It is a triangular lot of 0.44-acres, developed with a one-story,one-bedroom,single family dwelling of 426 sq.ft.of living area. The dwelling p0 dates to 1950 and therefore would predate enactment of zoning in this area of the Town. C. S' The applicant is proposing to demolish the existing dwelling on the subject lot and reconstruct a new single- family dwelling. According to the application,the proposed new single-family dwelling would have a total of 1,765 sq.ft.of living area,a back deck of 192 sq.ft.and a storage area of 192 sq.ft. The dwelling is a two- qr... bedroom,one and one-half story structure with a full basement. The footprint of the structure including the deck is 1,324 sq.ft. The dwelling is to be connected to public water and to the Town's Wastewater Treatment Facility. According to the survey plan presented,the proposed new dwelling will conform to the required setbacks of ' l the Residence G Zoning District. However,there is an existing shed on the property that is labeled as"to remain". That shed is located within the required 15 foot rear yard area and does not conform. Procedural&Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on June -*IA 2004. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened September 22,2004,continued to November 03,2004,November 17,2004,December 1,2004,and December 8,2004,at which time the Board found to grant the appeal. Board Members deciding this appeal were,Ralph Copeland,Jeremy Gilmore,Gail Nightingale,Randolph Childs and Acting Chairman Ron S Jansson. At the opening of the public hearing,the applicant Steven G.Heslinga represented himself before the Board noting it was his desire to demolish the dwelling located on the subject lot and rebuild a new single-family dwelling. He cited that the existing structure was in deteriorating condition and after appraisal of the structure,the most practical option would be to remove the building and build a new structure. The board noted that the subject lot was created by an Approval Not Required(ANR)plan endorsed by the Planning Board in 1986. At the time of creation,the subject lot did not meet the requirements of zoning as that area was already zoned Residence G requiring a minimum lot area of 65,000 sq.ft. The Board also noted that when the subject lot was created,no relief was issued for the undersized lot. The Board obtained the advice of the Town Attomey's Office and recommended to the applicant to consider seeking additional relief of a Variance for the subject lot. The hearing was continued to November 03,2004. Public comment was requested and no one spoke in favor or in opposition to the request. r" if Bk 19500 Pg 299 #7495 At the continuance,Attorney Mark H.Boudreau represented the applicant,and he submitted a Memorandum in support of the application. He noted that alternative relief in the form of a Variance was also requested if the Board could not see its way in granting the Special Permit for the demolition and the rebuilding of the dwelling on the subject lot. Mr.Boudreau noted that he had reviewed the Town Attorney's legal opinion on this matter and addressed the Variance criteria noting that the subject lot has six sides and that the use of the structures predated the creation of zoning in this area of the Town. He noted that both buildings were being used as independent residential structures. The Board clarified that the applicant purchased the property in 1977 and then later purchased additional adjacent land which is all part of the 1986 ANR plan. The Board noted that an ANR plan in itself does not constitute a buildable lot. Public comment was requested and Cheryl Lombardi of 1650 Hyannis Road and Phil Finnigan of 78 Maushop Avenue spoke in favor of the proposal. The Chairman noted that two letters of support were submitted to the file. The first was from Jeannine and Gerald Madden of Maushop Avenue;and the second was dated September 9,2004 and signed by: Cheryl Lombardi of 1650 Hyannis Road,J.W.Eames of 1606 Hyannis Road,John and Mary Campbell of 14 Maushop Avenue,and Joseph and Marilyn Keohane of 34 Maushop Avenue. The Board discussed the issues of the ANR plan and the creation of three lots. The subject lot contained a dwelling,a second lot contained a dwelling,and the third lot was a vacant developable lot. The subject lot was undersized and the other two lots conformed to zoning. The Board also noted that the second lot containing a dwelling apparently also contained an apartment. The Board requested additional information with respect to that apartment unit. The appeal was continued to November 17,2004. At the November 17,2004 hearing,a Planning Division Staff Memorandum was submitted to the Board citing the history of the apartment unit on the adjacent property noting that the unit was found to be a legal non-conforming use by the Board in 1992 and the applicant was granted a Special Permit to allow the apartment unit to be altered and expanded. In addition,Mr.Boudreau submitted a supplementary Memorandum in support of the grant of the Special Permit. The Board reviewed the proposed demolition and reconstruction on the property noting that subject lot is and would continued to be accessed directly from Hyannis Road. It was noted that