Activity Request: To permit construction of a 440 sq. ft. addition to an existing dwelling. M Procedural Provisions: Section 5-3.2 (3) : Variances &J o Background: This decision concerns the petition submitted by Albert B. Noyes, who had appealed to the Zoning Board of Appeals for a Variance to the Section 3-1.3 (5) Bulk Regulations, Minimum Front Yard Setback to permit the construction of a 440 sq. ft. addition to his existing home. The property is located at 173 Commerce Road and abuts Maraspin Creek in the " RF - 1 Residence F-1 Zoning District. The lot contains 3.0 acres, most of ^. which is salt marsh. According to the assessor's records the lot is developed 0 with a one story, one bath, two bedroom single family dwelling originally built in 1949. The property is served by public water and sewers. 3 The petitioner has requested relief from the 30 foot front yard setback to (` allow the addition of a 20 ft. by 22 ft. addition to the west side of the dexisting dwelling. The petitioner has owned the property for 45 years. The TU dwelling is apparently a pre-existing non-conforming structure that is set back only 12.3 ft. from .the front property line. The proposed addition is shown on a plan titled "Site Plan of Land in Barnstable, MA prepared for Albert Noyes" by Down Cape Engineering, Inc. dated 12-14-93 and revised 3-2-94. This plan indicates that- the new addition (in line with the existing building) is only 1.1.7 ft. back from the front property line, or. 18.3- into the required 30 foot setback. The architectural sketches submitted with the application indicate that the addition consists of a new j family room at the existing first floor level with a garage below. Procedural summary: 1 BF i791'� -00�35 �� -i1;-1i� 9:54 #2988 i Decision and Notice Appeal No. 1992-53 The application was filed in the office of the Town Clerk and at the Zoning Board of Appeals office on March 4, 1994. A public hearing, duly noticed under M.G.L. Chapter 40-A, was opened on April 20, 1994, at which time the hearing was closed and a decision rendered. The petition was heard by Board Members; Gail Nightingale, Richard Berry, Emmett Glynn, Elizabeth Nilsson and Chairman Richard Boy. The applicant represented himself before the Board and explained that he is seeking a variance due to the very limited amount of upland that is developable on the lot. The developable area is limited to a small triangular section of the lot adjacent to Commerce Road. The proposed location of the addition was dictated by the location of the existing structure, 12.3 inches from the front of the lot on Commerce Road 18 feet from the side lot line. An order of conservation has been issued that dictated the location of the proposed addition to be situated away from the wetlands 33 feet. These restrictions together leave no other alterative for expansion of the dwelling. The Board questioned why the applicant did not add to the structure a second floor and why they needed the additional room. He stated that he and his wife recently retired to the home which was their second home and now find it small for year round use. They are elderly and to located living space on the second floor could present a burden and an inconvenience in years to come. The public was requested to speak and no one was in favor or opposed. Findings: Based on the evidence presented and the testimony given at the meeting of April 20, 1994, the Zoning Board of Appeals unanimously finds as follows: 1. The petitioner .has requested a variance to permit development 11.7 feet from the front property line. 2. The proposal has been approved by Old Kings Highway Historic Commission and by Conservation Commission by an order of Conditions. 3. The dwelling is connected to public sewers which serves to mitigate and potential pollution impacts from on-site septic disposal to the neighboring wetland and Maraspin Creek. 4. There are variance conditions created by the triangular shape of the h developable section of the lot, its- limited. size and the slope of land to the wetlands. 5. To require the applicant to remain within the limited footprint now existing would force the building. of a second story presenting a hardship and may in fact be more intrusive to the general neighborhood. 6.
