Dear Mr. Crossen:
Thank you for meeting with us last Friday to review the condition of the Canal Marine buildings
and our pilings near the property line. We have just received your letter dated 9/9/98,and find that
we came away from that meeting with a slightly different understanding than you outline in the
letter.
As you know,there are at least four buildings on pilings over the water at the Canal
Marine/Barnstable Marine site. Three of the buildings are entirely on Canal Marine property. The
beams and pilings under these three northernmost buildings, as you pointed out,appear to be in
very bad condition.-.:In fact;;sections,of;theo:north end have,recently collapsed.
The southernmost building,of which we own a portion, is the newest of the entire complex.We
would argue that;although it is not in terrific condition, it is in no danger of falling down. We
believe that, as it stands,this building is not a threat to public safety. It is the planned demolition
activity around this building that will compromise its integrity.
We are not familiar with the law governing such issues. However,we do feel that common sense
would dictate that the party seeking to change the status quo should be responsible for the
protection of abutters'property. It was our understanding, from our meeting last week,that a
review of demolition plans would be forthcoming,and that a discussion of the protection and
reinforcement of our property would be included.
In light of the short notice we have been given, we would appreciate your patience in allowing us to
become more educated on the issues, and in allowing us to include our attorney in the discussion.
He has been on vacation;we will contact him upon his return early next week.
Again,we appreciate our taking the time to visit the site with us• and will be in touch next week.

official in immediate charge of the Town of Barnstable property,

to, from, and over the apron on the westerly side of the Town
Marina at the southern extreme of Barnstable Harbor.
In the course of acknowledging the foregoing, I am
constrained to vigorously dispute your assertion in the paragraph
numbered "4 . " in your letter to Mr. -Smith, that Barnstable Marine
may have acquired an easement by prescription with regard to any
Town land in that vicinity.

SP-17-93 Barnstable Marine service, Mill Way, Barnstable
Attorney Ford explained that he had filed with the Conservation Commission to
amend an existing order of conditions to allow sewer line hook-up. The
commission incorporated the sketch plan for sewer hook-up in the order Of
conditions for the deck. A restriction in the order Of Conditions is that a
drainage plan must be submitted to the Commission by 2/13/95. The drainage
plan is to be implemented by 2/13/97.
Mr. Gatewood verified this information and noted that the commission would be
striving for a meaningful improvement, but that they would want to accommodate
a first-flush storm, not a twenty-year storm. He agreed to provide the DPW an
opportunity to comment on the merit of the plan when it is submitted.
Attorney Ford again quoted from Section 4.7.5 of the zoning Ordinance
regarding ^. . .elements of the following information as are pertinent to the
development activity proposed:". He reiterated his position that this
development activity does not require a drainage upgrade at this point for
Site Plan Review.
A revised floor plan was submitted.
Attorney Ford offered the following information based on a meeting he had with
the Board of Health on 11/18/93:
1) The Board of Health did not agree to waive the grease trap `
requirement in favor of a grease interceptor.
2) The location of bathrooms in the other building was approved.
3) The question regarding the location and number of sinks was
resolved.
4) Three tables were permitted outside.
Regarding the access question, Mr. Ford reported on meetings with the Town
Attorney and the Town Manager. However, he did not yet have a written
decision from either.
Mr. Ford requested site Plan Review approval contingent upon clarification
from the Town Manager that access across Town land would be allowed to
continue.
Chief ,Tones indicated that continuation of the access road was very important
for fire protection.
It was Mr. Jasin's opinion that Mr. Rutherford wanted to maintain the status
quo regarding this issue.
At Mr. Marcello's request, Mr. DaLuz read a memo from the Town Manager
requesting that no site Plan Review action be taken until the resolution of
the access issue.
Mr. DaLuz indicated Conditional Approval. However, staff will not be asked to
sign the plan until written approval from the Town Attorney or Town Manager
regarding access is received. Mr. Ford said he expected to have that shortly.
ZBA action will be required.

SP-17-93 Barnstable Marine Service, Mill Way, Barnstable
Ms Vanduzer reported on a meeting she had with Mr. Barry, Health Department,
at the site. The applicant is seeking a variance from the Board of Health.
Placement of sinks and rest rooms was discussed.
Mr. Ford said he had met with the Town Attorney and Mr. Rutherford regarding
access.
In response to a question from Mr. Traczyk re the number of people in the
proposed club, Ms Vanduzer said that the Town has 90 slips, Barnstable Marine
has 35.and that she was unsure how many were at Millway. Membership would be
limited to slip owners and their guests. However, the size would be limited
to 24 seats and would operate in the summer only.
A filing with the ZBA is required as this is a conditional use.

