Harris Dear Mr. DaLuz : This office represents Thomas Proe who has contracted to purchase land owned by John 11. Harris on Harris Meadow Lane , off Main Street, in Barnstable . An express contingency of the contract is our verification that the land is a buildable lot within the meaning of II� the Barnstable Zoning By-laws. The land consists of two parcels . The first is parcel "B" on the Plan of Land of Margaret Rich dated November 15 , 1972 , and recorded with Barnstable Deeds in Book 266 , Page 130 . A copy of that Plan is enclosed. The parcel predated the zoning by-law changes and, as it contains 29, 500 square feet and has well over 50 feet of frontage, appears to be buildable under the provisions of M.G.L. Chapter 40A, Section 6 as a previously owned lot. In 1974 , a piece of the land was transferred out for the purpose of slightly altering a right of way next to the premises and an extra parcel was added to the land to compensate the owner. This change is incorporated on the Subdivision Plan of Land for Jane David recorded with Plan Book 289 , Page 16 , a copy of which I enclose. Parcel "B" on the copy is the portion that was added totalling 2 , 424 square feet. As you can see , the total area of the land was increased as a result of this change.
