DEFINITION OF HOMEOWNER Person(s)who owns a parcel of land on which_rie/she resides or intends to e ide, on which there is, or is intended to be a one or two-family dwelling, attached or detached structures accesso to uch use and/or farm structures. A person who constructs more than one home in a two-year period shall n be ca sidered a homeowner. Such "homeowner"shall submit to the Building Official on a form acceptab to the uilding Official,that he/she shall be responsible for all such work performed under the building permit. ( ecdon 109. .l) The undersigned"homeowner"assumes responsibility for complia ce with the Stat Building Code and other applicable codes,bylaws, rules and regulations. `` The undersigned"homeowner"certifies that he/she understan the Town of Barnstable Building Department minimum inspection procedures and requirements and that h she will comply with saidrocedures and requirements. H 4EOWNER'S EXEMPTION The Code states that: "Any homeowner per rming work for which a building permit is required shall be exempt from the provisions of this section(Section 109.1.1 -Licensing of constru ion Supervisors);provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as supervisor." . Many homeowners who use this exem ion are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q, Rules&Regulations for Licensing Constructio upervisors,Section 2.15) This lack of awareness often results in serious problems;particularly when the homeowner hires unlicensed person . In this case,our Board cannot proceed against the unlicensed person as it would witla,a licensed Supervisor. The homeowner acting as Sup 'sor is ultimately responsible. To ensure that the homeowner s fully aware of his/her responsibilities,many communities require,as part of the permit appl,ication, that the homeowner certify that he/she , derstands the responsibilities of a Supervisor. On the last page of this issue is a form currently'used by several towns. You may care t amend and adopt such a form/certification for use in your community. A Public Hearing was duly advertised and notices sent to all abutters in accordance with the Old King's Highway Regional Historic District Act. The Hearing was opened on December 11, 1996. Committee members hearing this appeal were Patricia Savage;.David Babbitt, Stanley Alger, Paul Shoemaker and the Chairman peter Freeman. Paul Coleman from the Town of Barnstable Department of Public Works explained the refuse control difficulties at the Mill Way Marina, and the difficulties of finding a good location for the durnpster and stockade fence. Mr. Richard Marchand, the abutter directly across the street from the location of the dumpster and stockade fence (which is already erected), expressed his strong dislike of its looks, its aesthetics, its not fitting in with his very historic house, and the functional problems. The Committee felt that the fence and durnpsters were unsightly, especially in view of the historical nature of Mr. Marchand's house directly across the street. The unanimous position of the Committee was that the stockade fence (and Dumpster)were incompatible with the area, and obviously incongruous to the purpose and intent of the Old King's Highway Act.
