Dear Ms. Atsalis:
Based upon an anonymous complaint filed on September 2, 2016, a site visit was conducted at 56 _`
Communication Way by Consumer Affairs Officer Therese Gallant the same day. It was found that
approximately 73 vehicles were parked on the premise, some with HMI Parking stickers in the front
windshield (see attached photos).
A site visit was again conducted by CAO Gallant on Sunday September 4`h, wherein she had a
conversation with Mr. Demetris Atsalis who confirmed that he was storing vehicles at that site. Mr. Atsalis
stated that he had received approval from the previous Building Commissioner Tom Perry to store
vehicles there and Mr. Atsalis continued stating that a license was not required for vehicle storage.

An open air parking space is defined by MGL in Chapter 148 §56:
"...no person shall engage in the business of conducting or maintaining an open-air parking space
without a license therefor granted by the local licensing authority, approved in all cases by the
head of the fire department. Each license granted under this section and the application therefor
shall specify...the total area of the space therein to be actually used for parking or storing vehicles
and the maximum number of vehicles to be parked or stored in such area...Whoever, not being
licensed, engaged in a business required by this section to be licensed...shall be punished by a 1
fine or not more than three hundred dollars." 1
It was stated by Mr. Atsalis to Town Manager Mark Ells that the storage of vehicle use of the property was
allowed by the former Building Commissioner Tom Perry. Please be aware that the Building
Commissioner does not have the authority to exempt businesses of licensing requirements, and according
to town records HMI Parking Services is licensed to conduct open air parking at the following locations
only:
• 165 Ocean Street—96 spaces
• 110-116 Ridgewood Ave — 30 spaces
• 163 Barnstable Road—33 spaces
Therefore, it is confirmed that 56 Communication Way is not licensed by the Town Manager to operate
any form of open air parking operation or storage, as defined and required through MGL c.148 §56.
Due to a possible misunderstanding regarding this particular property and the process required to be
properly licensed, Mr. Scali invited Mr. Atsalis to a meeting at 200 Main Street, Hyannis on October 4,
2016. at 3pm, which Mr. Atsalis confirmed through text. In attendance was Town Manager Mark Ells,
Director of Regulatory Services Richard Scali, Deputy Fire Chief Dean Melanson, Interim Building
Commissioner Paul Roma, myself, Consumer Affairs Officer Therese Gallant, Chief Zoning Enforcement•

Flynn. Mr. Atsalis failed to appear at this agreed upon meeting, nor communicated a need for absence.
The meeting continued, without Mr. Atsalis, and it was agreed by all attending that a license to conduct
any form of parking as outlined in MGL c148 §56 was required. A site visit was then conducted by CAO
Gallant where approximately 25 vehicles with HMI Parking Services identified in windshields were still on
site at 56 Communication Way,
As a result, you are hereby ordered to immediately cease and desist any and all open air parking lot or
storing of vehicle operations on the unlicensed premises located at 56 Communications Way, and at any
other unlicensed premise within the Town of Barnstable, or the Consumer Affairs Division will begin the
process to take further action.
Further, if you wish to conduct such operations as defined in Chapter 148 §56 on any unlicensed premise
you must submit the following items prior to site plan review and a Licensing Authority public hearing for
consideration of a Chapter 148 §56 license;
a. License Application Form;
b. A parking plan of the licensed premises drawn and stamped by a Registered Professional
Land Surveyor specifying the area to be used for parking, identifying each parking space,
aisle, emergency aisle and fire lane, as required by 10.03C. Said plan shall be signed and
dated as approved by the Building Commissioner, Fire Chief (or his designee) and the
Town Engineer. The parking plan must indicate how many parking spaces are designated
for parking permit use, daily rate use or any other category of parking usage that is agreed
upon between,the parking operator and a patron, and such information will be documented
on the license;
c. A copy of the receipt to be used in customer transactions;
d. Daily, long term and permit rates intending to charge customers between May 1st and April
30t";
e. Proof of Workers Compensation Insurance;
f. Proof of an active business certificate; and
g. The fee for a Parking Lot License shall be $14.00 dollars per parking space annually and
due at the time application is submitted.

