SolarCity Corporation and Christina Brazelton will not be moving forward

Dear Ralph:
I have recently noted that there appear to be residents occupying the property at 281
Commerce Road in Barnstable. This property is owned by T.B. Brazelton. The property
was renovated over the past year by Mr. William D. Mullin. My concern is based upon the
fact that this property has not been inspected for its smoke detection system. In addition, the
alarm system has a direct tie in to an alarm company and the builder has not addressed
concerns that we have noted in regards to contact persons, caretakers, etc. I am concerned
that an occupancy permit may not have been issued for this property and that it is improperly
occupied at present. This property also had the alarm system and smoke detection system
installed before any permits and plans were presented to us. Although both the builder and
electrician are well known to us and did discuss these items after the fact, I would present this
example as evidence of a more diffuse problem with new construction. Some time ago, you
required electricians to get plans to us prior to building permit issuance. This practice
prevented builders from"slipping through the cracks". I would respectfully request that you
reinstate this policy as it avoids some of the problems I have noted above.

The petitioners, or at least one of them, have owned the property since 1974 with their family
having owned it from 1962. A house has existed on the property for many years and with
Conservation Commission approval, a building permit has issued for the construction of the dwelling
as it sits on the property. The portion being constructed includes an addition of an existing
underground garage which is 19 feet from the sideline of Commerce Road. The petitioners seek to
construct a deck, 5 feet in width, along the front of the structure as shown on the plan by Sara Jane
Porter, Architect. This deck would be within 23 feet of the sideline of Commerce Road. The
property is in an RF 1 district which requires a 30 foot front yard setback.
The building has existed prior to zoning and currently encroaches to approximately 20 feet
from the sideline as to the garage and 27 feet from the existing house. The deck, 5 feet in width,
because of the angle of the road would be 23 feet from the sideline of the road. The applicable zoning
is as follows:
4-4.3 Nonconforming Buildings or Structures Used as Single and Two Family Residences:
A pre-existing nonconforming building or structure that is used as a single or two family
residence may be physically altered or expanded only as follows:
1) As of Right:
If the Building Commissioner finds that:
A. The proposed alteration or expansion does n physical p of m any way encroach into the
setbacks in effect at the time of construction, provided that encroachments into a 10-foot rear
or side yard setback and 20-foot front yard setback shall be deemed to create an
intensification requiring a special permit under Section 4-4.3(2); and
B. The proposed alteration or expansion conforms to the current height limitations of the
Zoning Ordinance.
2) By Special Permit:
If the proposed alteration or expansion cannot satisfy the criteria established in Section
4.4.3(1) above, the Zoning Board of Appeals may allow the expansion by special permit
provided that the proposed alteration or expansion will not be substantially more detrimental
to the neighborhood than the existing building or structure.
Because the existing garage is 20 feet from the sideline and the proposed deck will only be
23 feet from the sideline, your petitioners believe that they are entitled to a permit as a matter of right
because they do "not in any way encroach into the setbacks in effect at the time of construction".
If despite the fact that the present building is 20 feet from the sideline and the deck is 23 feet,
the Board feels that there is encroachment into the setback in effect at the time of construction, then
the petitioners feel that to allow the construction of the deck in accordance with the recommendation
of the architect and due to the topography of the lot, which causes the property to be raised above
the road, and because of its placement on a curve in the road, the proposed expansion would not be
substantially detrimental to the neighborhood than the existing structure.
