Deed: Book 12037 Page 257 Plan: Book 220 Page 85 Background In Special Permit 2011-008, the applicant, Stuborn Limited Partnership, sought a variance from Section 240-43 Permitted Uses in the MB-B Marine Business B District to permit single-family residential use and the construction of a 14,859 square foot dwelling and accessory uses on a property commonly known as "Freezer Point." The subject property is located at 153 Freezer Road in Barnstable Village and is shown on Assessor's Map 301 as Parcel 006. The locus is a small peninsula of land bordered by Maraspin Creek on the east and Rendezvous Creek on the west. Historical uses of the property include a shipyard, an industrial fish-freezing business, and the cold-storage of cranberries. The property presently contains a structure, formally for residential use, which was constructed on the property in 1932. The MB-B District encompasses parcels on and around Barnstable Harbor, and permits a variety of water-dependent uses, including marinas and retail sales of marine-related products and fish and shellfish. Residential use of the subject property became non- conforming when the property was rezoned in 1965 to the Barnstable Village Marine Business District. On May 25, 2011 the Board denied a special permit request by the Applicant (No. 2011-007)which sought to expand the preexisting non-conforming- residential use and construct the proposed dwelling. The Board denied the request based on the finding that the pre-existing nonconforming residential use had been lost, as the property had ceased to be used for residential purposes. In this appeal, the Applicant requested a use variance as provided for by §240- 125(B) 1 e . Procedural & Hearing Summary Appeal No. 2011-008 fora use variance for single-family residential use and construction , of a 14,859 square foot dwelling was filed at the Town Clerk's Office on March 9, 2011. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened on May 25, 2011, and continued to July 13, 2011, August 10, 2011, September 14, 2011 and October 26, 2011, at which time the Board found to grant the variance subject to conditions. Board Members deciding this appeal were Board Chair Laura F. Shufelt William H. Newton Craig G. Larson, Michael P. Hersey, and George T. Zevitas. The hearing was opened on May 25, 2011 and Attorney John Kenney represented the Applicant before the Board. Also present were Stuart and Jamila Bornstein, Kieran Healy from BSC Group and Norman Hayes, a wetland scientist. Attorney Kenney, Norman Hayes;and Kieran Healey provided an overview of the property and the project proposed by Stuborn, LP. Attorney Kenney provided the Board with a.history of zoning and residential use on the property. Norman Hayes discussed proposed wetland impacts, mitigation, and environmental clean- up. He stated the property contained various regulatory wetland resource areas and two coastal banks. Kieran Healy provided a summary of the soils, shape and topography of the property. He stated the dwelling would have to be elevated above the base flood elevation and that the foundation would have to be on pilings. Attorney Kenney addressed the introduction of a residential use into the Marine Business District. He discussed the property's location at the end of Freezer Road and the hardship involved with developing a waterfront property with a high land value. He explained that to accomplish a commercial development in the MB-B district, an anticipated project would have to be in excess of 10,000 square feet, given the cost of land; once a commercial project exceeds 10,000 square feet, it is within Cape Cod Commission jurisdiction. He read the uses under the MB-B zoning district and cited a proposed marine use for the property with 50 boat slips. He referred to a letter from the Cape Cod Commission regarding the 50 slip marina and the excessive trip generation it would produce. Attorney Kenney read from the Barnstable Village Plan and discussed how the proposed residential project would have the least impact on.the area and not contribute to overbuilding of the harbor or to,parking or traffic concerns. Consistency with the Comprehensive.Plan and Barnstable Village Plan were discussed. Attorney Kenney stated that permitted uses in the MB-B district are seasonal uses and not economically feasible for the applicant. Public comment was requested. Attorney Joseph Berlandi, representing a group of concerned citizens, spoke to the three-prong test for granting a variance and addressed the Applicant's knowledge of the zoning prior to purchasing the property. He discussed how the MB-B zoning was key to preserving the harbor. Ann Canedy, Town Councilor, spoke in . opposition to the request and addressed the history of marine use on the property and 'past village opposition to non-commercial use of the property. Mark Santos and Lenny