Mr. Ford said that he had reviewed a previous order of conditions for drainage
requirements and that a drainage plan was listed as a requirement. He said he
would be working .with the conservation commission on this and that the
Department of Public works would be included. Mr. Ford did not believe that
Site Plan Review staff had authority to require a drainage plan, citing
Section 4.7.5 of the Zoning ordinance ". . .elements of the following
information as are pertinent to the development activity proposed:". Mr.
Marcello disagreed and repeated his request for a drainage plan.
Mr. Gatewood explained that the Conservation Commission would be looking for a
first flush conveyance system for a two to five year storm. Mr. Marcello
agreed with this.
Mr. Traczyk expressed his preference that drainage be dealt with at the site
Plan Review level, prior to the ZBA review.
Mr. Ford agreed to attend the following weeks site Plan Review meeting
(10/15/93) . By that time he expects to have: 1) received feedback from the
Board of Health. 2) filed a request for an amendment to an order of
Conditions with the Conservation Commission. 3) something more definitive
from the Town Manager/Town Attorney regarding access.

access road. Mr. Ford is scheduled to address this issue with Site Plan
Review staff on October 8, 1993.

SP-17-93 Barnstable Marine Service, Mill Way, Barnstable
The conversation was audiotaped by Ms Vanduzer who displayed
old photos of the site, the earliest dated 1950, and said
that her family had owned the property since 1954.
Mr. Ford disagreed with the opinion of Planning Department
staff that the applicants access across Town property was
illegal, and pointed out that access to public restrooms was
across Barnstable Marine property.
Ms Vanduzer explained that the property had been
historically used by the Cape Cod Tuna Club for functions
and that, although it was not used as a public restaurant,
recreational activities took place.
Mr. Ford indicated that the applicant was considering
changing his proposal to a private club (membership to be
limited to Barnstable Marine slip holders and holders of
Town moorings in the harbor) rather than the public facility
currently proposed. He said that Barnstable Marine doesn't
want a public restaurant, they just want to legalize and
formalize an ongoing practice. A formal kitchen would be
installed. Connection to the sewer would be required. Mr.
Ford agreed to meet with Mr. Gatewood to discuss how to
procedurally work with the Conservation Commission regarding
this. A liquor license would be sought. Formal amendment
of the Site Plan Review application would be required.
Ms Vanduzer said that the private club would be strictly
seasonal in nature and would not overlap the boat storage
season.
There was discussion about whether a private club would
constitute an intensification of use. The Building
Commissioner did not think that it would.
Mr. Ford asked to clarify, for the record, that there is no
plan to use this property as a staging area for any Canal
Marine development.
Mr. Marcello expressed concern about drainage. Mr. Ford
admitted that drainage flows off the site. The applicant
has no plans to change this situation and no catch basins
are presently planned.
Mr. McKean will confer with Ms Saad about the drainage
situation.
Mr. Gatewood explained the standard Conservation Commission
approach to sheet run-off from parking lots.
Mr. Ford cited section 4.7.5 of the zoning ordinance
"...elements of the following information as are pertinent
to the development activity proposed:". There was some
discussion regarding which pieces of information on this
list could be considered pertinent to this application.
Mr. Ford requested that review time be extended until
10/8/93. Mr. Ford and Ms Vanduzer will attend the meeting
scheduled for that date. In the interim, Mr. Ford agreed to
confer with the Town Attorney re the access issue, review
chapter 91 to determine if a filing is appropriate, contact
Mr. McKean regarding Health Department issues, and review
the requirements of the existing order Of Conditions for any
drainage requirements.