On Friday, September 2, 2016 at 3:55 p.m., Maggie Flynn, Administrative Assistant to the Town of Barnstable
Consumer Affairs Division advised me that she had just received a phone call from an anonymous male party
reporting an unlicensed parking lot operation.

Ms. Flynn stated that the male party told her that he works at Commonwealth Electric, and that the former State
Rep. is flying past that location with cars to be parked. The male party further stated that he (the State Rep.) makes
rude comments to the people who are standing outside smoking.
Ms. Flynn said that she asked this caller if he was referring to Demetrius Atsalis and the caller stated "yes". He
went on to describe the location as being near 25 Communication Way, in the area of the Cape Cod Times
distribution center. He also stated that the lot where the cars are being parked is across from pole number 333. He
described the area as the third driveway before the fence and added that this operation has been going on for years.
NOTE: This area was later identified as 56 Communication Way, Barnstable, MA.
In a follow up to that call, I responded to that area at approximately 4:20 p.m. and located the "third driveway" to
the right of a fenced drive. I drove down the road and saw that it opened up to a large dirt lot area near the power
lines (noting pole #333 as described by the caller). I then observed what I later learned to be 73 motor vehicles
parked in an orderly fashion, in several rows, backed in. I called the station to document this investigation and
shortly thereafter photographed and recorded the vehicles in place. While taking pictures, I noted that nine of these
vehicles had labels located on their windshields with HMI Pass designation(s) on them. HM1 Parking Services,
-LLC is a known parking business of the Atsalis Family.
To follow up on this report, on Sunday, September 4, 2016 at 12:34 p.m., I returned to the area of 56
Communication Way in Barnstable to see if any changes had taken place. I took additional photographs and noted
that some vehicles had been removed since my previous visit and that at least one new one had been added (61
vehicles). I took photographs of these vehicles and exited the area. I was still on Communication Way when 1
noted a Black SUV drive by me and head into the area that I had just left(56 Communication Way). I followed this
vehicle in and noted one of the occupants, in a bright orange shirt, exit the vehicle and enter one of the parked cars.
1 then encountered another occupant of this vehicle, known to me as Demetrius Atsalis and spoke with him about
this situation.
Mr. Atsalis stated that this is not a parking lot but rather a long term storage area. He added that people who reside
on Nantucket pay a flat fee for him to store their cars. He stated that he spoke with Tom Perry,the former Building
Commissioner in June of this year (2016) and that he had told him that this area, formerly the business of Better
Stones, was zoned to allow for the storage of cars but that the other side of Independence Park was not zoned for
that.
I asked Mr. Atsalis how long had he been doing this and he stated, "just this year, since June 15th," He stated that
he had spoken with Sid Davidson, from Independence Park who told him that Better Stones had moved out of this
i area. He said that it was Mr. Davidson who allowed him to store the vehicles there and that the cars would be
cleared out no later than the end of the month. Mr. Atsalis stated that the remaining cars would then be moved,to
the lot located at 163 Barnstable Road. I advised Mr. Atsalis that it was likely that he needed a license to operate
this storage of vehicles and he reiterated that Tom Perry had told him that the area was zoned for this use and that
these vehicles were not short term parking for people to visit the islands but rather long term storage where they,
paid a flat fee. I advised him that I would document our conversation and I would be in touch.

