The property was a 6,279 square foot rectangular-shaped lot with 57 feet of frontage on Harbor View Road, a narrow private drive serving the dwellings on west side of the street. The area is served by public water and sanitary sewer. The lot was created by a plan recorded in 1961 that reconfigured the boundaries between several adjoining lots. The subject lot was undersized in 1961; however, the 1961 plan brought the lot into greater conformance with the minimum lot area and frontage requirements in effect at the time and the creation of the lot did not result in any other lot becoming nonconforming. Procedural & Hearing Summary Special Permit No. 2012-047 to allow demolition and rebuilding of a single-family dwelling on a nonconforming lot with less than 10,000 square feet of area was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on July 25, 2012. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters and interested parties in accordance with MGL Chapter 40A. The hearing was opened August 22, 2012 at which time the Board found to grant the Special Permit subject to conditions. Board Members deciding this • appeal were Board Chair Laura F. Shufelt, William H. Newton, Craig G. Larson, Alex M. Rodolakis and George T. Zevitas. Attorney Jonathan ldman represented the Applicant before the Board. Richard Gordon was also present. Attorney Idman summarized the proposed reconstruction, emphasizing that the new to Town of Barnstable Zoning Board of Appeals—Decision and Notice Special Permit No.2012-047—Harborview Properties Realty Trust house would conform to setback requirements and would be moved further from existing structures. He indicated that they had met with abutting property owners prior to filing with the Board and had made changes in response to their concerns. He explained that the house had been approved by the Old Kings Highway Committee, but that there were subsequent revisions to the design that would need to be reviewed and approved. The Board discussed the bulk of the new house. Members commented that the neighborhood had changed and the proposed design was not out of character. The Board Chair agreed and noted that the house did meet setback requirements, but expressed concern over the height of the - dwelling. The issue of parking was raised and the Applicant indicated that overflow parking would be accommodated on the grass. The Board also reviewed the half-story covered porch. Staff noted that if the porch was to be considered 'enclosed', it would count towards the total gross floor area of the dwelling. The Board expressed no objection to the porch. Public comment was requested and no one spoke in favor of, or in opposition to, the proposal. Findings of Fact At the hearing of August 22, 2012, the Board unanimously made the following findings of fact for Appeal 2012-047, a request for a special permit filed by Harborview Properties Realty Trust to demolish and rebuild a dwelling at 67 Harbor View Road: 1. Richard N. Gordon, Trustee of Harborview Properties Realty Trust has petitioned for a Special Permit pursuant to Section 240-91(H)(3). The Petitioner seeks to demolish and rebuild a single-family residence on a pre-existing nonconforming lot that does not meet minimum frontage requirements in the RB District and contains less than 10,000 square feet in area. 2. The subject property is located at 67 Harbor View Road, Barnstable, MA as shown on Assessor's Map 319 as Parcel 133. It is in the Residence B Zoning District. 3. The applicant is proposing to demolish the existing cottage a rebuild a new, 1,878 square foot, 2.5 story dwelling. The dwelling would be connected to public sanitary sewer. 4. The application falls within a category specifically excepted in the ordinance for a grant of a special permit. Ordinance Section 240-91(H), applicable to preexisting legal nonconforming lots less than 10,000 square feet improved with a single-family residence which conformed to - all provisions of the zoning ordinance in effect at the time of construction, allows for the complete demolition of the old residence and reconstruction of a new residence with a Special Permit from the Zoning Board of Appeals. 5. Site Plan Review is not required for single-family residential structures. 6. After an evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or • the neighborhood affected. 7. The proposed dwelling is in compliance with standards for setback, lot coverage, floor area, and height. 8.
