Crossen Building Commissioner , Town of Barnstable 367 Main Street Hyannis, MA 02601 Re: Request for Determination of Buildability of Undersized Lot Locus: Lot 23,Plan Book 172, Page 51 a/k/a 549 Huckins Neck Road, Barnstable, MA Parcel ID#: Map 234,Parcel 39 Land Area: 15,310 Square Feet or.351 Acres Dear Mr. Crossen, I am writing to request,a determination from you that for zoning purposes, the above-referenced lot is a "non-conforming lot" exempted from the current minimum lot size provisions of the Barnstable Zoning Ordinance. The facts regarding the subject lot and the adjoining lots are as follows: 1. The lot was established on a plan of land dated September 22, 1962. The plan is recorded in the Barnstable County Registry of Deeds in Plan Book 172, Page 51. Locus is shown as Lot 23 on said plan. The subject locus has 15,310 square feet of land (351 acres) and 110.00 feet of frontage on an approved way, Huckins Neck Road, also known as Neck Lane. 2. Cape Cod Real Estate Exchange, Inc., deeded the entire development -- "Pleasant Pines" --to Spero Theoharidis and Magdalene Theoharidis, Trustees of Cedar Acres Realty by deed dated May 17, 1963 and recorded in Book 1205, Page 411. Lot 23, itself, was conveyed separate from all adjacent lots by deed from Spero Theoharidis and Magdalene Theoharidis, Ralph M. Crossen Building Commissioner February 14, 2000 Page 2 of 5 Trustees of Cedar Acres Realty Trust dated November 4, 1977 and recorded in Book 2621, Page 2. The Grantees of the deed at Book 2621, Page 2, were Owen F. Needham and Kathleen W. Needham,.husband and wife. Owen F. Needam and Kathleen W. Needam, in turn, conveyed Lot 23 to Gene R. Gerbitz and Linda M. Gerbitz, husband and wife by deed dated April 23, 1981 and recorded among the records at Barnstable County Registry of Deeds on April 24, 1981 at Book 3274, Page 280. Gene R. Donlan, Elizabeth G. Andreoli , and John J. Donlan and Elizabeth Donlan dated October 24, 1963 and recorded October 31, 1963 in Book 1224,Page 355. John J. Donlan died and the surviving three conveyed Lot 20 to Deborah A. Duverger by deed dated September 15, 1977 and recorded September 22, 1977 in Book 2585, Page 184. This was a deed from Spero Theoharidis and Magdalene Theoharidis, Trustees of Cedar Acres Realty Trust, to Peder M. Stennes and Carrie M. Stennes, husband and wife, as Tenants by the Entirety. Said deed is dated October 31, 1963 and recorded in Barnstable County Registry of Deeds November 1, 1963 in Book 1224,Page 458. The Death Certificate of Peder M. Stennes is recorded in Book 1813, Page 063. Carrie M. Stennes, as sole tenant, in turn conveyed Lot 22 to Alice E. Lamson and Marjorie E. Lot 24 on the Plan recorded at Plan Book 172, Page 51 was conveyed to ownership separate from the subject Lot 23 on May 11, 1967, when Spero Theoharidis and Magdalene Theoharidis, Trustees of Cedar Acres Realty Trust conveyed it to Bruce B. McGee and Mary E. Brunnelle. This deed Ralph M. Crossen Building Commissioner February 14, 2000 Page 4 of 5 is recorded in Book 1365, Page 703. On December 21, 1970, Bruce B. McGee and Mary E. On February 28, 1985, by Article 1 in the Town Meeting in the Town of Barnstable, minimum lot size for the subject area was increased to 43,560 square feet. Based on the foregoing, it is my opinion that under Section 4-4.2 (1)of the Town of Barnstable Zoning Ordinance, this lot was not held in common ownership with any adjoining land at the time of the zoning change which made it nonconforming; and has at least 5,000 square feet of area and 50 feet of frontage; and conformed to the existing zoning when legally created; and was separately owned at the time of every zoning change which made it nonconforming. Therefore, it is my opinion that this lot is "grandfathered" and may be built upon for residential purposes because the lot conforms to Section 4-4.2 (1)of the Zoning Ordinance.
