This document will explain the train of events as follows.It started on September. 9,2002 with a notice to Dublin Const.which was starting that it had come to the Building Dept. attention of a request of a change of address and that Dublin Const.had changed the footprint of foundation and access to property.We requested he submit a certified as built plan and contact Old Kings Highway on the changes that had been made.This also stated that failure to do so within 14 days of receipt of this notice will result in a stop work order.I David W Mattos local inspector for the Town of Barnstable went to 11 Desert Sands Ln.Barnstable on September 20 2002 to do a frame inspection which I had to reject for the reasons of the egress window size in bedrooms were to small.I explained to contractor of the problem.I wrote a inspection correction notice documenting the situation.The problem was fixed by pulling out two clips in window which made window open wider to meet code. So I approved the house frame so he could continue with construction.I was called on September 27 2002 to do a insulation inspection on the building.I went to the building the same day when I arrived to inspect the job it was only half done so I rejected the binsu inspection and put a sticker of rejection on a window.I received a call from Mr.Robert Dunphy on September 26 2002 at about 4:00 pm that day.He was concerned about rejection,but realized after they had not finished the insulation.He then continued to inform me of a problem he which was he had sheet rocked the building already which was a violation of the Massachusetts building and regulations code.The insulation has to be approved before covering walls.I asked him how we were going to solve this matter.He suggested a signed affidavit stating the insulation was done to code# 780 cmr.I agreed that would be sufficient.I received a fax on September 27 2002 from Mr.Dunphy stating as such.I then approved the insulation inspection under those conditions. I was approached on September 28 +29 2002 about the problem of the footprint being changed with no compliance from Dublin Const.I then called Mr.Dunphy about the movement of the house he in turn told me he did not move the house that he was just trying to change the entrance to property.I told him that I would look into the matter and we need a new as built plan.I also told him he need to get a herring date with Old Kings Highway.I then talked to his wife at the counter she also stated he did not move the house on the lot.I then did research on this problem and was told the house was moved.I then called Mr.Dunphy about situation he then admitted he did move the house on the lot.I informed him that if I did not get a new as built plan and apply for a date with Old Kings Highway that I would put a stop work order on building. On October 14 2002 I discussed problem with commissioner as a result of that meeting I decided to put a stop work order. I went to 11 Desert Sands on October 15 2002 to put a stop work order.When I arrived I asked workmen to leave job due to order.They all left the job so I continued with my day. I did not hear from Mr.Dunphy so on October 17 2002 I revisited the job site to find the work order torn down and men working on house.I requested the workmen to leave then proceeded to put another stop • work order.'Mr.Dunphy spoke to me by phone on job site I told him I would not lift stop work order until he registered for a herring date with Old Kings Highway and received a new as built plan.When I returned to office there was a recorded date for herring which showed the movement of the house.At that point I let them go back to work on building. I received approval from Old Kings Highway on November 13 2002 which there is a 14 day appeal process before we can release approval.I wrote approval date on my calendar so I could contact Mr.Dunphy for a final inspection.In the meantime the owners of the property had moved in without an occupancy permit.I talked to Mr.Dunphy and set up a date for inspection which was December 4,2002.I arrived at the house to meet him but just the new owners were there.I explained why I was there and continued to do my inspection.Mr.Dunphy never showed up for the inspection. The next day I called and spoke to Mrs.Dunphy about the occupancy permit.I told her that she could come down in the morning and I would process the card and she would have to pay$70.00 for the two stop work orders.She told me this would not be a problem and she would be in to see me.Mrs.Dunphy never showed up for the card or to pay the fee. I have not heard from Dublin Construction as of this date,December 18,2002.