the dwelling had been occupied as an independent living unit until just recently when it was vacated in anticipation of the demolition and reconstruction. The Old King's Highway Historic Commission had reviewed the plans and issued a Certificate for the Demolition of the existing building and a Certificate of Appropriateness for the construction of the new dwelling. It was noted that there was no public opposition to the proposal. The hearing was continued to December 1,2004 and again to December 08,2004 to permit the Board Members added time to review the issues in the appeal. At the December 08,2004 continuance,the Board members discussed the relief being requested. Acting Chairman Ron Jansson stated that he would abstain from the vote and informed the applicant that four positive votes were required to grant relief. Mr.Boudreau agreed to continue forward with the appeal. Findings of Fact: At the hearing of December 08,2004,the Board made the following findings of fact: 1. Appeal 2004-123 is that of Steven G.Heslinga seeking a Special Permit in accordance with Section 4- 4.3(2)Non-conforming Buildings or Structures Used as Single and Two-Family Residences and findings under MGL Chapter 40A,Section 6 for the demolition and reconstruction of a single-family dwelling on 2 Bk 19500 Pg 300 #7495 a non-conforming lot. The property is addressed 1631 Hyannis Road,Barnstable,MA located as shown on Assessor's Map 299 as Parcel 001-003. It is in a Residence G Zoning District. 2. The property has an existing dwelling on it. The dwelling and its use legally predates the enactment of zoning for this area of the Town. The applicant seeks to demolish that structure and rebuild a new structure that would conform to the required setbacks for the zoning district it is in. The existing dwelling has 426 sq.ft.of living area and was built in 1950. 3. The applicant is proposing to reconstruct a new single-family dwelling of 1,765 sq.ft.of living area,a back deck of 192 sq.ft.and a storage area of 192 sq.ft. The dwelling is to be a two-bedroom,one and one-half story structure with a full basement. The proposed new dwelling will conform to the required setbacks of the Residence G Zoning District. There is an existing shed on the property that is labeled as "to remain". That shed is located within the required 15 foot rear yard area and does not conform. 4. The subject lot was created by an Approval Not Required(ANR)plan,endorsed by the Planning Board on April 14, 1986 and recorded at the Barnstable Registry of Deeds in Plan Book4 Sl try 15 plpagean 29. The creating the lots appears to have been based upon the division of land upon which the existing dwelling was located. 6. Under MGL Chapter 40A,Section 6 the new dwelling is a`reconstruction"as that term is used in the "second except"clause of the first sentence of MGL Ch.40A,Section 6. The new dwelling because it is larger does intensify the non-conformity in terms of the level of development on the undersized subject lot. However,the proposed new dwelling would not be substantially more detrimental to the neighborhood than the former dwelling. - The vote was as follows: AYE: Randolph Childs,Ralph Copeland,Jeremy Gilmore,Gail Nightingale NAY: None ABSTANED: Ron S.Jansson Decision: Based on the fmdings of fact,a motion was duly made and seconded to grant the permit for the demolition and reconstruction with expansion of a single-family dwelling on an undersized non-conforming lot,subject to the following conditions: 1. All construction on the site shall comply with all existing setback requirements. 2. The dwelling shall be built in conformance to plans and elevations presented to the Board entitled "Heslinga Residence II"as drawn by Post&Beam of Cape Cod,dated 5-18-04 and consisting of seven sheets and initialed and dated by the Chairman. 4. The dwelling shall be connected to public water and to the Town's Wastewater Treatment Facility. 5. It is a triangular lot of 0.44-acres, \ developed with a one-story,one-bedroom,single family dwelling of 426 sq.ft.of living area. The dwelling dates to 1950 and therefore would predate enactment of zoning in this area of the Town. .. )c) The applicant is proposing to demolish the existing dwelling on the subject lot and reconstruct a new single- family dwelling. According to the application,the proposed new single-family dwelling would have a total of 1,765 sq.ft.of living area,a back deck of 192 sq.ft.and a storage area of 192 sq.ft. The dwelling is to be +��a two-bedroom,one and one-half story structure with a full basement. The applicant had requested a Special Permit to allow for the demolition and reconstruction of a new dwelling on the undersized subject lot. Dining that appeal,the Board noted that the subject lot was created by an Approval Not Required(ANR)plan endorsed by the Planning Board in 1986;and at the time of creation,the subject lot did not meet the requirements of zoning as that area was already zoned Residence G \c' requiring a minimum lot area of 65,000 sq.ft. Procedural&Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on October 13,2004. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened November 03,2004 and continued to November 17,2004,December 1,2004,and December 8,2004,at which time the Board found to grant the appeal. Board Members deciding this appeal were,Ralph Copeland,Jeremy Gilmore,Gail Nightingale,Randolph Childs and Acting Chairman Ron S Janson. At the opening of the public hearing,Attorney Mark H.Boudreau represented the applicant and submitted a Memorandum in support of the application. Mr.Boudreau noted that he had reviewed the Town Attorney's legal opinion on this matter and addressed the Variance criteria noting that the subject lot has six sides and that the use of the structures predated the creation of zoning in this area of the Town. He noted that both buildings were being used as independent residential structures. The Board clarified that the applicant purchased the property in 1977 and then Later purchased additional adjacent land all of which is part of the 1986 ANR plan. The Board noted that an ANR plan in itself does not constitute a buildable lot. Public comment was requested and Cheryl Lombardi of 1650 Hyannis Road and Phil Finnigan of 78 Maushop Avenue spoke in favor of the proposal. The Chairman noted that two letters of support were submitted to the file. The first was from Jeannine and Gerald Madden of Maushop Avenue and a second 1 letter dated September 9,2004 was signed by:Cheryl Lombardi of 1650 Hyannis Road, J.W.Eames of 1606 Hyannis Road,John and Mary Campbell of 14 Maushop Avenue,and Joseph and Marilyn Keohane of 34 Maushop Avenue. f Bk 19500 Pg 306 #7496 The Board discussed the issues of the ANR plan and the creation of three lots. The subject lot contained a dwelling,a second lot contained a dwelling,and the third lot was a vacant developable lot which has since been built upon. The subject lot was undersized. The other two lots conformed to zoning. The Board also noted that the second lot containing a dwelling apparently also contained an apartment. The Board requested additional information with respect to that apartment unit. The appeal was continued to November 17,2004. The Board reviewed the proposed demolition and reconstruction on the property noting that subject lot is and would continued to be accessed directly from Hyannis Road. It was noted that the dwelling had.been occupied as an independent living unit until just recently when it was vacated in anticipation of the demolition and reconstruction. The Old King's Highway Historic Commission had reviewed the plans and issued a Certificate for the Demolition of the existing building and a Certificate of Appropriateness for the construction of the new dwelling. It was noted that there was no public opposition to the proposal. The hearing was continued to December 1,2004 and again to December 08,2004 to permit the Board Members added time to review the issues in the appeal. At the December 08,2004 continuance,the Board members discussed the relief being requested. Acting Chairman Ron Jansson stated that he would abstain from the vote and informed the applicant that four positive votes were needed to grant relief. Mr.Boudreau agreed to continue forward with the appeal. In that hearing,the Board found to grant a Special Permit for the demolition reconstruction. Upon that grant,the Members cited that the issue of the undersized lot and its creation should be resolved. They determined to proceed with the Variance request also to assure that issue would not resurface in the future. Findings of Fact: At the hearing of December 08,2004,the Board made the following findings of fact: 1. Appeal 2004-154 is that of Steven G.Heslinga seeking a Variance to Section 3-1.3(5)Bulk Regulations, Minimum Lot Area,Minimum Lot Width,and Minimum Yard Setback. The applicant is seeking to demolish and reconstruct a single-family dwelling on an undersized subject lot and allow an existing shed to remain non-conforming with respect to yard setbacks.The property is addressed 1631 Hyannis Road,Barnstable,MA located as shown on Assessor's Map 299 as Parcel 001-003. It is in a Residence G Zoning District. 2.' The property has an existing dwelling on it. The dwelling and its use legally predates the enactment of zoning for this area of the Town. The applicant seeks to demolish that structure and rebuild a new structure that would conform to the required setbacks for the zoning district it is in. The existing dwelling has 426 sq.ft. of living area and was built in 1950. 3. The existing lot does not comply with the bulk regulations of the zoning bylaw in that it only consist of .44 acres where one and one-half acres is now required. 4. The applicant is proposing to reconstruct a new single-family dwelling of 1,765 sq.ft.of living area,a back deck of 192 sq.ft.and a storage area of 192 sq.ft. The dwelling is to be a two-bedroom,one and one-half story structure with a full basement. The proposed new dwelling will conform to the required setbacks of the Residence G Zoning District. There is an existing shed on the property that is labeled as "to remain". That shed is located within the required 15 foot rear yard area and does not conform. The Board shall condition this Variance upon the shed conforming as the Board does not intend to include a setback Variance for the property. 5. No specific findings were made with respect to MGL Chapter 40A,Section 10.