Dear Robert.:
Thank you for discussing the issues of access to Barnstable
Marine Service with me this afternoon. As we discussed, the
tactical considerations in regards to fire protection are of
prime concern to this department. To outline our concerns, I
have listed them below:
1 . Dry Standpipe access: At the entrance (gate) from
the town access road (west side of harbor) , a dry
standpipe is located. This standpipe provides fire
protection for the fueling systems, fuel dock and
west side berths. In the event of a fire at the
town slips on the west side, it could play an
instrumental part in protecting northerly exposures
in the harbor. The harbor access is best for this
standpipe due mostly because of item #2 below.
2 . Hydrant Systems: The hydrant(s) utilized for this
property are located on Freezer Road and at the
corner of Millway Road and the town bulkhead area.
The hydrant located at the end of Freezer Road is
located at the end of a "dead end" main. In
addition, this hydrant is on a six (6) inch main and
does not have a sufficient fire flow for our
requirements. The hydrant located at Millway Road
is on an eight (8) inch main. In addition, it loops
through Commerce Road back to Route 6-A. As we
discussed, this provides us with better fire flow
relative to volume and pressure of water. This
hydrant best protects the property via access
through the access gate over the harbor access we
.� discussed.

3. Exposure Protection: There are several exposure
problems that require careful consideration on the
part of the fire department. The freezer plant is a
large, unprotected wood frame structure. In
addition, it is a structure that houses a supply of
anhydrous ammonia. This substance is utilized in
the ice making process and as such, is a hazardous
material. Close to the structure are the buildings
of Barnstable Marine. These buildings, although
protected with a sprinkler system, are combustible
and house boats in the winter. Many of these boats
are fiberglass and have fuel located inside fuel
tanks. Thus the need for adequate access and
simultaneous water supply is illustrated. This
department could easily find itself in a situation
where the supply of water through a limited access
on Freezer Road could easily inhibit operations and
lead to fire spread.
The need to preserve the environment is indeed a very
significant concern for us all. In addition, the aesthetic
appearance of Barnstable Harbor is another resource that we
can not afford to loose. However, the public safety concerns
of this department point to a specific need to maintain the
harbor access gate and road into Barnstable Marine Service
"as is". This access has been present for many years and has
been planned for use by this department in pre-plan
operations. In addition, other fire related and EMS
emergencies have been mitigated via this access route to the
property. If this use was intended for the present property,
and was new construction, current codes would require
substantial changes in regards to fire protection. These
types of changes would be very costly and frankly unfair to
the present occupant who has been carrying on business there
for many years. I suggest that the possibility of
"legitimating" the use of the harbor access road and gate by
Barnstable Marine, be undertaken by the Town. This could be
easily accomplished by granting a right of easement as we
discussed on the telephone. I appreciate your concern and
attention in this matter and I hope to hear from you soon in
regards to our concerns and suggestions.

The subject building is part of a large parcel which
currently contains three (3) buildings for a combined total
surface area of about 29,000 square feet.
The plan as presented has no drainage plan, no parking plan
design, and no estimate of traffic impact or proposed
upgrades to the entrance of the subject parcel.
Apparently the narrative attached to the plan wants the Site
Plan Review Committee to narrowly look at the subject
building only.
It is my opinion that the Zoning By-law should be observed
with respect to drainage, parking, and ingress/egress. The
writer is therefore unable to provide a meaningful review
without some rationale from the applicant as to why the site
should not be upgraded.
Example: Without topography, how can an analysis be done
for run-off? What is present impact of traffic on entire
site?

In'general, this department has very few concerns regarding
this proposed occupancy. Comments are outlined below.
1.'. The harbor access road is essential to the provision of
fire protection to the facility and area. As such it
should be left unobstructed and in basically the same form
as. it appears. Fire protection is such that primary hydrant
systems in the area require tactical and strategic concerns
` .that .focus on the harbor access road in it's resent form.

In addition, the standpipe system for the fuel dock is
located at the harbor access road entrance. Thus this access
should be kept unchanged during this and any future projects
on the property.
-2. Egress routes from the proposed restaurant should be
clearly designated and marked with lighted exit signs.
3. The proposed restaurant should be provided with emergency
egress lighting in accordance with the State Building Code.
4. Fire extinguishers should be provided in the restaurant
area and kitchen alike.
S. In the event that deep frying or griddle type cooking is
planned, an extinguishing system and

required. This shall be installed in accordance with
NFPA pamphlet # 96 entitled: Removal of Smoke and Grease-

