The history, for purposes of this determination, of the Lot begins with the recording of the ANR Plan on November 24, 1965 at which time the owner of said Lot 1 was Dr. William Bencker who also owned Lot 2 as shown on the ANR Plan. On November 24, 1965 Dr. Bencker conveyed Lots 1 and 2 to Mr. and Mrs. Wendell Jacques who immediately conveyed Lots 1 and 2 to Mr. and Mrs. George Luddy. The Luddys conveyed Lot 1 to Linda Plunkett on October 19, 1973, who is the current record owner. Lot 1 is a vacant lot with no improvements thereon. Lot 5 as shown on Plan dated October 1926 and recorded at the Barnstable County Registry of Deeds at Plan Book 55, Page 27 hereinafter the"Lot 5 Plan". The Lot 5 Plan depicts also Lot 4 which Lot is also (though reconfigured) now known as Lot 1 as shown on the ANR Plan. Lot 5 has a house on it and has had the" house on the Lot since, at least, 1955. Lot 5, as of December 10, 1955,was owned by Virginia Campbell and by a deed dated April 25, 1968 and recorded at the Barnstable County Registry of Deeds on the same day Ms. Campbell conveyed Lot 5 to Gregory P. Plunkett (husband of Linda J. Plunkett owner of the abutting parcel, Lot 4). On January 26, 1977, Gregory P. Plunkett conveyed Lot 5 to himself as Trustee of the H.P. Realty Trust. This deed was recorded on February 3, 1977. It is known that the beneficiary of the H.P. Realty Trust was Gregory P. Plunkett as stated in the Trustee Deed signed by Gregory P. Plunkett as Trustee and by Gregory P. Plunkett Individually. Said Trustee Page 2 March 25, 1998 Deed is dated March 3, 1989 and recorded at the Barnstable County Registry of Deeds on March 14, 1989 and conveys Lot 5 to his wife Linda J. Plunkett. On July 6, 1992 a foreclosure deed was recorded divesting Mrs. Plunkett of her interest in Lot 5 which now stands in an unrelated party's possession.
