The area is in close proximity to Barnstable Harbor and is characterized by small lots mostly developed with cottage structures that have,over the years,evolved into permanent year- round homes. The subject area has the benefit of both public water and town sewer. This lot is a 0.27-acre parcel developed in 1947 with a one&a half-story,three-bedroom,single-family dwelling of 1,857 sq. ft. The applicants are requesting to demolish the existing dwelling and reconstruct a new larger single-family dwelling on the undersized non-conforming lot. The applicants have requested Special Permit findings under MGL Ch.40A, Section 6,and Section 4-4.3 Nonconforming Buildings or Structures Used as Single and Two Family Residences. The proposed new dwelling is to be three-bedrooms plus a separate guest bedroom,one&a half-story, single-family dwelling of 2,548 sq. ft.of living area. Also proposed are three screened-in porches,one covered porch,two outdoor shower enclosures,and a wood deck structure. A Certificate for the Demolition of the existing structure and a Certificate of Appropriateness for the proposed new dwelling was issued by the Old Kings Highway Historic District Committee on March 10, 2004. Procedural &Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on January 27,2004. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened March 31,2004,at which time the Board found to grant the appeal. Board Members deciding this appeal were Richard L.Boy, Randolph Childs,Sheila Geiler,Ron S.Jansson,and Chairman Daniel M.Creedon III. Attorney Albert J. Schulz represented Mr. Clifton and Mr.Constantino who were also present. Mr. Schulz described the dwelling and the property citing that the lot is one of the largest in the neighborhood. The applicants seek to demolish the existing structure and reconstruct a new larger dwelling. Mr.Schulz submitted a revised plan that shows the proposed new dwelling in compliance with all of today's setbacks and having a total of 3,029 sq.ft.not including porches and decks. The decks are to be designed and 1 • Bk 18554 Pg 60 #35111 constructed as a flush patio and would not qualify as a structure as defined in the Ordinance and,therefore, ' could be located in the required setbacks. Pictures of the existing dwelling were also submitted. The Board discussed the location of the flush patios and the proposed parking. Concerns were expressed for the narrow roadway and the possible issue of access. The Board desired additional parking and the applicant's architectural designer,Kenneth Sadler, sketched possible additional lawn parking on a copy of the proposed site plan. Public comment was requested and no one spoke in favor or in opposition to the request. Findings of Fact: At the hearing of March 31,2004,a motion was duly made and seconded to make the following findings of fact: 1. Russell Clifton and Stephen Constantino have applied for Special Permit findings under MGL Ch.40A,Section 6,and Section 4-4.3 Nonconforming Buildings or Structures Used as Single and Two Family Residences to allow for the demolition of an existing single-family dwelling and garage located on the property and reconstruct a new single-family dwelling in conformance to required setbacks. The property is located as shown on Assessor's Map 319,Parcel 77 addressed as 38 George Street,Barnstable,MA in a Residence B Zoning District. 2. The subject property is located in an area generally referred to as"Common Fields"located off Commerce Road in Barnstable Village. The area is in close proximity to Barnstable Harbor and is characterized by small lots mostly developed with cottage structures that have,over the years, evolved more and more into permanent year round homes. The subject area has the benefit of both public water and town sewer. 3. This particular lot is a 0.27-acre parcel originally developed in 1947. The dwelling is a one&a half-story,three-bedroom,single-family structure of 1,857 sq. ft.of living area. The applicants purchased the property in June of 2003 (Recorded at the Registry of Deeds,Book 17166,page 168) and are today requesting to demolish the existing dwelling and reconstruct a new larger single- family dwelling on the undersized non-conforming lot. 4. According to plans submitted,the proposed new dwelling is to be three-bedrooms plus a separate guest bedroom,one&a half-story,single-family dwelling of 2,548 sq. ft.of living area. Also proposed are three screened-in porches,one covered porch,two outdoor shower enclosures,and a wood deck not connected to the structure.Total square footage with porches is approximately 3500 sq. ft. 5. Elevations of the structure have been submitted and staff estimates it will be 28 feet to the highest roof ridge. 