The lot has 266 feet of frontage on Freezer Road and backs up to Bamstable Harbor. The rear of the lot is impacted by wetlands, primarily salt marsh with bordering vegetated wetland, and contains a coastal bank. The lot is in a FEMA Flood Zone with a base flood elevation of 13-14. The property is improved with a 1,180 gross sq.ft(1,020 sq.ft living area), 2-bedroom, single-family dwelling; constructed in 1992 (per Assessor's data). The house is served by public water and sewer. The dwelling appears to be set back from the property line approximately 10 feet. Parking is provided on-site to the north of the dwelling. Procedural& Hearing Summary Appeal No. 2016-007 for a modification of the conditions of use variance No. 1991-61 and for relief from the height requirements of the MB-B district to build 2% stories was filed at the Town Clerk's 1 Office and office of the Zoning Board of Appeals on January 19,2016. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened February 10, 2016 at which time the Board found to grant the variance subject to conditions. Board Members deciding this appeal were Brian 1 Florence, Alex M. He showed a picture of the existing dwelling in context of the adjacent marina and single-family dwelling to the north. Attorney Kenney reviewed the unique conditions of the lot, including the extensive wetland impacts and small buildable area. He addressed the parking and screening on the north side of the property that limited the footprint expansion. He addressed the marine zoning of the property, along with the Bamstable Village comprehensive plan section that pointed to the limited ability to introduce new marine uses in the harbor. Findings of Fact. At the hearing on February 10, 2016, the Board unanimously made the following findings of fact for Appeal No. 2016-007, a request for modification of Use Variance No. 1991-61 and a variance from the height requirements of the MB-B District: 1. In Appeal No. 2016-007, Myles A. Walton &Annlisa L.Weigel have petitioned for a modification of Variance No. 1991-061 and a variance to Section 240-23.G Bulk Regulations. The petitioners are proposing to modify Use Variance No. 1991-061 to allow expansion of the residence and are seeking relief from the bulk regulations of the Marine Business-B District to allow the dwelling to have two and %stories, where the ordinance permits only two stories. 2. The subject property is located at 139 Freezer Road, Bamstable, MA as shown on Assessor's Map 300 as Parcel 019. It is in the Marine Business B Zoning District. 3. In consideration of the request to modify the conditions of use variance No. 1991-61, the Board finds: a. There are circumstances related to shape or topography of such land or structures and especially affecting such land or structures but not affecting generally the zoning district in which it is located.
