was issued a variance which allowed him to relocate an old and dilapidated residence from a location which was not in conformity with the setback requirements of the bylaw to another location which was also non conforming with regard to setback. The primary difficulty is that the lot is only 41 feet wide . A copy of the variance is attached hereto as exhibit A. The house was moved and it' s present location is shown as "EXISTING DWELLING # 156" on the plan attached hereto as exhibit B. Please note that the dwelling is located 1 . 31 feet from the unnamed private way on the east and that the dwelling and deck are located 8 . 15 feet from the sideline of Goodview Way on the west. There are also two other undersized lots shown on the plan, being Parcel B which contains 10, 677 square feet and Parcel A, which contains 9, 579 . 38 square feet . Parcel A has a cottage on it and Parcel B is vacant . Attached hereto as exhibit C is a photograph which shows the existing, house, deck and patio. Mr. Tassinari is planning on retiring to the Cape and will need to expand the size of the existing dwelling at # 156 Commerce Road. Attached hereto as exhibit D is a sketch which shows a proposed expansion of the existing house, the elimination of the way, and the creation of two lots where there have been three. Please note that the foremost extension of the house on the east side would encroach into what is now the unnamed private way. This issue would be resolved by the elimination of the private way and the transfer . to # 156 of both the fee interest in the unnamed way and that portion of Parcel. On the westerly (Goodview Way) sideline, the proposed addition would extend in a northerly direction, angling away slightly from the sideline for a distance of about sixteen ( 16 ) feet, and then turn easterly to connect to the remainder of the addition which would then be in compliance with the setback requirements . Based upon our conversations and your review of these documents, it is my understanding that you would issue a building permit for such an addition pursuant to Section 4-4 . 3 ( 1 ) , contingent upon the necessary steps being taken by the owner to eliminate the way and complete the transfers outlined above. Tassinari, have appealed to the Board of Appeals from a decision of the Building Inspector and petition for a variance from Section J, Appendix A, Intensity, Regulations, Barnstable Zoning By-Law as revised April 2,1975, to allow addition to and relocation of existing single family dwelling on non-conforming lot such relocation not in conformity with front and sideline setback requirements as Commerce Road, Goodview hay and Unnamed Private Way, Barnstable in an RB Zoning District. Attorney David Grossman represented Petitioner. Petitioner seeks to construct addition to and relocate on lot a 150 to 200 year old house which is in disrepair and will collapse without extensive work. Locus is only 41 feet wide and is abutted by three streets. Therefore, it is impossible to meet frontage requirements on all three sides abutting streets. Petitioner will improve setback on the public way (Commerce Road) by increasing it from 12 feet to 58 feet and will improve the setback on the traveled private way (Goodview Way) from 2 feet to 5 feet. The dwelling will infringe on the 20 foot setback from the unnamed private way. It will be -1 - feet from that way .. However, tha.s way is a paper road and ia-separated from locus by a hedge, and it it were not there, which on the ground it is not, there would be a 10 foot sideline requirement on this side. The restoration of this house will be an improvement -b the area. Opposition was based on the fear that there would be increased traffic on Goodview Way, over which Petitioner's have no right of way. The Board found that this was a unique parcel of land, long and narrow, with non- conforming setbacks on two sides. The Board found that it would be hardship as defined in Chapter 40A of the Massachusetts General Laws ter. ed. as amended to require that setbacks be met in the restoration of this non-conforming house as_ it is impossible to meet presently required setbacks on all three sides of this parcel abutting "streets" and Petitioner would, by constructing according to plans submitted, bring house into compliance on front setback on Commerce Road, improve the setback on the traveled private Way (Goodview Way) and infringe only upon the unnamed private way, which is a paper road. The Board found that this would not be detrimntal to the area as it would serve to restore an antique home, which would be __ an asset to the neighborhood, nor would it be in derogation of the Barnstable Zoning By-Law as revised April 2, 1975. TASSINARI AND BEVERLY J. TASSINARI FOR VARIANCE APPEAL NO. 1976-41 INTRODUCTION Edward J. Tassinari and Beverly J. Tassinari ("Petit- ioners" ) seek to have the sideline setback reguirements of the Barnstable Zoning By-Laws varied so as to allow Petitioners to restore the older portion of their house (dating from the early 19th Century) and to rebuild a deter- iorated portion of their home in a manner that is in keeping with the purpose of the Zoning By-Laws and aesthetically consistent with the neighborhood. The setbacks from Commerce Road, the only public way affected, and Goodview Way, a private way, will be substantially increased overall. FACTUAL BACKGROUND Petitioners bought their home in July, 1972 and have used it with their two young children since. The lot is of an unusual long, narrow shape, 41' wide by 302' deep. The existing structure is now set back 12 ' from Commerce Road and only 2. 