The subject lot is .57 acres and developed with a 2,356 gross square foot, three-bedroom dwelling constructed in 1953. The lot has frontage on Harvey Avenue and overlooks Barnstable Harbor. Undersized lots appear typical for the area. Property is served by town sewer. The existing dwelling has a front setback of 28.3 feet where 30 feet is the minimum required, a side setback of 18.2 feet where 15 feet is the minimum required and a rear setback of 14.6 feet where 15 feet is the minimum required. The lot size is 19,887 square feet where one acre is required. Under Section 240-91 (H)(3)(a) Special Permit is required for demolition and rebuilding because the proposed dwelling does not meet the setback criteria in H(1)(a). Procedural & Hearing Summary Special Permit Application No. 2019-049 for the demolition and construction of a dwelling which does not comply with the rear yard setback was filed at the Town Clerk's office and office of the Zoning Board of Appeals on August 8, 2019. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters and interested parties In accordance-with MGL Chapter 40A. The hearing was opened on September 11, 2019 and continued to September 25, 2019 at which time the Board found to grant the Special Permit subject to conditions. Board w Members deciding this appeal were: Herbert Bodensiek, Bob Twiss, Paul Pinard, Todd Walantis and Jacob Dewey. Alex Rodolakis recused himself from this application. Attorney Michael Schulz, representing the Applicant, appeared before the Board. Also present was builder Jimmy Bowes, Attorney Schulz reviewed the project and the existing and proposed conditions. He stated the new dwelling meets the current side yard setbacks, that no new Town of Bamstable Zoning Board of Appeals-Decision and Notice Special Permit No.2019-049-Hilton nonconformities are created with respect to the front or rear yard setback, and that the new dwelling meets the spirit and intent of the Ordinance which would not be substantially more detrimental than the existing structure to the neighborhood. Mr. Bowes discussed the building code requirements in the floodP lain. The Board Chair acknowledged letters of support from direct abutters John Still dated September 19, 2019, Jon Lewis dated September 16, 2019, James Still dated September 16, 2019 and Ann Morganstern dated September 14, 2019. The Chair also acknowledged an email of concern from Deirdre Detjens dated September 25, 2019. The Chair requested public comment and no one spoke. The Board discussed flooding issues in the area. Findings of Fact At the hearing on September 25, 2019, the Board made the following findings of fact in Special Permit Application No. 2019-049, a request to demolish and construct a single-family dwelling: 1. The application falls within a category specifically excepted in the ordinance for a grant of a special permit. Section 240-91(H)(3) allows for the complete demolition and rebuilding of a residence on a nonconforming lot where the proposed setbacks equal to or greater than the existing setbacks. 2. Site Plan Review is not required for single-family residential dwellings. 3. After an evaluation of all the evidence presented, the proposal fulfills the spirit and Intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. 4. The proposed yard setbacks must be equal to or greater than the yard setbacks of the existing building. The proposed setbacks will comply with the requirements of Chapter 40A Section 6 with a Special Permit. 5. The proposed lot coverage shall not exceed 20% or the existing lot coverage, whichever is greater. The proposed lot coverage is 15.3%. 6. The floor area ratio shall not exceed 0.30 or the existing floor area ratio of the structure being demolished, whichever is greater. The proposed FAR is .13 or 13%. 7. The building height, in feet, shall not exceed 30 feet to the highest plate and shall contain no more than 2 '/2 stories. The proposed height is 25 feet to the top of the plate (30 feet maximum to the plate) and the proposed dwelling is 2 stories. 8. The proposed new dwelling would not be substantially more detrimental to the neighborhood than the existing dwelling.