6. Plans for the structure show a partial full basement;most of the building has only a crawl space. This may be due to the high water table in the area. There are no known wetlands within the vicinity that would affect development on the property. 2 Bk 18554 Pg 61 #35111 7. A Certificate for the Demolition of the existing structure and a Certificate of Appropriateness for the proposed new dwelling was issued by the Old Kings Highway Historic District Committee on March 10,2004. 8. The proposed construction is a reconstruction which does intensify the nonconformity but the proposed new dwelling would not be substantially more detrimental to the neighborhood than the former dwelling. The vote was as follows: AYE: Richard L.Boy,Randolph Childs,Sheila Geiler,Daniel M.Creedon NAY: Ron S. Jansson Mr. Jansson stated that he voted in the negative to the findings stating that the proposed dwelling was too large for the lot and it could lead to congestion on the narrow roadway. He cited that the purpose of the zoning is to prevent fire,congestion,and confusion,and it is his opinion that to permit this would be detrimental to the neighborhood. Decision: Based on the findings of fact,a motion was duly made and seconded to grant the permit for the demolition and reconstruction with expansion of a single-family dwelling on an undersized non-conforming lot subject to the following conditions: 1. The proposed reconstruction shall comply with all setback requirements for the district including the front yard setback established by Goodview way. 2. The dwelling shall be located as shown in the site plan submitted today,drawn by Felco,Inc., entitled"Site Plan Locus 38 George Street Barnstable,MA prepared for Russell Clifton 31 Mary Knoll Dr.,Hingham,MA"and initialed by the Board Chairman dated 3/31/04. The plan shows a 20 foot by 38 foot red boxed area noted as"Additional On Site Parking(Grass)3 Cars."There are a total of five on-site parking spaces shown on the plan. 3. The new dwelling shall be limited to no more than four bedrooms(including any guest suite). The overall structure shall not exceed one&one-half stories,nor shall it exceed 2,548 sq.ft. of living area,excluding screened-in porches and covered decks. All screened-in porches and decks shall not exceed that shown in the site plan submitted to the Board and cited above. 4. The building shall be built substantially in conformance with architectural plans submitted entitled "Custom Home and Residence for Russell Clifton/Stephen Constantino"and as may be revised to conform to the newer building footprint as shown on the proposed site plan cited in Condition 2. Those plans shall also be submitted to Old Kings Highway Historic District Committee for a new or amended Certificate of Appropriateness. 5. The dwelling shall be connected to public water and to the Town's Wastewater Treatment Facility. 6. Construction shall comply with all applicable fire codes,and all Health and Building Division requirements. 7. During all stages in the demolition and reconstruction of the dwelling,all vehicles,equipment and materials associated with the demolition/reconstruction shall be required to be located on-site,and, whenever possible,within the required setbacks. At no time will any parking, storage,or construction materials or items be permitted in the right-of-way of George Street or Goodview Way 3 • Bk 18554 Pg 62 #35111 or within 10 feet of the neighboring property except as may be needed for landscaping purposes or for utilities,and then only on a temporary basis. 8. All mechanical equipment associated with the dwelling(air conditioners,electric generators,etc.) shall be located so as to conform to the required setbacks for the district and screened from neighboring homes and the public right-of-ways. 9. The dwelling,covered porches,decks and the accessory shed shall be considered full build-out for the lot and it shall not be expanded in area or in footprint nor shall any other accessory structures be permitted without further permission from the Zoning Board of Appeals. 10. This decision must be recorded at the registry of deeds. A copy of that recorded document must be submitted to the Zoning Board of Appeals Office and to the Building Division before any demolition or building permit is issued. The relief authorized must be executed within one year of the granting of this permit. 11. The property shall not be rented on a weekly basis.