Observations:
1. The primary issues appears to be that of access and parking needs. The
site has been utilized and is currently utilizing Town property (Barnstable
Harbor Town Landing) to access its existing dock, retail, and second floor
residential. The proposed new restaurant activity would also be utilizing this
access point if allowed. see attached memo to Site Plan Review dated June 3,
1993. In addition, additional data is needed on the number of employees on hand
for the boat storage operation and the size and number of units for residential
uses (single family?, Apartments?) on site.
2. Zoning District considerations: Restaurant use is a conditional use in the
BM-B district only, permited provided that a special permit is first obtained
from the ZBA subject to the provisions of 5-3.3. [Section 3-3.4 (3) ]
3. Parking Requirements:
a. The number of parking spaces required for the large boat storage use on
this site should be determined by actual need. Information on the residential
uses on site should also be provided. Parking should be limited to that required
to meet all allowed uses on the site, and as determined by the Building
commissioner.
b. Handicapped parking: parking appears to be adequate.
C. There also appears to be excessive parking on site. It is recommended
that the final required parking number as determined by the Building commissioner
be set as a maximum.
4. Curb cuts and access: Access for proposed new use should be from Freezer
Road, the legal frontage for this property. The Town Property adjacent this
parcel to the south should not be used as a public way to provide access.
Recommendations:
1. A new site plan be submitted providing access to the site from Freezer Road.
Also, all Required parking including the proposed restaurant should be shown,
with entrance and exit circulation from Freezer Road.
2. A fence should be included on the above suggested new site plan eliminating
access from the Town owned land into the site.
3. Documentation should be provided indicating any Special Permit(s) or
variances for the existing residential uses on the site, and information on any
lot subdivision for the single family residence on Freezer Road that is indicated
as part of Lot #21, Map 300.
4. No off-premise signs or signs on town-owned lands should be permited.
5. Administrative Proceedures to be checked:
(1) old Kings Highway Regional Historic District input?
(2) Conservaton Commission Wetlands Protection Review?

Freezer Road.
West of Barnstable Marina is a 2 . 9 acre parcel of town-owned
property. Part of this property was acquired by the town in
the 1960 's; the strip - around the periphery of the harbor has
apparently been owned by the town for a considerable length
of time. The Marina was created by dredging of the creek' in
1956 .
Access to both Canal Service Marine and Marine Service is
from Freezer Road. Marine Service has also accessed their
property by a driveway across town-owned land close to the
harbor. This driveway is not a right-of-way according to
town maps. It does provide vehicular access for maintenance
of the bathrooms and a few parking spaces. Use by Marine
Service appears to be moderate, perhaps for occasional boats
and for access to the bait shop. The driveway along the
harbor is paved but in poor shape with many patches.
The Barnstable Village Comprehensive plan has focussed on
the harbor area as an area in need of improvement. A park
is proposed for the 2.9 acre parcel of town-owned land and
the Tree Warden has already begun the process of tree
planting. Benches along the waters edge have also been
proposed. The area at present has a delapidated, unsightly
appearance. It is also recommended that the cut-through at
the southern end of the harbor between Freezer Road and Mill
Way be paved, with parking and trailer spaces, and unloading
area for fish; this area is essentially a parking and
unloading area, not a roadway.
The two marine service P rot✓erties to the north of the town-
owned land are sizeable. Canal - Marine (aka Bassets, old
Freezer building) contains 7 acres , although not all the
acreage is buildable because of wetlands. A redevelopment
of the site has been proposed with a whale watch boat,

In general, this department has very few concerns regarding
this proposed occupancy. Comments are outlined below.
1. The harbor access road is essential to the provision of
fire protection to the facility and area. As such, it
should be left unobstructed and in basically the same form
as it appears. Fire protection is such that primary hydrant
systems in the area require tactical and strategic concerns
that focus .on the harbor access road in it's present form.
In addition, the standpipe system for the fuel dock is
located at the harbor access road entrance. Thus this access
should be kept unchanged during this and any future projects
on the property.
2. Egress routes from the proposed restaurant should be
clearly designated and marked with lighted exit signs.
3. The proposed restaurant should be provided with emergency
egress lighting in accordance with the State Building Code.
4. Fire extinguishers should be provided in the restaurant
area and kitchen alike.
5. In the event that deep frying or griddle type cooking is
planned, an extinguishing system and grease hood will be
required. This shall be installed in accordance with
NFPA pamphlet # 96 entitled: Removal of Smoke and Grease-
Laden Vayors from Commercial Cooking Equipment.
6. Parking areas, especially those near fire protection
systems and connections, should be designated as fire lanes
and should be painted/lined in accordance with the Town of
Barnstable Fire Lane By-Law.