Clark 2 Town of Barnstable Zoning Board of Appeals-Decision and Notice Stubom, Limited Partnership—Variance No.2011-008 spoke in opposition to the request. The Board Chair read letters submitted for the record, both in favor and in opposition to the request. The hearing was reopened on July 13, 2011. Attorney Kenney addressed rumors and fears about the proposal and the possibility of the use variance opening the door for a 40B development. In response to those concerns, the applicant proposed placing a conservation restriction on the undeveloped portion of the site. Attorney Kenney indicated that the applicant would agree to establishing a building envelope and then restricting further building on the remainder of the property. He indicated the applicant would not be amenable to offering public access to the property or waterfront. Kieran Healey, BSC Group, spoke about the design of the proposed dwelling. He explained the tidal datum shown on the proposed plan, clarifying that a Mean Low Water datum was used, as opposed to NGVD datum. He explained the proposed foundation is in the flood zone at MLW elevation 17 and the garage floor is at MLW elevation 18. He cited FEMA's recommendation that all enclosed space should be above the base flood elevation. He entered renderings of the house into the record. He clarified that the house would be constructed in an area that is already disturbed. Norman Hayes spoke about retention of existing trees and other vegetation on the site and the removal of invasive species. He also provided calculations to confirm the accuracy of the FEMA base flood elevation. David Sigl of DSH Building Designs was present for the Applicant. Mr. Sigl indicated that they revised the house plans and presented Scheme 11 for the record. He stated that by altering the roof pitch, the total height to the main ridge could be reduced to 36.6 feet in height. Attorney Kenney spoke about the existing building on the property, the Captain Jerald Fish House. He explained that they are required to have a certified historic architect on site to decide what parts of the structure can be saved. He stated the proposed use of the structure would be for an accessory garden storage shed and that it would not be habitable. Attorney Kenney addressed other proposed accessory uses on the site, including a personal marina and a small shed near'the marina for storage of items such as life jackets. He clarified this proposal had not yet been reviewed by the Conservation Commission, but the Applicant understood this would be required. The Board Chair again requested public comment. Attorney Joseph Berlandi spoke in opposition to the request. Frank'Hinckley, former Chair of the Planning Board (1965) spoke about the community's desire to preserve access to the water. Robert Ambrose and Mark Santos spoke in opposition. Attorney James Connors, representing Brian and Kathy Hickey, addressed the Board regarding an easement claim on the subject property. John Julius spoke in favor of the Applicant. Attorney Kenney indicated that in 1999, Freezer Road was named a scenic road and the Regional Policy Plan does not allow the expansion of scenic roads in historic districts. In order to do a marina use, they would have to go to the Cape Cod Commission to show that the 14 foot wide road could handle 500 trips on the weekday and 700 trips on the weekend ' with people towing boats through a residential area. He also discussed the zoning amendment that prohibits chain stores in the MB-B, which was adopted after the applicant purchased the property. 3 Town of Barnstable Zoning Board of Appeals—Decision and Notice Stuborn, Limited Partnership—Variance No.2011-008 On August 10, 2011, the hearing was continued because all Board members sitting were not present. The hearing was reopened on September 14, 2011. Board member Michael P. Hersey submitted a Confirmation of Evidential Review pursuant to MGL Chapter 39 Section 23D and Section 37-8 of the Town Code, as he was not present at the hearing on July 13, 2011. Attorney Kenney addressed several new items for the record. There was extensive discussion about the wharf on the property. The Board confirmed the wharf was for the owner's personal use and that it required additional permitting through other Town departments and agencies. The Board Chair confirmed that the existing Chapter 91 license for the wharf permitted public access. The Applicant confirmed that he would be willing to relinquish the ability to use the wharf for commercial purposes and it would only be for his personal use. Public comment was requested and Attorney Joe Berlandi spoke in opposition to the request.'John Julius spoke in favor. On October 26, 2011, the hearing was reopened. The Board Chair noted additional public comments received. Attorney Kenney addressed an easement claim submitted by Brian and Karen