Summary: Granted with Conditions Petitioner: Coastal Sun Limited Partnership Property Address: 270 Communications,Way,_ ,._,:._. Assessor's Map/Parcel: Map 296,Parcel 031 Zoning: Industrial Zoning&Wellhead Protection Overlay Districts Relief Requested& Background: According to the Assessor's Record,the property is a 6.31 acre parcel developed with 10 industrial buildings used for storage and warehousing. The property is located in the industrial area of Independence Park fronting on Independence Way in Barnstable. The property is accessed via a 24-foot access easement from Communication Way over the neighboring property of Hyannis Office Park Center. Development of the subject property dates to 1988 through 1990 and today has a total effective area of 96,277 sq.ft. of building area. According to the plans submitted with the application,lot coverage by building is currently 28.5%. The applicant is proposing to construct a 997 sq.ft. second floor office addition. The addition is cantilevered slightly over the existing first floor footprint. To accomplish the plan,the applicant has submitted a petition for a special permit and an application for a variance. Appeal 2005-075 is seeking a special permit in accordance with Section 240-93.B for the expansion of a pre= existing,nonconforming structure to allow for an addition that purports: • will increase the lot coverage by buildings beyond the 25%permitted; • will further reduce.the.27.65..foot nonconforming,side yard setlack,to a 25.71foot setback; and • to permit expansion of a structure on the site that does not conform to the 50%limitation on impervious coverage by buildings, structures, and paved surfaces imposed in the Groundwater Protection Overlay District regulations. Appeal 2005-076 seeks three Variances.The first two variances requested are to Section 240-33.E,Bulk Regulations to allow the proposed addition to: • intruded into the required 30-foot side yard setback by 4.3 feet; and • to exceed the 25%maximum lot coverage by buildings by 3.5%. The third variance request is to Section 240-35.G(3),Groundwater Protection Overlay District Regulations, maximum impervious coverage to exceed the 50%limitation on impervious coverage by buildings, structures, and paved surfaces in a wellhead protection area. &HearingSummary: Procedural These appeals were filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on July 29,2005. An Extension of the Time Limits for holding the public hearing and for the filing of the decision was executed between the applicant and the Board Chairman. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened September 14,2005,continued to October 19,2005 and November 02, 2005 at which time,testimony was taken and the Board found to grant both the special permit and variances with conditions. Board Members deciding the appeals were,Ron S. Jansson,Randolph Childs, James R.Hatfield, Daniel M. Creedon III,and Gail Nightingale, Chairman. Attorneys Eliza Cox and Patrick M. Butler represented the applicant. Ms Cox noted that a memorandum in support of the application dated October 4,2005 had previousiTbeen submitted'to the Board. She presented a summary of the existing conditions and the proposed expansion citing that the proposal was to add a 997 sq.ft. office area to the second floor. The office would be accessed with a new exterior staircase that occupies 113 sq.ft. The infringement was characterized as being diminimus. With respect to the non-conformity in structure including lot coverage,Ms Cox noted that the Definitive Plan for the subdivision was approved in March of 1986 and that the groundwater protection overlay district regulations did not come into effect until November of 1987. This being the case,the subdivision lots were protected for 7 years from those dimensional provisions imposed by the Groundwater Overlay District Regulations. The subject lot was developed according to applicable dimensional and lot coverage at the time of the subdivision plan, 1986. Therefore,the dimensional non-conformities are legal pre-existing non- conformities. The Board and Ms. Cox discussed the option of locating the proposed second floor over another existing building located on the property. It was noted that all of those structures are storage warehouse buildings and may not be capable of accommodating a second floor. The proposed infringements were detailed and it was noted that the infringements, although slight,did increased the degree on non-conformities. The Board determined that it would be in the best interest of the applicant that both appeals be granted for the addition. Public comment was requested and no one spoke in favor or in opposition to the request. Findings of Fact: At the hearing of November 2,2005,the Board unanimously Made the following findings of fact: 1. In Appeal 2005-075 the applicant is Coastal Sun Limited Partnership. The applicant is seeking a special permit for the expansion of a pre-existing,nonconforming structure. The property is addressed 270 Communications Way,Hyannis,MA and is located as shown on Assessor's Map 296 as Parcel 031. It is in an Industrial Zoning District and a Wellhead Protection Overlay District. 2. The applicant has applied for a Special Permit pursuant to Section 240-93.B,Expansion of a Pre- existing,Nonconforming Structure. The applicant is seeking to construct a separate 2nd floor office space of 997 sq.ft., and add a 113 sq.ft. exterior staircase that will increase the lot coverage,impervious coverage and side-yard setback nonconformities of the structure. 