05' from Goodview Way. -2- Shortly after purchasing their home, Petitioners noticed that the rear (North) section of the existing home was badly deteriorated. Since the structure lacks a foundation, it is sagging and the building will ultimately collapse. In addition there is no second means of egress from the upstairs bedrooms. This lack of secondary egress presents a severe danger to the family in the event of fire. SCOPE OF PROPOSED WORK Petitioners propose to do the following: The deterio- rated rear (North) portion of the structure will be rebuilt and slightly widened (from 16. 5' to 20' ) . At the same time, the entire structure will be moved north and east so as to establish the front yard depth in keeping with the Zoning By-Laws and to create the largest feasible side yard. Set- backs will be improved as follows: On Commerce Road, the public way, from 12 ' 6" to 38' ; On Goodview Way, a private way from 2. 05' to 5' . Only on the east will the setback be reduced and then only slightly from 23' to 17 ' . Moreover the east side of the house faces an unused private way. As you can see from the plot plan and other materials previously submitted to the Board, all work has been designed by a registered architect whose instructions were to keep the structure' s design consistent with the neighborhood sur- roundings, the typically Cape Cod "feel" of the area, and -3- aesthetically in keeping with the neighborhood. Respect for the traditional nature of the neighborhood has been paramount in Petitioners' Planning. The Barnstable Historic District Commission has approved Petitioners ' plans as meeting its high standards. (See Exhibit "A" ) . LEGAL JUSTIFICATION FOR GRANT OF VARIANCE Because of conditions uniquely affecting this piece of land and the building, literal enforcement of the Zoning By-Laws would work a substantial hardship on Petitioners. The rear section of the dwelling is so badly deteriorated that its continued use is a safety hazard, as well as a potentially unsightly detriment to the neighborhood. Virt- ually any rebuilding of this section will result in a technical violation of the sideline requirements. With a 41' lot width and a 20' sideline requirement, it is impos- sible to rebuild a 20' wide structure anywhere on the lot without a variance. And yet, if Petitioners cannot re- build, the house that they purchased will lose most of its value and become unliveable. This is a substantial hardship to Petitioners both in a financial sense - having their home rendered substantially less valuable - and also in a utility sense, since their home, without the 'rear portion, would become unliveable for their family. -4- BENEFIT TO THE PUBLIC GOOD Granting of this variance will be without detriment to the public good and will in fact enchance the public good. Instead of a home with a deteriorating rear portion,, there will be a structurally sound and asethetically tasteful home. A safety and health hazard will be eliminated. The setback from the busiest way on which the property abuts, Commerce Road is substantially increased to 38 ' and on Goodview Way the setback is also increased. THE VARIANCE FURTHERS THE PURPOSE OF THE BARNSTABLE ZONING BY-LAWS One of the statutory requirements for a zoning variance, as well as a requirement of your by-laws, § Q. 2 (c) , is that the variance not nullify or substantially derogate from the intent or purpose of your bylaws. The purpose of the Barnstable Zoning By-Law is given as: " . . . [T] o promote the health, safety, convenience, morals and/or general welfare of the Inhabitants of the Town of Barnstable, to protect and con- serve the value of the property within the town, to increase the amenities of the town, and to secure safety from seasonal or periodic flooding, fire and congestion or confusion. " Granting the variance sought by these Petitioners will improve health and safety by improving the dwelling on the property, and by creating an additional means of egress in case of fire. -5- It will conserve and enchance property values by having an old and meaningful dwelling restored in an architectually sound manner, consistent with the neighborhood. It will increase the amenities of the Town by improving setbacks. CONCLUSION What is sought here is a minimal variance of sideline requirements which will not affect the use of the subject property one bit, and which will enchance the attractive- ness of the property and neighborhood. The purpose is to preserve and restore the older portion of the dwelling while providing a compatible rear wing as to continue the liveability of the home. Failure to grant this variance would work substantial hardship on petitioners; granting it will be a benefit to them, the neighborhood, and the town.