Hickey, and historic property conveyances by Alfred Crocker, as they related to reservation of easement rights. Procedural requirements for acceptance of a conservation restriction were discussed. The Board voted to close the public hearing on October 26, 2011. Findings of Fact At the October 26, 2011 hearing, the Board unanimously made the following findings of fact: 1. Stuborn Limited Partnership, Stuart Bornstein, General Partner, has applied for a variance to §240-23 Marine Business B District-Permitted Uses. The applicant is requesting a variance to allow.a single-family residential dwelling in the MB-B District. The applicant has proposed construction of a new, six bedroom, single-family residence with an attached garage and attached guesthouse on the property. 2. The property is addressed 153 Freezer Road, Barnstable, MA and is shown on Assessor's Map 301 as Parcel 006. 3. The subject property is zoned Marine Business B (MB-B) zoning district. Single-family residential dwellings are not a principal permitted use in the district. 4. The Applicant submitted a proposed'plan for development of the property entitled "Plan of Land 153 Freezer Road in.Barnstable Massachusetts, Proposed Site Plan", drawn and stamped by BSC Group, dated December 24, 2009 and last revised September 5, 2011 (hereinafter referred to as "Proposed Site Plan"). The property is proposed to be developed in conformance with this plan. 4 Town of Bamstable Zoning Board of Appeals—Decision and Notice Stubom, Limited Partnership—Variance No.2011008 Site 5. The subject property is a triangular-shaped peninsula of land bounded by.Maraspin . Creek on the east, Rendezvous Creek on the west, and Barnstable Harbor on the North. According to a boundary plan submitted by the Applicant entitled "Plan of Land, 153 Freezer Road in Barnstable, MA', drawn and stamped by BSC Group dated December 24, 2009, last revised May 27, 2011, Pg. 3., of the 7 acres of property, as assessed by the Town; 2.82 acres are upland as defined by the Zoning Code. 6. Approximately the northern one-third of the site consists of salt marsh and is subject to E regular tidal flooding. .The northern portion of the site is also within a FEMA V'Velocity Zone. Vegetated wetlands extend further into the site on all three sides of the property. 7. A soil survey for the property conducted by ENSR for the Barnstable Planning. Department, dated October 1, 1999, classifies the majority of soils on the subject property as artificial fill, underlain by salt marsh peat. There is also a coastal bank on the property, with land seaward subject to coastal storm flowage. There are historic filled tidelands on the property, subject to public trust rights under M.G.L. Chapter 91. The jurisdictional historic high water line is shown on the Proposed Site Plan. 8. Areas of the property along Maraspin Creek, north of the existing licensed wharf, have been shown to have high suitability for shellfish. Northern portions of the property are within an Area of Critical Environmental Concern (Sandy Neck Barrier Beach System) and within the National Heritage and Endangered Species Program BioMap Core Habitat. 9. The site contains remnants of demolished commercial structures on the property, including a 9,100 square foot and a 7,250 square foot concrete slab. The locations of these remnants are depicted on the Proposed Site Plan as "former wood-framed warehouse building slab" and "concrete slab ±9,100 S.F. to be removed.". 10. The site is currently developed with a structure formerly used for residential purposes. The Massachusetts Historical Commission Form B inventory sheet indicates that the ' structure was built as a fish house in the late 1800's and moved to its current location and converted into a dwelling unit in 1932. The structure is labeled on the plan as "2- story wood framed 2-family building" and "historical portion of dwelling to remain". Proposal 11. During the hearing, the applicant submitted revised elevations for the principal dwelling, entitled "New Residence, Scheme 11, Freezer Road Barnstable Massachusetts", and dated July 13, 2011, drawn by David H. Sigl. The principal dwelling is proposed to be constructed in conformance with these elevations. 12. Scheme 11 of these elevations proposes to reduce the overall height of the single family principal dwelling by three feet, six inches over what was originally proposed and approved by the Old King's Highway Regional Historic District Commission. At the hearing, David Sigl, architect, stated the reduction in height was achieved by reducing the roof pitch. The drawings show the overall proposed height of the structure from the proposed basement grade at elevation 18.0 to ridge as 36 feet 7 inches. 