The subject building is part of a large parcel which
currently contains three (3) buildings for a combined total
surface area of about 29,000 square feet.
The plan as presented has no drainage plan, no parking plan
design, and no estimate of traffic impact or proposed
upgrades to the entrance of the subject parcel.
Apparently the narrative attached to the plan wants the Site
Plan Review . Committee to narrowly look at the subject
building only.
It is my opinion that the Zoning By-law should be observed
with respect to drainage, parking, and ingress/egress. The
writer is therefore unable to provide a meaningful review
without some rationale from the applicant as to why the site
should not be upgraded.
Example: Without topography, how can an analysis be done
for run-off? What is present impact of traffic on entire
site?

It has come to my attention that the town ' s planning department
is concerned about my family ' s business , Barnstable Marine Service,
utilizing the Barnstable Harbor access road as a major thoroughfare.
I believe that this concern is the result of an informal and
hypothetical discussion with Mr. Bassett of Canal Marine about the
development of his property, specicifically about his need for
additional parking. No formal agreement has ever been suggested by
either party. We have no plans to turn our property into a parking
lot, and Mr. Bassett ' s application does not include our property or
any reference to using the harbor access road.
Now before the Site Plan Review committee is our own application
for a 24-seat seasonal restaurant, providing the boating public with
sandwiches , soups, and beverages in a casual atmosphere. Because of
its small size and its waterside accessibility, this project will not
significantly affect traffic on the access road . Canal Marine ' s
project would not use the access road at all . I hope, therefore,
that any confusion between the two proposals has been resolved,
and that our plans will be judged on their own merit and on their
value to the community.

Observations:
1. The primary issues appears to be that of access and parking needs. The
site has been utilized and is currently utilizing Town property (Barnstable
Harbor Town Landing) to access its existing dock, retail, and second floor
residential. The proposed new restaurant activity would also be utilizing this
access point if allowed. See attached memo to site Plan Review dated ,Tune 3,
1993. In addition, additional data is needed on the number of employees on hand
for the boat storage operation and the size and number of units for residential
uses (Single family?, Apartments?) on site.
2. Zoning District considerations: Restaurant use is a conditional use in the
BM-B district only, permited provided that a special permit is first obtained
from the ZBA subject to the provisions of 5-3.3. [section 3-3.4 (3) ]
3. Parking Requirements:
a. The number of parking spaces required for the large boat storage use on
this site should be determined by actual need. Information on the residential
uses on site should also be provided. Parking should be limited to that required
to meet all allowed uses on the site, and as determined by the Building
Commissioner.
b. Handicapped parking: parking appears to be adequate.
C. There also appears to be excessive parking on site. It is recommended
that the final required parking number as determined by the Building Commissioner
be set as a maximum.
4. curb cuts and access: Access for proposed new use should be from Freezer
Road, the legal frontage for this property. The Town Property adjacent this
parcel to the south should not be used as a public way to provide access.
Recommendations:
1. A new site plan be submitted providing access to the site from Freezer Road.
Also, all Required parking including the proposed restaurant should be shown,
with entrance and exit circulation from Freezer Road.
2. A fence should be included on the above suggested new site plan eliminating
access from the Town owned land into the site.
3. Documentation should be provided indicating any special Permit(s) or
variances for the existing residential uses on the site, and information on any
lot subdivision for the single family residence on Freezer Road that is indicated
as part of Lot #21, Map 300.

Freezer Road.
West of Barnstable Marina is a 2 . 9 acre parcel of town-owned
property. Part of this property was acquired by the town in
the 1960 's; the strip - around the periphery of the harbor has
apparently been owned by the town fora considerable length
of time. The Marina was created by dredging of the creek' in
1956.
Access to both Canal Service Marine and Marine Service is
from Freezer Road. Marine Service has also accessed their
property by a driveway across town-owned land close to the
harbor. This driveway is not a right-of-way according to
town maps. It does provide vehicular access for maintenance
of the bathrooms and a few. parking spaces. Use by Marine
Service appears to be moderate, perhaps for occasional boats
and for access to the bait shop. The driveway along the
harbor is paved but in poor shape with many patches.
The Barnstable Village Comprehensive plan has focussed on
the harbor area as an area in need of improvement. A park
is proposed for the 2.9 acre parcel of town-owned land and
the Tree Warden has already begun the process of tree
planting. Benches along the waters edge have also been
proposed. The area at present has a delapidated, unsightly
appearance. It is also recommended that the cut-through at
the southern end of the harbor between Freezer Road and Mill
Way be paved, with parking and trailer spaces, and unloading
area for fish; this area is essentially a parking and
unloading area, not a roadway.
The two marine service properties to the north of the town-
owned land are sizeable. Canal. Marine (aka Bassets, old
Freezer building) contains 7 acres , although not all the
acreage is buildable because of wetlands. A redevelopment
of the site has been proposed with a whale watch boat,
restaurant, gift shop and museum. Plans brought in for