3. Although the second floor office space will not be any closer to the side yard set backs in terms of the measurement on the ground, it will slightly intensify the set back districts from the second floor overhang. The distance from the second floor overhang to the side yard property line will be reduced to 25.71 feet— 2.2 feet closer to the property line - and the stairwell will be approximately 24.98 feet from 2 r the property line. In terms of lot coverage and impervious coverage,the only increase is a result of the proposed stairwell which consists of 113 sq.ft.. 4. Because the definitive plan for the subdivision was endorsed prior to enactment of Groundwater Protection Overlay District regulations,the zoning was frozen for a period of seven years following endorsement of the plan. During that freeze period,the subject property was developed in its current pre-existing non-conformingto configuration. As such,the existing development is considered legally pre e g the 50%impervious coverage enacted pursuant to adoption of Groundwater Protection Overlay Districts. 5. This relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Decision: _. Based on the findings of fact, a motion was duly made and seconded to grant the appeal with the following conditions: 1. Development of the site shall be as proposed in a plan entitled"Hyannis Coastal Sun Self Storage" as drawn by BSC Group, dated June 26, 2005 and consisting of 2 sheets. 2. Use of the space to be added shall be limited to office use accessory to the principal use of the site— storage and warehousing. The area shall not be used as a separate office suite. 3. Development shall conform to all applicable building,fire and health regulations. 4. There shall be no further expansion of the structures or surface covering of the lot by impervious surfacing without permission from the Board. The vote was as follows: AYE: Ron S. Summary: Granted with Conditions Petitioner: Coastal Sun Limited Partnership Property Address: 270 Communications Way,Hyannis,MA Assessor's Map/Parcel: Map 296,Parcel 031 Zoning: Industrial Zoning&Wellhead Protection Overlay Districts Relief Requested &Background: According to the Assessor's Record,the property is a 6.31 acre parcel developed with 10 industrial buildings used for storage and warehousing. The property is located in the industrial area of Independence Park fronting on Independence Way in Barnstable. The property is accessed via a 24-foot access easement from Communication Way over the neighboring property of Hyannis Office Park Center. Development of the subject property dates to 1988 through 1990 and today has a total effective area of 96,277 sq.ft. of building area. According to the plans submitted with the application, lot coverage by building is currently 28.5%. The applicant is proposing to construct a 997 sq.ft. second floor office addition. The addition is cantilevered slightly over the existing first floor footprint. To accomplish the plan,the applicant has submitted a petition for a special permit and an application for a variance. Appeal2005-075 is seeking a special permit in accordance with Section 240-93.B for the expansion of a pre- existing,nonconforming structure to allow for an addition that purports: • will increase the lot coverage by buildings beyond the 25%permitted; • will further reduce the 27.65 foot nonconforming side yard setback to a 25.71 foot setback; and • to permit expansion of a structure on the site that does not conform to the 50%limitation on impervious coverage by buildings, structures, and paved surfaces imposed in the Groundwater Protection Overlay District regulations. Appeal 2005-076 seeks three Variances.The first two variances requested are to Section 240-33.E,Bulk Regulations to allow the proposed addition to: • intruded into the required 30-foot side yard setback by 4.3 feet; and • to exceed the 25%maximum lot coverage by buildings by 3.5%. The third variance request is to Section 240-35.G(3),Groundwater Protection Overlay District Regulations, maximum impervious coverage to exceed the 50% limitation on impervious coverage by buildings, structures,and paved surfaces in a wellhead protection area. Procedural &Hearing Summary: These appeals were filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on July 29,2005. An Extension of the Time Limits for holding the public hearing and for the filing of the • decision was executed between the applicant and the Board Chairman. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened September 14, 2005,continued to October 19, 2005 and November 02, 2005 at which time,testimony was taken and the Board found to grant both the special permit and variances with conditions. Board Members deciding the appeals were,Ron S. Jansson,Randolph Childs, James R. Hatfield, Daniel M. Creedon III, and Gail Nightingale,Chairman. Attorneys Eliza Cox and Patrick M. Butler represented the applicant. Ms Cox noted that a memorandum in of the application dated October 4,2005 had previously been submitted to the Board. She presented support PP a summary of the existing conditions and the proposed expansion citing that the proposal was to add a 997 sq.ft. office area to the second floor. The office would be accessed with a new exterior staircase that occupies 113 sq.ft. The infringement was characterized as being diminimus. With respect to the non-conformity in structure including lot coverage,Ms Cox noted that the Definitive Plan for the subdivision was approved in March of 1986 and that the groundwater protection overlay district regulations did not come into effect until November of 1987. This being the case,the subdivision lots were protected for 7 years from those dimensional provisions imposed by the Groundwater Overlay District Regulations. The subject lot was developed according to applicable dimensional and lot coverage at the time of the subdivision plan, 1986. Therefore,the dimensional non-conformities are legal pre-existing non- conformities. The Board and Ms. Cox discussed the option of locating the proposed second floor over another existing building located on the property. It was noted that all of those structures are storage warehouse buildings and may not be capable of accommodating a second floor. The proposed infringements were detailed and it was noted that the infringements, although slight,did increased the degree on non-conformities. The Board determined that it would be in the best interest of the applicant that both appeals be granted for the addition. Public comment was requested and no one spoke in favor or in opposition to the request. Findings of Fact: At the hearing of November 2,2005,the Board unanimously made the following findings of fact: 1. In Appeal 2005-076 the applicant is Coastal Sun Limited Partnership. The applicant is seeking a variance to setback,lot coverage by buildings and lot coverage by surfacing for the expansion of an existing structure. The property is addressed 270 Communications Way,Hyannis, MA and is located as shown on Assessor's Map 296 as Parcel 031. It is in an Industrial Zoning District and a Wellhead Protection Overlay District. toSection 240-33.E,Bulk 2. The applicant has petitioned for Variances S oRegulations and to Section 240- 35.G(3),Maximum Impervious Coverage in a Wellhead Protection Area. The applicant seeks to construct a separate 2nd floor office space of 997 sq.ft., and add a 113 sq.ft. exterior staircase that will intrude into the required side yard setback, exceed the maximum lot coverage by buildings, and exceed the maximum lot coverage by impervious surfaces. 3. Although the second floor office space will not be any closer to the side yard set backs in terms of the measurement on the ground,it will slightly intensify the set back districts from the second floor overhang. The distance from the second floor overhang to the side yard property line will be reduced to 25.71 feet—2.2 feet closer to the property line - and the stairwell will be approximately 24.98 feet from • the property line. In terms of lot coverage and impervious coverage, the only increase is a result of the proposed stairwell which consists of 113 sq.ft.. 4. Unique conditions do exist with respect to topography of the structures located on the property and their use as storage buildings. Most of the storage structures are of a lighter construction and can not easily accommodate expansion of a second floor. This particular structure can accommodate a second floor. 5. A literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner, and the relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Decision: Based on the findings of fact, a motion was duly made and,seconded to grant the appeal with the following conditions: 1. Development of the site shall be as proposed in a plan entitled"Hyannis Coastal Sun Self Storage" as drawn by BSC Group,dated June 26,2005 and consisting of 2 sheets. 2. Use of the space to be added shall be limited to office use accessory to the principal use of the site— storage and warehousing. The area shall not be used as a separate office suite. 3. Development shall conform to all applicable building,fire and health regulations. 4. In doing demolition at a project in Hyannis,we did generate some dust. The process was cutting up concrete floors with jack hammers. The noise caused the school next to the work to create a flood of calls to every agency. We ere investigated by the Barnstable Fire Dept.which told us we were doing everything O.K. we used HEPA half masks and face and eye protection,used ventilation equipment,vacuumed with HAYCO HEPA vacuums and in the final stage used Negative Air at 6500cf/min to ventilate and clean the air. Concrete saws used water to minimi7e the dust. A majority of the dust came from dirt dug from beneath the concrete floors after cement work was completed. An inspection was also completed by the Barnstable Board of Health and the Building Commissioner. All agencies found that all procedures used were acceptable and that complaints were made due to mainly noise that interrupted the classes in adjoining buildings. I have notified all investigating agencies to contact me if further complaints are made,and told them to feel free to stop in at any time to inspect our procedures as the work progresses. One handicapped parking space is to have the proper signage with a "van accessible" sign, and one handicapped parking space is to have the proper signage. Also, the rear door, which is to be handicapped accessible, must comply with 521 CMR 26.10 Please mark the units in this building, front and back, to make it easier for the fire department in case of an emergency.
