The WEEBLug consists of two parts: a stainless steel washer(weeb-6.7)and a tin-plated copper lug. The washer is designed to provide a reliable gas-tight electrical connection with anodized aluminum pieces. The lug allows the lay-in connection of an electrical equipment grounding conductor. The existing structure complies with the required yard setbacks for the district. However,the lot is undersized in that the zoning district now requires one-acre minimum lot area. The hearing was opened February 12,2003,at which time the Board found to grant the appeal. Board Members deciding this appeal were,Gail Nightingale,Ron S.Jansson,Ralph Copeland,Thomas A. DeRiemer and Chairman Daniel M. Creedon. The applicant Stephen T.Vetorino represented himself before the Board. He submitted a copy of deed that transferred the property from Thomas F. and Karen Vetorino,his parents,to him. The two-car garage would be attached to the structure. Mr.Vetorino noted the condition of the building required demolition. A demolition certificate and a certificate of appropriateness had been issued by the Old Kings Highway Historic District for the proposal. He stated that he had discussed the proposals with neighbors and no one objected to his proposed demolition or rebuilding. The new structure would conform to all setbacks for the district. Public comment was invited and no one spoke in favor or against the proposal. The Board noted that a certified proposed plot plan by the surveyor would be needed. The applicant committed to providing one for the file. _ i V Findings of Fact: At the hearing of February 12, 2003, the Board unanimously made the following findings of fact: 1. In Appeal 2003-028 Stephen T.Vetorino has applied for a Special Permit and Findings in accordance with Section 4-4.3 and Chapter 40A,Section 6,Non-conformities to permit the demolish and reconstruction of a single-family dwelling on an undersized lot.The property is shown on Assessor's Map 298 as Parcel 026. It is addressed as 467 Braggs Lane,Barnstable,MA and is in a Residential F-2 Zoning District. 2. The Residential F-2 Zoning District today requires a minimum lot area of 1-acre. Tlie subject lot is a legal non-conforming lot. It has only 0.81-acres and is deficient in area. In the Land Court case of Dugas v. Barnstable Zoning Board Of Appeals, the Court has ruled that with respect to demolition and rebuilding on undersized lots,the Board must determine whether the new dwelling is a"reconstruction"under MGL Ch. 40A, Section 6 and make finding with regards to intensification and detriment to the neighborhood. 3. The lot is developed with a one& one/third-story,two-bedroom, single-family dwelling built in 1972. It has a living area of 864-sq.ft. The existing structure complies with the required yard setbacks for the district. The applicant is proposing to demolish the existing single-family dwelling and reconstruct a new single- family dwelling.The proposed new single-family dwelling will comply with all required setbacks for the district. The proposed new structure is to be one&one/half-story, three-bedroom plus family room and office single-family dwelling of approximately 2,380 sq.ft. and an attached garage of 780 sq.ft. The applicant has applied for and received a Certificate of Demolition for the existing dwelling and a Certificate of Appropriateness for the new.dwelling from the Old Kings Highway Historic District Commission. 5. The proposed new dwelling is a reconstruction under MGL Chapter 40A,Section 6. The existing structure and the proposed reconstruction, conforms to the required setbacks. The only non-conformity is in the lot area.Although the new dwelling is larger and represents an intensification,the proposed new dwelling would not be substantially more detrimental to the neighborhood than the former dwelling.
