This request was made specifically in accordance with the provisions of General Laws Chapter 40A Section 7. (For your reference a copy of said request is enclosed.) The Trial and Appellate Courts of the Commonwealth of Massachusetts have established that your response is a pre-curser to our ability to have the matter reviewed by the Barnstable Zoning Board of Appeals initially, and thereafter, the Barnstable Superior Court. The courts have also established that the means of compelling a response, when for whatever reason the Building Commissioner or Zoning Enforcement Officer declines to follow the provisions of 40A, Section 7, is an action by way of mandamus seeking an Order of the Barnstable Superior Court compelling you to submit a written response, either asao the action that you will take by way of enforcement, or the reasons why you will decline to take any enforcement action. This process only adds an unnecessary expense to the Town of Barnstable and maybe completely eliminated by the office of the Zoning Enforcement Officer simply following the statutory mandate. Should we not have your response within five (5) business days of the receipt of this correspondence, we will file a complaint in the Superior Court of Barnstable County against you seeking in that complaint, a mandatory injunction compelling you to respond as required by General Laws, Chapter 40A, Section 7. Atten; Robin 200 Main Street Hyannis, Ma.02601 This letter of explanation is at your request after the inspection of our property at 430/450 Braggs Lane in Bamstable,on Tues.June 24,2008 regarding our composting farm. - We own and operate on approximately 8+-acres a small composting and vegetable farm. The actual composting is done on less than 3/4 acre of the property. Since receiving the first complaint regarding noise in the spring of this year we have installed all new muffler systems on our equipment and in some cases double mufflers..We have made every effort to comply with our'new'neighbors request to keep the noise down while she sleeps late mornings. Especially on the days she is at home. Some days a short period of running the equipment is unavoidable. We do not start any machinery up before 8am and it is all silent by 7pm In total the equipment is run approx.2-4 hrs.total all week. We are producing less than 400 yards of compost annually with leaves and grass dropped on the property by our son and an occasional neighbor. We are more than the required 25 ft.setback from the street in all directions. We have been operating. out of this property since 1972 as a farm and composting yard waste (Recycling it)We were granted Agricultural Rights by Herb Stringer(building Inspector)in the 70's and again in the 80's by Joe DeLuce (building Inspector)and then Mr Whitty of the Assessors office(all verbal agreements). We do not sell to the public..Our son takes any composted product(loam)that we do not use for our own purposes...We have a large vegetable garden,a barn and at this point no animals although we have had many in the past..Pigs,cows,chickens,turkeys,ducks,etc. We have not had a single complaint regarding odor,noise,traffic etc.in the past 36 years. Not until our new neighbor moved in. Regarding her claim that there is constant large truck traffic coming and going that is just not true.. Late in the afternoon 3-5 days a week,there are anywhere from 1 to 3 pickup trucks that make one trip each to drop off lawn clippings in the summer and leaves in the fall. This is only from April thru Nov. Occasionally a small dump truck will pick up some finished product(loam)and leave with that,but that may be any where from 1 to 10 times a month. We are only here from May first thru Dec. This is not by any means a full time commercial operation.. This is a small family project exclusively for the family use. We have also been requested to remove the woodchips from the end of Hyannis/Bamstable Road that the Town of Bamstable started to put there in 1980's and again when they cleared Phinneys Lane in the 90's.(Yes,we have added to the pile on occasion).This will be taken care of as promised but our neighbor can not be calling the Town to complain every time we fire up a machine to try to remove these chips. They stop us and hence the chips cannot be removed.... I appreciate the time and effort you are putting into this Robin and hope that this helps to sooth the situation a bit. This correspondence is to be.considered a request for zoning enforcement pursuant to the provisions of General Laws Chapter 40A, Section 7, and accordingly, we would request a written response either by way of the requested action, as will be set forth later in this correspondence, or a written declination to take such action and the reasons therefor, all within the time constraints set forth within the aforementioned statutory provision. • As previously noted, Mr. Amster's residence is located at 1367 Hyannis-Barnstable Road. To acclimate you as to the nature of the situation of which we are complaining, I have attached as an enclosure with this correspondence a copy of the Town of Barnstable Geographic Information System, and will refer to the parcels at issue by parcel number from that system: Mr. Amster's residence is shown on the aforementioned.map as parcel number 297006. We have penned-in the name of Hyannis- Barnstable Road,and, at this point;although not shown on this map, Hyannis-Barnstable Road is a dead end street which abuts they layout of the Mid-Cape Highway(Route 6)and is improved by way of pavement and a cul-de-sac at the road's terminus at the edge of the highway layout.,_•-) ,- - •. Of further significance are two parcels of land owned by the Town of Barnstable which encompass a portion of the public way and cul-de-sac. These parcels are identified as parcels numbered 297004 and;29.70014. • - � • ZISSON AND VEARA Thomas Perry, Building Commissioner June 23, 2008 Page 2 Finally,the properties which are owned or controlled by Thomas Vetorino, his wife, or trust under their control, are shown on this map as parcels numbered 297015 and 297016. The area where Mr. Amster's residence is located is in a residentially zoned district. Notwithstanding this zoning district and its constraints, Mr. Amster reports and has documented by way of photographs that there is a commercial operation in the nature of stump grinding, loam screening, and heavy equipment operation at the Vetorino location. Moreover and most astounding is the fact that the Vetorino operation is using the two town-owned parcels as storage areas for bulk storage of large piles of mulch and screened loam. Mr. Amster reports to me that this"storage area"not only infringes on the paved portion of Hyannis-Barnstable Road, but is being deposited there and on-loaded onto dump trucks that would traverse Hyannis-Barnstable Road for purposes of being loaded by heavy equipment. Not AI only is this a violation of the residential zoning restraint, but the noise and traffic is disturbing the residential quality and tranquility of the neighborhood. Further,the volume of heavy trucking poses a substantial risk to persons, including young children, that reside on what is a dead-end street. In addition to the aforementioned violation,town-owned parcel number 297014 also has had a driveway constructed upon it. It is our understanding that this road/driveway is being used to gain access to parcel number 297016 which is being used for a commercial enterprise. The proper and lawful access to this property should be at 450 Bragg Lane and not across the town-owned parcel numbered 297014 as there appears to be no grant of easement or rights whatsoever to support this present use of the town- owned land. Mr. Amster has provided us photographs of the operation on the property at parcel number 297015 and designated on the enclosed map as a stump dump, which clearly demonstrates the extreme nature of the commercial activity that is being conducted on the property. Hugh excavating equipment is in place as well as screening and grinding equipment for purposes of creating the mulch and screening loam for resale. All of the aforementioned activities at this location are in violation of the residential zone in which the properties are located, and accordingly, we would ask that immediate action be taken by way of a cease and desist order directed to Mr. Vetorino and members of his family who own or control parcels numbered 297015 and 297016. We request that said order require immediate cessation of the operation of heavy equipment,the conduct of a stump dump operation and loam screening facility, as well as the use of the two town-owned parcels for storage and loading areas for these products.