5 Town of Barnstable Zoning Board of Appeals—Decision and Notice Stubom, Limited Partnership—Variance No.2011-008 13. At the hearing, the Applicant submitted a document entitled 153 Freezer Road Scheme 10 Square Footage Calculations" that states the proposed single-family home will have 14,859 square feet of gross floor area. The applicant testified that revised Scheme 11 Building Elevations do not change this proposed square footage of the dwelling. 14. The lot coverage of the proposed dwelling and accessory structures is approximately 9 P P 9 rY PP Y 5.3 percent of the total upland area of the site, calculated pursuant to the definitions of Wetlands and Lot Coverage in Zoning Code Section 240-128. 15.=On October 13, 2010, the Regional Committee of the Old King's Highway Regional Historic District Commission OKH issued Certificate of Appropriateness a rovin the approving design fora new residence on the property, labeled Scheme 10. This decision annulled the Town Committee's vote to deny the application,which cited concerns over the exposed foundation and the building height in relation to surrounding commercial structures. The elevations labeled Scheme 11 have not been reviewed by the Old 'King's Highway Regional Historic District Commission or the Barnstable Old King's Highway Historic District Committee. 16. A letter submitted for the record from Building Commissioner Tom Perry, dated April 22, 2011 confirms that the proposed dwelling, as depicted by the architectural renderings prepared by David.H. Sigl labeled 'Scheme 10', dated 4/1/2010, is a two- story dwelling and is in compliance with the height restrictions in the Zoning Ordinance. Both the MB-B District and the adjacent RF-1 district establish a maximum height requirement of 30 feet, as measured from grade to plate. The renderings labeled 'Scheme 11' do not alter the dimensions of the dwelling from grade to plate. Uses and Structures Accessory to the Proposed Single Family Dwelling 17. On June 22, 2011, the Barnstable Old King's Highway Historic District Committee approved a Certificate of Demolition for partial demolition of the existing structure, known as Captain Jerauld Fish House, subject to the requirement that the Applicant retain the historic front portion of the structure. Per the Commission's decision,.the Applicant is required to retain a Certified Historic Preservation Consultant to oversee the partial demolition of the structure. In the Applicant's estimation, the portion of this historic structure to remain will be between 960 and 980 square feet in area on the first floor, with second story of approximately 820 square feet. This structure is labeled on the Proposed Site Plan as "2-story wood framed 2 family building'; the plan also indicates the approximate footprint of the "historical portion of dwelling to remain." 18. At the hearings, the Applicant.testified that the post-demolition proposed use of this structure would be for an accessory shed for the storage of lawn and garden equipment. ' . 19. On April 21, 2010, the Applicant was issued an Order of Conditions from the Barnstable Conservation Commission, recorded at the Barnstable County Registry of Deeds as Book 24592, Page 16, approving a proposed site plan entitled "Plan of Land 153 Freezer Road in Barnstable Massachusetts, Proposed Site Plan", drawn and stamped by BSC Group, Craig A. Field, PLS, dated December 24, 2009, last revised March 29, ' 6 . t Town of Barnstable Zoning Board of Appeals—Decision and Notice Stuborn,Limited Partnership—Variance No.2011-008 2010. To mitigate the disturbance of wetlands, the approved plan proposes clean-up and removal of concrete, debris, and invasive species, and site restoration and replanting of native species, as described in a letter from Kieran Healy, PLS to Conservation Division Director Rob Gatewood dated April 15, 2010. 20. On the property there is an existing wharf and concrete bulkhead that provides access to Maraspin Creek. The Applicant has a Chapter 91 License, No. 11070, recorded in Book 20834, Page 200, to maintain the existing stone revetment and wharf, and to use the structures for commercial and non-commercial docking and boating access. 21. The Applicant testified that the associated moorings/piers for the boat shown in red on the Proposed Site Plan are proposed to be.removed, and that the removal would improve navigation within the Maraspin Creek channel. The Applicant indicated that it was their intention to use the wharf for their private, non-commercial use and that Conservation Commission, Massachusetts Department of Environmental Protection, Massachusetts,Environmental Policy Act, and U.S. Army Corps of Engineers permits would be required to make alterations to the wharf. 