On Tuesday, September 06, 2016 at 9:00 a.m., I spoke via the telephone with Sid Davidson who is the director of
the Lyndon Paul Lorusso Charitable Foundation. NOTE; 56 Communication Way is property owned by the
Lorusso Foundation.
Mr, Davidson confirmed that there is a temporary lease with Demetrius Atsalis for this property. He added that he
thought the lease began just after Memorial Day and is due to end by September 15, 2016 although there was
discussion of extending it until mid October. Mr. Davidson added that this was only a temporary arrangement as
the land is to be developed soon,
Mr. Davidson stated that Mr. Atsalis had told him that the former Building Commissioner, Tom Perry had told him
that he could store cars there. "I assumed that he had done his due diligence to make sure that this was a proper use
of the land." Mr. Davidson explained thatlhe believed that Mr. Atsalis stored the vehicles of the "year rounders".
(those who live on the island) on his lot on Ocean Street in the off months and,that once Memorial Day arrived, he
moves these vehicles to another location, "I think when they come over to the mainland, they call him up and he
brings their vehicle to them at the boat and then returns it to the lot once they go home." In a later conversation,
Mr. Davidson added that the lease was a verbal agreement as it was short term. He stated that the only thing they
had required of Mr. Atsalis was confirmation that he had insurance to store the vehicles on that parcel of land. I
asked if he had a copy of the insurance binder and I was told that they were verbally advised that the insurance was
in place. i
l later spoke with the Building Commissioner, Paul Roma about this land use and was advised that this particular
enterprise, the storage of vehicles, is not allowed as it is not part of the Principal Pemitted Uses as delineated by
the Town of Barnstable Zoning Code, Chapter 240-33 A.

PARKING LOT REGULATIONS
REVISED — DECEMBER 13, 2011
1. Parking lots must comply with all Town of Barnstable Ordinances and
Regulations and shall meet the requirements of zoning, Including the site plan
review process. A detailed plot plan of the premises specifying the area to be
used for parking must be submitted with the application. The plot plan must be
approved by the Fire Chief and the Town Engineer before the license shall be
approved. A copy of the plot plan shall be retained by the Town Engineer and a
copy shall at all times be available for inspection on the premises by any town
officer. All vehicles shall be parked in spaces as shown on the approved plot
plan and no vehicle shall be parked so as to block the exit or entrance of any
other vehicle. NO PARKING LOT SHALL BE OPERATED WITHOUT A VALID
LICENSE ON THE PREMISES.
2. A statement of the current maximum daily rate shall be posted conspicuously on
the lot. The rate statement must be visible to a customer from the street at all
times. The posting of the maximum daily rate shall be in clearly readable block
letters 12 inches high and 6 Inches wide with a 1 inch stroke. There shall be a
minimum of'1 inch of clear space between all numbers and a minimum of 1 1/2
inches of clear, space between the outside of the numbers and any other
lettering. It the lot uses more than one entrance, each entrance must comply
with this section.
3. A notice shall be posted' conspicuously on the premises detailing who to contact
in the case of emergency. Said information shall contain a telephone number
where a person authorized to conduct the business of the owner may be reached
during those hours that the lot is not manned. The same information must be
legibly printed on the back of all receipt tickets given to customers.
4. A notice shall be posted conspicuously detailing when a refund may be due a I
customer and further explaining how to apply for a refund in the event the lot is
not manned at the time of return of the customer. Customers intending to use a
service, such as a boat line or sightseeing, which is cancelled or sold out or
otherwise not available, and return to the parking lot within one hour of parking
and inform the attendant of the cancellation or nonavailability of the intended
service may be charged a maximum of two dollars ($2.00). The same
information must be legibly printed on the back of all receipt tickets given to
customers. j
5. No parking lot. operator or employee shall accept payment from a customer
without issuing a receipt. Each receipt must contain the name and address of
the lot, the date of the transaction, the maximum daily rate, the number of days
paid for, and the total dollar amount charged. The receipt must also contain the

information required in 3 and 4. A copy of the receipt to be used must be filed
with every new or renewal application.
6. License holders shall notify the Licensing Authority in writing of their rates and no
change in rates may be implemented until twenty-four(24) hours after notification
in writing to the Licensing Authority of the proposed rate change.
7. Permit must be posted conspicuously on the premises.
8. There shall be no soliciting business on any public way, which includes a town
sidewalk. No license holder or any employee of a licensee shall signal from upon
the licensed premises or upon the'public way a moving vehicle on any public way {
or cause the stopping of a vehicle thereon. Under no conditions shall any license I
holder or employee signal or direct traffic on a public way. At all entrances and I
exits to a public way, all license holders and employees shall remain inside the
licensed premises, and off the public way.
9. No license holder or any employee of a license holder shall by means of outcry
accost any occupant of a moving vehicle which is on a public way. I
10. The fee for a parking lot license shall be eight ($8.00) dollars per parking space

