Summary Granted with Conditions Applicant&Owner: Clifford White Applicant's Address: 74 George Street, Barnstable, MA Assessor's Map/Parcel: 319-73A Zoning: RB Residential B Zoning District Applicant's Request: Variance to Section 3-1.1 (5)Bulk Regulations Side and Rear Yard Setback Background Information: The application is for a Variance to Section 3-1.1 (5) Bulk Regulations for an existing tool shed that is too close to the property line. According to the application, the shed is 3 feet from the side and rear property line. The locus is in an Residential B Zoning District that requires a 10 foot setback. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on August 8, 1995. A Public Hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The Hearing was opened on September 27, 1995, at which time the Board found to grant the appeal with conditions. Board members hearing this appeal were Emmett Glynn, Elizabeth Nilsson, Robert Thorne, Thomas DeRiemer and Chairman Gail Nightingale. Clifford White represented himself at the proceedings. He explained that he has built a 6' by 10' shed in his back yard which infringes on the required setbacks. The lot is small and the only location for the shed was in this corner of the lot. He also located the structure in order to retain vegetation and views. The shed was built without a building permit and without Old Kings Highway Regional District Committee(OKH) approval. He sought and was granted OKH approval on August 23, 1995, for the shed. If the Variance is granted, he would then secure a building permit for the shed. The Board asked if this shed was on a permanent footing. Mr. White said it was on blocks. The Board asked if it was possible to move the shed into conformance. He noted that it would cost him money and that moving the shed would obstruct view and would place the shed directly against the home. • The public was requested to testify and a neighbor, David Conden spoke for the neighborhood association and noted of its 24 members who live on George Street, no one objected to the shed and its location. No one spoke in opposition. Finding of Facts: Based upon the testimony given during the Public Hearing on this appeal, the Board unanimously found the following findings of fact: 1. The Petitioner, Clifford White, is seeking a Variance to Bulk Regulations for an existing tool shed located on his property at 74 George Street in Barnstable, MA-Assessor's Map 319, Parcel 73A. Zoning Board of Appeals.-Decision and Notice Appeal Number 1995-127 White • 2. The enforcement of the Zoning Ordinance in this instance would be a substantial hardship on the Petitioner. II 3. To allow the shed to remain would not be a substantial detriment to the neighborhood in that the shed is built and neighbors have not complained nor objected. Decision: Based upon the positive findings a motion was duly made and seconded to grant a Variance of 7 feet from the required 10 foot side and rear yard setback to permit the shed to be located 3 feet from the property line with the following conditions: 1. A copy of the approval from the Old Kings Highway Regional District Committee(OKH) shall be submitted to the ZBA file. 2. No living space shall be permitted in the shed at any time. 3. The Applicant shall apply for the building permit to legitimize the shed structure.
