DEFINITION OF HOMEOWNER Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is,or is intended to be,a one or two-family-dwelling,attached or detached structures accessory to such use and/or farm structures. A • person who constructs more than one home in a two-year period shall not be considered a homeowner. Such "homeowner"shall submit to the Building Official on a form acceptable to the Building Official,that he/she shall be . responsible for all such work performed under the building permit. (Section 109.1.1) The undersigned"homeowner"assumes responsibility for compliance with the State Building Code and other • applicable codes,bylaws,rules and regulations. . Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q, Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly 1 when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. • To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application, .- that the homeowner certify that he/she understands the responsibilities of a Supervisor. Based on a site visit by Turning Mill Consultants,Inc.the retaining wall is constructed of boulders approximately 3'x3'x2' in size with a 1:2 batter and a 12"gravel(3/4")drain with filter screen the full height of the wall(4'-8'). The backfill is a granular soil with mixed grain sizes with an assumed unit weight of 120pcf. The allowable net bearing pressure of the foundation soil is assumed to be 4000psf. The Factor of Safety for overturning at the 8' high section was calculated at 2.25 and is within allowable limits based on the NCMA Design Manual for Segmental Retaining Walls. Therefore,based on Turning Mill Consultants, Inc. foundation inspection and analysis the boulder retaining wall is within allowable industry limits. TION. 508-790-6227 Town of Barnstable Zoning Board of Appeals Decision and Notice Appeal Number 1995-35-- Vages Appeal of an Administrative Official Summary Upheld Applicant&Owner: Steven T.Vages and Beth S.Vages Applicant's Address: 8 Turtleback Road,Marstons Mills,MA 02648 Property Location: 383 Commerce Road,Barnstable,MA Assessor's Map/Parcel: 318 -009 Zoning: RF-1 Residential F-1 Zoning District Appeal Nos. 1995-35 appealed to the Zoning Board of Appeals in accordance with MGL Chapter 40 A,Sections 8 and 15,a decision of the Building Commissioner not to issue a building permit for a proposed single-family dwelling. Background Information: The applicant was seeking to build a single family dwelling along Commerce Road in Barnstable Village. The applicant received Old Kings Highway Commission Approval, most recently on December 14, 1994. The application for a building permit that was denied on February 01, 1995. The Building Commissioner cited that the plans presented constituted a third floor which is not permitted under zoning. The applicant is appealing this interpretation and is also seeking alternative relief for a variance from bulk regulations,maximum number of stories permitted to allow the floor area above the second floor to be utilized as living space. Definitions: State Building Code: Story: That portion of a building included between the upper surface of a floor and upper surface of the floor or roof next above. Zoning Ordinance as amended 1993: Story: That portion of a building included between the upper surface of a floor and the upper surface of the floor or roof next above and having a least one-half(1/2)its height above grade. Procedural Summary: The application was filed on February 16, 1995 and scheduled for hearing before the Zoning Board of Appeals on March 29, 1995. Board Members sitting on this appeal are: Ron Jansson,Richard Boy, Emmett Glynn,Tom DeRiemer and Chairman Gail Nightingale. Attorney Peter Freeman represented the petitioner and therefore had recused himself from the OKH hearing for conflict of interest. Neighboring houses have attic dormers and the petitioner thought they could too. The first building permit was granted without dormers. The widow walk in the plan is permitted. Proposed are shed dormers. In this instance there is no basement or half basement issue.They have a gable,steep pitched roof as required by Old King's Highway. The back of the house is the same with the roof dormers. According to Section 3-1.5 of the building regulations they are actually under the height maximum of 30 feet to the plate. Some people have referred to North Street,where there is a three story building above maximum height allowances. Mr.Freeman presented over 100 pictures of dormers in Zoning Board of Appeals Decision and Notice Appeal Number 1995-35--Vages this town. He said in 1993 our Zoning Ordinance was amended as to the definition of a story,but did not define a half story making one half stories questionable. In dealing with a height limitation;dormers do not offend that issue. Ralph Crossen,Building Commissioner quoted the State building code definition for"story". If an attic has a load bearing floor,has evidence of habitability,has windows and stairs up to it then it is a floor. Attorney Peter Freeman said that means we can not have an attic on a two story building. In Barnstable it is an enigma because of the space between the floor and the attic,it begs the issue of a half story. Perhaps it may have to do with a walk out basement. In 1993 the Planning Board amendments refer mostly to basements and concerns wetland basements particularly. • The Board asked what would be going on the third floor; an office space and/or recreational space. Attorney Freeman said the Zoning Ordinance was not intended to prohibit a dormer. He said it is what the common understanding would allow. A dormer could act as a half floor. The whole building height is only 27 feet to the ridge. As with the other homes in the area with dormers,an element of consistency needs to be followed. There really is no public safety concern. If you look at the history of the houses next doors you will see they have a third story or a third half story. Photos were shown of a mill with a shed dormer on Commerce Road,a dormer on the Bacon Barn Inn and several others including the home on Plum Street of the Assistant Town Attorney Ruth Weil. The Board said because several buildings in Hyannis have dormers does not establish a precedent and was not the intention of the Zoning Ordinance. We have question of intensity of use. An attic for storage is OK but using it for livable space is not.. Could you consider using it as storage? Attorney Freeman said as a common understanding here there is a history of using dormers in this town. Building Commissioner,Ralph Crossen said in 1979 the formal interpretation in language changed and number of floors specifically above grade came in. Primarily if you wanted it you could get around it by installing a sprinkler system. The Board said if the applicant wants to call it storage and seeing as it has a 7 foot, 3 inch head room area with a window and access by stairs then the key is habitable space. Common sense says it is not habitable without heat and insulation. A dormer is permitted as attic space. Electricity for light is OK. PUBLIC COMMENT: No one spoke in favor and no one was opposed: Francis Hunsiker of 312 Commerce Road spoke to ask questions and comment on the size of the home being tremendous,possibility of it being too high interfering with the view of other people and beauty of design is important to the Cape. One letter from John and Karen Kuba is in the file and did not object. FINDINGS: Ron Jansson Regarding Appeal Number 1995-35 --Vages--Appeal of a decision of the Building Commissioner 1. The State Building Code provides a story definition as: "Height,story: The vertical distance from top to top of two(2)successive tiers of beams or finished floor surfaces;and,for the topmost story,from the top of the floor finish to the top of the ceiling joists,or,where there is not a ceiling,to the top of the roof rafters." 2. Our Zoning Ordinance parrots the state code. 3. In reference to the plan submitted the building consists of three stories if the dormer is to be used as habitable space. 4. Our Zoning Ordinance prohibits more than two and one half stories. 5. The Building Commissioner acted correctly in issuing a denial of the applicant's request. 2 Zoning Board of Appeals Decision and Notice Appeal Number 1995-35--Vages Second: Richard Boy VOTE: AYE: Tom DeRiemer,Emmett Glynn,Richard Boy,Ron Jansson and Chairman Gail Nightingale.