11. The Rules and Regulations are adopted under the authority of Massachusetts
General Laws Chapter 148 Section 56.

12. Any violation of these Rules and Regulations or violations of any Towri of
Barnstable Ordinance or Regulation, or Massachusetts General Laws, shall be j
cause for rejection., suspension or revocation of a Parking Lot License. Any
violation of these regulations may be enforced by the methods provided in
Section 21 D of Chapter 40 of the General Laws. The fine for violations enforced
by said Section 21 D of Chapter 40 shall be one hundred ($100,00) dollars. I

Section 56 Parking space business; licenses; fees; term; suspension and revocation; unlicensed business
i
Section 56. In any city or town which accepts the provisions of this section, no person shall engage in
the business of conducting or maintaining an open-air parking space without a license therefor
granted, in the city of Boston, by its commissioner of transportation, and in any other city or town, by i
the local licensing authority, approved in all cases by the head of the fire department. Each license
granted under this section and the application therefor shall specify all the premises to be occupied by
the licensee for the purpose of conducting the licensed business, the total area of the space therein to
be actually used for parking or storing vehicles, and the maximum number of vehicles to be parked or
stored in such area. The fee for each such license shall be such amount as may be established by the
authority granting the license, and said authority may reasonably classify said licenses and fees.
Licenses granted hereunder shall expire on April thirtieth following .the date of issue, or on such date
as may be specified therein, and may be suspended or revoked by such authority and by the head of
the fire department. Whoever, not being licensed, engages in a business required by this section to be
licensed, or is concerned therein, or, being licensed, violates any condition of his license or engages in
such business, or is concerned therein, and any other place than that designated in his license or after
notice to him that his license has been suspended or revoked, shall be punished by a fine of not more
than three hundred dollars. The provisions of this section shall not apply to any open-air parking space
established under paragraph (g) of section three of chapter one hundred and sixty-one A or under
paragraph (g) of section six of chapter one hundred and sixty-one B and maintained or conducted by
the Massachusetts Bay Transportation Authority or by an authority created under said chapter one
hundred and sixty-one B or a lessee or licensee thereof.

Dear Ms. Atsalis
Based upon an anonymous complaint filed on September 2, 2016, a site visit was conducted at 56
Communication Way by Consumer Affairs Officer Therese Gallant the same day. It was found that
approximately 73 vehicles were parked on the premise, some with HMI Parking stickers in the front
windshield (see attached photos).
A site visit was again conducted by CAO Gallant on Sunday September 4th, wherein she had a
conversation with Mr. Demetris Atsalis who confirmed that he was storing vehicles at that site. Mr. Atsalis
stated that he had received approval from the previous Building Commissioner Tom Perry to store
vehicles there and Mr. Atsalis continued stating that a license was not required for vehicle storage
purposes.
An open air parking space is defined by MGL in Chapter 148 §56:
"...no person shall engage in the business of conducting or maintaining an open-air parking space
without a license therefor granted by the local licensing authority, approved in all cases by the
head of the fire department. Each license granted under this section and the application therefor
shall specify...the total area of the space therein to be actually used for parking or storing vehicles
and the maximum number of vehicles to be parked or stored in such area...Whoever, not being
licensed, engaged in a business required by this section to be licensed...shall be punished by a
fine or not more than three hundred dollars."
According to town records, HMI Parking Services is licensed to conduct open air parking at the following
locations only:
• 165 Ocean Street-96 spaces
• 110-116 Ridgewood Ave- 30 spaces
• 163 Barnstable Road -33 spaces
Therefore, it is confirmed that 56 Communication Way is not licensed by the Town Manager to operate
any form of open air parking, as defined and required through MGL c.148 §56.
As a result, you are hereby ordered to immediately cease and des.ist-any-and-all;open:air-parking lot or
storing of vehicle operations on the unlicensed premises Iocated,at 56 Com_ m_ unications Way, and at any
other unlicensed premise within the Town of Barnstable.
Further, if you wish to conduct a such operations as defined in Chapter 148 §56 on any unlicensed
premise you must submit an application' and certified engineered floorplan to Site Plan Review prior to a

In doing more research,cars have apparently not been considered a"storage"vessel for haz mats. Consequently, I do
not believe 240-33-2 and 240-35-G.2.c,d, and a apply. This is too strict a reading of the word. However,this does not
relieve the other requirements of both zoning and licensing.There is nothing in the street file indicating a permitted
parking lot or open air storage facility.