22. At the hearing, the Applicant proposed a water-dependent accessory structure on the property for the storage of items used in conjunction with the property owner's boats. The dimensions of the accessory structure are proposed to be up to 12 feet by 15 feet. The accessory structure is identified on the Proposed Site Plan as "Proposed Storage Shed" and also referred to as a "Boat Supply Shed". Access 23. The property is accessed by Freezer Road, which is a designated Scenic Road, regulated under Section Chapter 180 of the Barnstable Town Code. 24. At the hearing, the Applicant provided testimony that the width of the Town-owned Freezer Road layout is fourteen feet and that the narrow road layout presents constraints to the substantial widening of the road to support commercial use of the property. Alternate Uses Previously Proposed 25. The Applicant submitted documents into the record from the Cape Cod Commission, the Division of Marine Fisheries, the Office of Coastal Zone Management, and the Department of Conservation and Recreation, dated between February 3, 2009 and February 10, 2009, commenting on an Environmental Notification Form submitted by the Applicant.for proposed dredging of 10,000 cubic yards of material from Maraspin 9. 9 Y p Creek and development of a 50-slip commercial marina. The documents provide an overview of the regulatory requirements for the proposed dredging and marina construction. 26. The property is subject.to an array of environmental constraints and local, regional, state and federal regulatory requirements. Development on the property that would trigger thresholds set by the Cape Cod Commission Act would. require review as a Development of Regional Impact by the Cape Cod Commission. The applicant testified that the regulatory requirements for non-residential development on the property are 7 Town of Barnstable Zoning Board of Appeals—Decision and Notice Stubom, Limited Partnership—Variance No.2011-008 ,likely to create a significant impediment to use of the land as a result of increased development costs and lengthy development timeframes. 27. On March 18, 2010, the MB-B Marine Business B Zoning District was amended to include Section 240-23(E), which prohibits"formula businesses" and "corporate branding", as defined within said Section. The Applicant repeatedly stated that it would be a significant hardship for any independent business to bear the costs of developing the subject property, given the environmental constraints and permitting requirements that has been testified to herein. Bulk Regulations 28. The proposed residential use of the property provides the basis to apply Zoning Code sections applicable to residential development to the subject property. Application of residential zoning code requirements will ensure that the scale of development and intensity of use is comparable to neighboring residentially zoned land. Specifically, the following sections are found to be applicable: a. Section 240-7(F)(1) Number of buildings allowed per lot, which requires that that only one principal permitted building shall be located on a lot. b. The bulk and dimensional requirements of Section 240-13 RF-1 Residential District. The RF-1 District is the residential zoning district immediately adjacent to the MB-B District to the west. Properties directly across from Rendezvous Creek are zoned RF-1 and share a similar setting and visual character with the subject property. The "Proposed Site Plan" demonstrates compliance with the above-cited Zoning Code Sections. 29. The proposed dwelling is subject to the requirements of Section 240-7(G) Setbacks from wetlands/great ponds. The Proposed Site Plan depicts the proposed dwelling in compliance with the required 35 foot setback from wetlands. 30. This structure shall require review and approval by the Conservation Commission and Old t Kings Highway Historic District Committee, as applicable. 14. The development authorized by this decision shall be considered full build out of the property. Other than the specific permissions granted in Conditions No. 2, 8, 11, and 13, expansion or alteration of any structure or use on the property is prohibited. 15. Exercise of this variance prohibits all:uses of this property except the single family residential use that-is the subject of this application and the accessory uses identified herein. To prevent undue intensification of the use on the site, this variance does not allow any other principal, accessory, or conditional uses on the Property. 16. While the rights authorized by this variance are being exercised, uses permitted by the underlying zoning are prohibited on the Property. 17. The continuous rim boards are not able to bear on the sill plates,since the floor joists cantilever slightly beyond the supporting concrete frame below. Thus,the rim boards are subject to the downward load of the bearing walls above with no direct support below them. The Purpose for the inverted hangers is to transfer the vertical wall load carried by the rim boards into the joists by some means other than reliance upon the face nails in the ends of the joists only.