Dear Mr . DaLuz:
It has come to my attention that the town ' s planning department
is concerned about my family ' s business , Barnstable Marine Service,
utilizing the Barnstable Harbor access road as a major thoroughfare.
I believe that this concern is the result of an informal and
hypothetical discussion with Mr. Bassett of Canal Marine about the
development of his property, specicifically about his need for
additional parking. No formal agreement has ever been suggested by
either party. We have no plans to turn our property into a parking
lot, and Mr. Bassett ' s application does not include our property or
any reference to using the harbor access road .
Now before the Site Plan Review committee is our own application
for a 24-seat seasonal restaurant, providing the boating public with
sandwiches, soups, and beverages in a casual atmosphere. Because of
its small size and its waterside accessibility, this project will not
significantly affect traffic on the access road. Canal Marine ' s
project would not use the access road at all . I hope, therefore,
that any confusion between the two proposals has been resolved,
and that our plans will be judged on their own merit and on their
value to the community.

Please be advised that the following items previously
requested by the Site Plan Review Staff have not been added to the
current plan as it is my opinion that the same are not required
under the applicable provisions of the Zoning Ordinance .
Specifically, not included on the most recent plan are the
following:
1 . Topographic survey
2 . Drainage calculations and a drainage system
3 . Color schemes of buildings
4 . Landscape plan
It is my opinion that under Section 4-7 . 5, a plan need only
contain the information required in said Section to the extent that
said information is "pertinent to the development activity
proposed" .
In the instant case as you are aware, no construction of any
kind or site improvements are proposed on the site. An existing 20
x 20 building is proposed to be converted to a small restaurant
using the existing site, parking and structures . Therefore,
the information listed above is not "pertinent to the development
activity" before you and, therefore, not required to be shown on
the plan in order be reviewed prior to a Board of Appeals
application for same.

Freezer Road.
West of Barnstable Marina is a 2.9 acre parcel of town-owned
property. Part of this property was acquired by the town in
the 19601s; the strip around the periphery of the harbor has
apparently been owned by the town for a considerable length
of time. The Marina was created by dredging of the creek in
1956.
Access to both Canal Service Marine and Marine Service is
from Freezer Road. Marine Service has also accessed their
property by a driveway across town-owned land close to the
harbor. This driveway is not a right-of-way according to
town maps. It does provide vehicular access for maintenance
of the bathrooms and a few parking spaces. Use by Marine
Service appears to be moderate, perhaps for occasional boats
and for access to the bait shop. The driveway along the
harbor is paved but in poor shape with many patches.
it The Barnstable, Village Comprehensive plan has focussed on
the harbor area as an area in need of improvement. A park
is proposed for the 2.9 acre parcel of town-owned land and
the Tree Warden has already begun the process of tree
planting. Benches along the waters edge have also been
proposed. The area at present has a delapidated, unsightly
appearance. It is also recommended that the cut-through at
the southern end of the harbor between Freezer Road and Mill
Way be paved, with parking and trailer spaces, and unloading
-area for fish; this area is essentially a parking and
unloading area, not a roadway.
The two marine service properties to the north of the town-
owned land are sizeable. Canal Marine (aka Bassets, old
Freezer building) contains 7 acres, although not all the
acreage is buildable because of wetlands. A redevelopment
of the site has been proposed with a whale watch boat,
restaurant, gift shop and museum. Plans brought in for
informational review indicated that the development was 70

parking spaces short, and proposed locating that parking on
the adjacent Marine Service property.
The Marine Service property contains 2.9 acres with a boat
service business and a small bait shop. A very small
bar/restaurant is also proposed. The site plan for this
project at the end of May indicated access across the town-
owned land only, with no access from Freezer Road.
It is recommended that there be no increase in traffic
across town-owned property on the existing driveway be
permitted. Access to future development and redevelopment
on both the Canal Marine and Marine Service should be from
Freezer Road which is the public road. Both properties have
substantial frontage on these roads.