The interim Building Commissioner determined that vehicle storage/parking is not permitted on.this lot because of the
prohibition in the IND regarding the storage of vehicles containing hazardous materials. Paul was requested to give the
opinion in fairly short order, so I don't know if it included a zoning history or an analysis of pre-existing nonconforming
uses.The general rubric is that current zoning applies unless there is a.demonstration by the property owner that there
is a legal pre-existing nonconforming of the property that meets all the criteria attendant thereto. l will allow Paul to

The canceled zoning approval and withdrawal (2013)was for a satellite parking.lot for Atsilas. This information was
found in the 84 Barnstable Road street file along with a letter of explanation from Tom Perry. This proposal included 84
+92 Barnstable Road. (Please see attached)

92+84 Barnstable Road +79 Center Street historically have been used and permitted together. Please see the attached
site plan review staff report and SPR approval letter from Nauset Marine back in 2005. A favorable zoning
determination was made by the Building Commissioner to allow Nauset to replace the previous tenant,Cape Water
Sports because it was the exact same use even though the new HVB zoning excluded this use.
In 2014, A new tenant, Gracie Fitness, was approved via Business Certificate (attached)to use 92 +84 Barnstable Road
together for martial arts use. 92 Barnstable Rd. has very little parking, so 84 Barnstable Road presently is supposed to
be used as customer parking for the 92 Barnstable Road tenant.
The Assessor's use code for this property currently is 3300 which is automotive sales and service. There is not an
Assessor's boat sales and service code so this is probably closest. However,when printing sign permits etc,the system
defaults to "automotive sales and service"which ends up being printed on its face. This could possibly be causing some
confusion as to what is allowed.

Dear Mr. Oheim:
Please be advised that the above-referenced proposal was administratively approved at the staff
meeting of October 21, 2008 subject to the following conditions:
• Approval is based upon site plan review application, plans and information package
submitted October 9, 2008 and identified as referenced above and subsequent letter dated
October 20, 2008 in response to Site Plan Review Committee comments generated from
review of project at the October 14, 2008 staff meeting.
• Submission to and approval by Site Plan Review Committee of a landscape plan to
provide an acceptable visual screening barrier where possible along the eastern property
line.
• Applicant must obtain all other applicable permits, licenses and approvals required.
• Upon completion of all work, a registered engineer shall submit a letter of certification,
made upon knowledge and belief in accordance with professional standards that all work
has been done in substantial compliance with the approved site plan (Zoning Section 240-
104 (G).
A copy of the approved site plans and supporting information will be kept on file at Town of
Barnstable Offices located at 200 Main Street, Hyannis, MA.

Please be advised that this application was approved at the Site Plan Review meeting on
June 27t'with the following conditions:
• The use of barbed wire is prohibited.
• A paved apron shall be provided by the gated entrance.
• All prohibited uses and materials shall be posted in the work area and
corresponding language shall be included in all leases and sub-leases.

Dear Mr.Lorusso:
It was recently brought to my attention that someone has illegally dumped a large amount of construction
debris and hazardous materials in the Industrial Park on one of your lots. This must be one of your most
difficult problems to control given the vast open area in the park..Given the types of materials in this
dumping,however,it needs to be addressed as soon as possible.
I found the debris piles on map/parcel 315/040(56 Communication Way)which is down a dirt path next to
the trailer location of"Atlantic Contractors". This site adjoins the Cape Cod Times site and is
distinguishable by the new chain across the driveway at Communication Way. Chemicals in large
containers were found including oils,acids,landscaping chemicals,and other containers usually one to five
gallons in size each. Most appeared to still be in their containers. However,I could not be sure of that.
Attached is a map of the area. I have marked the area for you as"dump area". Please take immediate steps
to clean this area up as soon as you see it. I only request that you give me a call after the debris is removed
so I can close this out.
