Summary: Granted with Conditions Petitioner: Terrance M. and Janet L.Brooks Property Address: 15 Harbor View Road,Barnstable,MA Assessor's Map/Parcel: Map 319 as Parcel 044 Zonings Residential B Zoning District Background: In Appeal 2005-115, the applicant sought a special permit in accordance with Section 240-91 H(2) of the Code of the Town of Barnstable. That section of the Zoning Ordinance was'amelided in November of 2004 and requires that a special permit be issued from the Zoning Board of Appeals for the demolition/rebuilding of a single-family dwelling on undersized lots having less than 10,000 sq.ft. in lot area. The subject lot is 9,810 sq.ft. and requires that special permit. In granting of that special permit, the applicant is required to conform to current setback requirements, limited to a lot coverage of 20%by all structures and buildings and a maximum floor area ratio of the building cannot exceed 0.1 The proposed 2,683 sq.ft., three-bedroom, two-story dwelling and attached two car garage is replacing an existing 936 sq.ft.,two-bedroom one=story single family dwelling. The dwelling is to be connected to the Town's Wastewater Treatment Plant. An Order of Conditions was issued by the Conservation Commission on August 23, 2005. On July 27, 2005 a Certificate for Demolition was issued by the Old Kings Highway Historic District Committee for the removal of the existing structures on the property and on August 10, 2005,the Committee issued the Certificate of Appropriateness for the proposed new structure. Procedural & Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on November 01, 2005. An Extension of the Time Limits for holding the public hearing and for the filing of the decision was executed between the applicant and the Board Chairman. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing.was opened November 30,2005, and continued December 14,2005,and to January 04, 2006, at which time the Board found to grant the modification. Board Members deciding this appeal were, Randolph Childs,James Hatfield,Ron S.Jansson,Daniel M. Creedon, and Chairman Gail C. Nightingale. During the proceedings, the applicants were represented by Attorneys Brian Wall and Peter L.Freeman. Mr. Childs of Patriot Buildings was also present at the opening of the hearing. Attorney Wall cited that the existing structure dated to the 1920's and had been renovated around 1971. He cited that the lot and buildings predate the inception of zoning and do not comply with current zoning area requirements or with setback requirements. He stated that the proposed rebuilding on the lot would correct those setback non- conformities. Mr. Wall stated that the subject lot,being 9,810 sq.ft. still would require a special permit for the demolition rebuild pursuant to Section 240-91.H(2) of the Code of the Town of Barnstable. The requirements of that section were addressed and the proposed redevelopment of the lot met all of those requirements of lot coverage, floor area ratio and building setback and height. It was noted that the an Order of Conditions was issued by the Conservation Commission and a Certificate for Demolition and Appropriateness had been issued by the Old Kings Highway Historic District Committee. Public comment was requested and no one spoke in opposition to the appeal. The Board determined to continue the hearing to allow for a site visit. Findings of Fact: At the hearing of January 04,2006, the Board unanimously made the following findings of fact: 1. Appeal 2005-115 is that of the applicants,Terrance M. and Janet L. Brooks. They are seeking a Special Permit pursuant to Section 240-91 H(2) Nonconforming Lot. The subject property is located as shown on Assessor's Map 319 as Parcel 044 and addressed 15 Harbor View Road, Barnstable,MA in a Residence B Zoning District. 2. The property is a lot of 9,810 sq.ft. in the Residential B Zoning District that now requires a minimum lot area of 1 acre. The lot is non-conforming to that minimum lot area. The structure located on the lot is also non-conforming in terms of structural required setbacks that today are 20-foot front yard and 10- foot side and rear yard setback. The lot and structure predate the inception of zoning in this area of the Town. 3. The applicant seeks to demolish and rebuild a new single family dwelling on a pre-existing, nonconforming lot. The total gross floor area of the dwelling is cited as being 2,683 sq.ft. The proposed single-family dwelling is to be a three-bedroom, two-story dwelling with an attached two-car garage. The dwelling is to be connected to the Town's Wastewater Treatment Plant. 4. An Order of Conditions was issued by the Conservation Commission on August 23, 2005. On July 27, 2005 a Certificate for Demolition was issued by the Old Kings Highway Historic District Committee for the removal of the existing structures on the property and on August 10, 2005, the Committee issued the Certificate of Appropriateness for the proposed new structure. 5. In accordance with Section 240-91 H(2) Demolition Reconstruction on Undersized lots, the Board finds that the proposed plans for the dwelling meet all of the required criteria for Section 240-91 H(2) Demolition Reconstruction on Undersized lots. The structure is to conform to current setback requirements, the lot coverage does not exceed 20% and the floor area does not exceed the 0.3 ratio maximum building area. 6. The subject property is located in a congested area and given that the proposed new dwelling is to conform to current setbacks and all requirements of Section 240-91.H(2), it would not be substantially more detrimental to the neighborhood than the existing dwelling. 2 f 7. This appeal falls within a category specifically excepted in the ordinance for the granting of a Special Permit, and after evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. Decision: Based on the findings of fact, a motion was duly made and seconded to grant the special permit under the provision of Section 240-91 H(2) for the demolition and reconstruction on an undersized lot with less than 10,000 sq.ft. and is subject to all of the provisions of that section and the additional conditions as follows: 1. Barnstable MA"as drawn by Patriot Builders dated 07/05/05 and consisting of 4 sheets. 3. Construction shall comply with all applicable Building Division and Conservation Commission requirements. 4. The dwelling shall be connected to the Town's Wastewater Treatment Facility. 5. During all stages in the demolition and reconstruction of the dwelling, all vehicles, equipment and materials associated with the demolition/reconstruction shall be required to be located on-site except as may be permitted only if permission is granted from neighboring property owners. 6. At no time will any parking, storage or construction materials or items be permitted in the right-of-way of Harbor View Road except as may be needed for landscaping purposes or for utilities and then only on a temporary basis. 7. All mechanical equipment associated with the dwelling (air conditioners,electric generators, etc.) shall be located so as to conform to the required setbacks for the district and screened from neighboring homes and the public right-of-way. 8. The proposed redevelopment shall represent full-build out of the lot and the proposed structure, once built, shall not be expanded in area nor shall any accessory building or structure including that of a swimming pool be added. 9. This decision must be recorded at the registry of deeds and a copy of that recorded document must be submitted to the Zoning Board of Appeals Office and to the Building Division before any demolition or building permit is issued.
