Abate:
Robert R Falanga, Falanga,Inc. and all persons having notice of this order:
As property owner or tenant of the property located at 156 Harbor Point Road,Assessors Map 352
Parcel 034, and you are hereby notified that you are in violation of Part 1 of the Town of Barnstable
General Ordinances, Chapter 240-Zoning, and are ORDERED this date 9/18/2019,to: CEASE
AND DESIST all functions associated with the following violation(s)on or at the above mentioned
premises and also at a location noted to be the intersection of Bone Hill Rd and Main Street where
an off-premises sign is installed and illuminated:
Summary of Violations:
On 9/18/2019,I observed a violation of the Barnstable Zoning Ordinance Chapter 240 Section 084
Specifically,'an abandoned sign (as determined and based on the status of the associated facility)
situated at the intersection of Bone Hill Rd and Route 6A, now illuminated and serving as
advertisement for a defunct restaurant located at 156 Harbor Point Road.
I, also observed a violation of the Barnstable Zoning Ordinance Chapter 240 Section 087
specifically, the failure to properly maintain and or repair the subject sign now declared
abandoned including recent electrical repairs or lighting provisions without required permits.
In order to abate these violations and to avoid further enforcement action by this office,commence
within 7 days upon receipt of this notice the following action: obtain electrical permit and officially
disconnect electrical service and remove the abandoned off-premise sign located the intersection of
Bone Hill Road and Route 6A.
And, if aggrieved by this notice and order, you may file an appeal with the Town Clerk of
Barnstable, specifying the ground thereof within thirty (30) days of the receipt of this order
(in accordance with Chapter 40A Section 15 of the Massachusetts General Laws). If, at the
expiration of the time allowed, action to abate this violation has not commenced, further
action as the law requires will be taken.

Article VII. Sign Regulations
§ 240-84. Abandoned signs.
A. Signs which have been abandoned due to a closing of a business, a
change in business name or for any other reason which renders the
sign not applicable to the property involved shall be removed by the
permit holder or the owner of the.buildingor premises within 14 days
from the_date of the action that caused,the sign to be considered
abandoned.
B. A condition of approval for all sign permits shall be that permit holders
or owners of the building or premises shall, at his or her own expense,
remove all abandoned signs.
C. New signs for a building or property on which an abandoned sign is
located shall not be approved until the abandoned sign is removed.
D. The Building Commissioner shall determine when a sign is abandoned.
Notice shall be sent to the permit holder and to the property owner prior
to administrative action.

Chapter 240. Zoning
Article VII. Sign Regulations
§ 240-87. Safety and maintenance.
A. All signs, together with their supporting structures, must be kept properly maintained,
repaired, and in proper condition. All signs and the grounds about them shall be kept
free from all rubbish and other objectionable material.
B. Failure to comply with these provisions shall be grounds for a citation.
C. If the Building Commissioner finds that a sign is' unsafe or otherwise improperly
maintained, he shall issue a written notice to that effect to the permit holder and the
property owner. If the specified conditions are not corrected, the Building
Commissioner is authorized to remove or repair the sign, all costs of which shall be
assessed to the permit holder or property owner, including an administrative fee of$50.
If public safety is involved, the Building Commissioner may take immediate action.
