Dear Ms. Dugas,
I am in receipt of correspondence from you in which you request enforcement concerning the property located
at 1525 Hyannis Road in Barnstable. Your requests)-for enforcement have been difficult to process as you
have made multiple allegations but have failed to provide a single citation,relevant code reference or
meaningful evidence to substantiate them. So,it has been left to us to try to determine which laws and
regulations you wish to have enforced. To further complicate matters your various requests fall under
different general laws and Commonwealth of Massachusetts Regulations(CMR)each requiring a separate
response as.the appellate process for each are different.
Based upon our careful review of your requests and multiple investigations I have determined that your
requests for enforcement fall into three (3)categories:
• Private property and civil disputes between private citizens
• The Building Code .
• Old Kings Highway Regional Historic District(OKH)
As I stated above,the three categories each fall under separate provisions in law and regulations and each
have different appeals and/or adjudication processes. Therefore, each must be addressed separately to ensure
that you are properly advised of your rights to appeal.
In this correspondence I will address the first category which relates to private disputes between private
citizens. I will address the building code and OKH matters under separate cover.letters for the reasons stated
above.
For your convenience I will summarize each allegation in the numerical order in which they appear in your
request followed by our findings which will be labeled in bold letters as: Response. I will then conclude with
our action based upon the totality of our findings.

1. A garage moved with a crane off a foundation and place on the opposite property line
Response: This matter is not addressed here— See subsequent Building Code response letter
2. Property bounds removed and covered
Response: This issue is a private matter and not in the public interest,therefore it is not actionable by
Inspectional Services.
3. Trees and plants cut, uprooted and removed
Response: There are no permits required for property maintenance on an improved lot. This issue is
a private matter and not in the public interest,therefore it is not actionable by Inspectional Services.
4. Allegation:Mr. Bishop's crew coming on my property
Response: This issue is a private matter and not in the public interest,therefore it is not,actionable by
Inspectional Services.
5. Allegation:Mr. Bishop has become increasingly aggressive in his actions
Response: This issue is a private matter and not in the public interest,therefore it is not actionable by
Inspectional Services.
6. Allegation:He has threatened to run a fence the entire length of the property
Response: "Threatening"or articulating intent to erect any type of structure is not a violation of a law
or regulation. This issue is a private matter and not in the public interest,therefore it is not actionable
by Inspectional Services.
7. Allegation: The fence that he put up several years ago is greater than 7 feet tall and he never went to
OldKings Highway for that.
Response:This matter is not addressed here—See subsequent OKH Historic District letter
8. Allegation:He has advised me that he is going to fill all of his land
Response: Verbalizing intent to fill land is not a violation of law or a regulation. This issue is a
private matter and not in the public interest,therefore it is not actionable by Inspectional Services.
9. Allegation:He indicated that he plans to run a driveway along my property line
Response: Verbalizing an intent to construct a driveway is not a violation of law or a regulation. This
issue is a private matter and not in the public interest,therefore it is not actionable by Inspectional
Services.
10. Allegation:He wants to access his property from Hot Bottom Road. Has no right to use it as access

Response: This involves a property dispute between private parties. This issue is a private matter
and not in the public interest,therefore it is not actionable by Inspectional Services.
11. Allegation:He has also started preparations for an addition to his existing house without
permitting.
Response: Making preparations to erect a structure that does not involve construction is not a
violation of a law or regulation. This issue is not actionable by Inspectional Services.
In your letter you state: "It is for these reasons that I request that the work on that property be stopped and
Mr. Bishop notified that he must seek out the proper approvals before altering the property further. "
Response:While an individual may request enforcement it is the code enforcement officer who
determines whether or not to enforce and in what manner. As you can see from my responses you
have requested enforcement where none is available through the regulatory process so no order to
cease and desist will be issued.
You further state, "Due to the reduction in staffing during to the current COVID-19 Pandemic the inspector
could not visit the property while the work was in progress"
Response: Respectfully,that is incorrect. Our inspectors have been to the site multiple times. I
personally have been there during ongoing maintenance.
Finally,you stated: "I was told that the inspector would go by the property on Tuesday of this coming week. I
would like to know what time he expects to visit the property as I would like to be present on my property."
Response: Code compliance inspections are not intended to be hearings. We do not take testimony
or adjudicate matters during that process. Our inspectors are required to conduct their investigations
and gather evidence in a non-biased manner without outside influence.
The only time that we ask for parties to be present is when it is necessary to obtain permission to
enter upon private property or when we have specific questions. We did not need to go onto your
property and we had your allegations and contact information if we needed to contact you regarding
the investigation. We did not find that to be necessary.
Based upon a careful review of your request for enforcement, our investigation and evidence gathered we
have found that,unless otherwise stated above, your requests for enforcement are a private matter between
private citizens. They are not in the public interest and are not actionable by Inspectional Services.
Therefore,your request(s)for enforcement as outlined above are DENIED.
Typically I would explain the appeals process at the conclusion of this type of response but as the allegations
and concerns listed above are not regulatory matters there is no appellate process to advise you of except that
you may wish to consider obtaining an attorney to provide you with legal advice.

The current exemption for "homeowners" was extended to include owner-occupied
dwellings of six units or less and to allow such homeowners to engage an in-
dividual for hire who does not possess a license, provided that the owner
acts as supervisor.
DEFINITION OF HOMEOWNER:
Person(s) who owns a parcel of land on which he/she resides or intends to re-
side, on which there is, or is intended to be, a one or two family dwelling,
attached or detached structures accessory to such use and/or farm structures.
A person who constructs more than one home in a two-year period shall not be
considered a homeowner. Such "homeowner" shall submit to the Building Official
on a form acceptable to the Building Official, that he/she shall be responsible
for all such work performed under the building permit. (Section 109.1. 1)
The undersigned "homeowner" assumes responsibility for compliance with the Stat
Building Code and other applicable codes, by-laws, rules and regulations.
The undersigned "homeowner" certifies that he/she understands the Town of
Barnstable Building Department minimum inspection procedures and requirements
and that he/she will comply with said procedures and requirements. •

HOME OWNER'S EXEMPTION
The code state that: "Any Home Owner performing work for which a building
permit is required shall be exempt from the provisions of this section
(Section 109. 1. 1 - Licensing of Construction Supervisors) ; provided that if
Home Owner engages a person(s) for hire to do such work, that such Home Owner
shall act as supervisor. "

Many Home Owners who use this exemption are unaware that they are assuming
the responsibilities of a supervisor (see Appendix Q, Rules and Regulations
for licensing Construction Supervisors, Section 2. 15) . This lack of awarenes
often results in serious problems, particularly when the Home Owner hires
unlicensed persons. In this case our Board cannot proceed against the
inlicensed person as it would with licensed Supervisor. The Home 'Owner actin
as supervisor is ultimately responsible.
To ensure that the Home Owner is fully aware of his/her responsibilities, man
communities require, as part of the permit application, that the Home Owner
certify that he/she understands the responsibilities of a supervisor. On the
last page of this issue is a form currently used by several towns. You may
care to amend and adopt such a form/certification for use in your community.
