Re: Freezer Road Property Violations/Complaint

Dear Mr. Tinsley,
On August 6, 1999 I contacted the Building Commissioners office with a complaint about
the fenced structure which is located on top of the pilings where the freezer building once
stood. On August 10th I finally received an answer to this complaint which I find less
than adequate,as a matter of fact I feel the answer was extremely flip and
non professional I have enclosed a copy of the correspondence for you to review.
My initial concern about the entire situation was due in part to a letter dated September 2,
1998 to Mr. Stuart Bornstein from Mr.Ralph Crossen.(also enclosed) A letter which
resulted in the demolition of the historic freezer building that so many of us valued as part
of our villages heritage. That letter stated: "Additionally,the piling system is inadequate
to hold any dead loads as their mass has disintegrated to the point that they, can not be
reused at all." " A dangerous situation that is beyond repair."
I have enclosed several pictures for you to review and as you can see this fenced area
which was part of an entire party setting,is sitting directly on those dangerous pilings.
Many individuals were out on those pilings the night of Mr. Bornstein party. If it was so
dangerous out there how could the building commissioner allow it's construction or it's
use. Especially after Mr. Al Martin had been out there to view the site before the party
ever took place."
Someone could have got hurt in that dangerous area. Or maybe it just never really was
that dangerous and hazardous to individuals in the first place. That particular fence still
remains standing. That fence in and of itself is a violation of the Old King's Highway Act
of 1973. I do not understand how the building commissioner in this town could allow this
to be.constructed or used. It seems to be completely contradictory to his letter which
was used to suit it's purpose 11 months earlier. Everyone seems to have turned their head
on this one and I would lice to know Why? and How?Mr. Bornstein and Mr. Crossen
could get away with this? As an ordinary citizen I know I could not have. In America
why should your average home owner have to follow such strict laws when the same laws
are overlooked for others? The public should be, and many are asking what's going
on with this one?
I would appreciate it if you and Mr. Geiler would investigate this matter. I look forward
to receiving a copy of your findings as you look into this matter within the next week or
two. Your anticipated cooperation is greatly appreciated.
In an effort to be clear,here are the questions I feel need to be answered:
1.) Who gave Mr.Bornstein permission to put up and use that fencing?
2.) How long is it going to stay there?
3.) Why was a party allowed to take place on top of the condemned pilings?
4.) What difference does it make, what day of the week the event was held?

5.) Could I have put up all of those structures without hearing from someone
at town hall?
6.) Do you feel that allowing people to be out on those pilings was in direct
contradiction to the letter written by Mr. Crossen on September 2,1998?
