According to the Assessor's records,the building is unoccupied and the utilities were disconnected in 1980. The existing structure is in a dilapidated condition and in need of being removed. Appeal 2003-75 is an application for a finding under MGL Chapter 40A section 6 to permit the demolition of the existing structure and reconstruction of a new dwelling. According to plans presented,the new dwelling is to be a 1.5-story,two-bedroom structure estimated to be 1,900 sq.ft. The dwelling is located in conformance to the required setbacks and outside of the 100-foot jurisdiction of Conservation Commission. A Certificate of Demolition for the existing structure and a Certificate of Appropriateness for the new dwelling �i were issued by the Old King's HighwayHstoric District Commission on May 14,2003. Procedural&Hearing Summary- This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on May08, 2003. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A The hearing was opened June 04,2003,at which time the Board found to grant the special permit. Board Members deciding this appeal were;Ron S.Janson,Gail Nightingale,Richard Boy,Jeremy Gilmore and Chairman Daniel M. Creedon. Mr.Paul Pacella represented the applicants. An April 2,2003 letter from Steven G.Heslinga and Lynn Heslinga authorized him to act on their behalf,a copy of which is contained in the file. For proof of standing,Mr.Pacella submitted a copy of the deed to the property showing that the property has been transferred from Bryce H Cloweryto the applicants. Mr.Patella stated that the applicants wish to demolish the existing dwelling and rebuild a new single family dwelling on the lot. He stated that the existing dwelling is deteriorated and beyond repair. He presented plans for the new dwelling citing that the new stricture will conform to today's setbacks. He noted that the plans for the dwelling have been granted a Certificate of Appropriateness from Old King's HghwayHstoric District Commission. The Public Health Division has signed off on the proposal because town sewer will service the L . ry property. Mr.Pacella stated that the home is located more than 100 feet from wetlands and the Conservation Agent has also signed off and that the proposed redevelopment will not require an Order of Conditions. Concerns were expressed for the two driveways and Mr.Parcella stated that one of the driveways services the neighboring lot and that the use of two driveways would make it so that no one had to back-out into traffic. The Board felt this would be a safer situation. Public comment was requested and no one spoke in favor or in opposition to the request. Findings of Fact: At the hearing of June 04,2003,the Board unanimously made the following findings of fact: 1. Steven and Lynn Heslinga have applied for Special Permit findings under MGL Chapter 40A Section 6 for the demolition and reconstruction of a single-family dwelling on an undersized lot. The property is shown on Assessor's Map 299,Parcel 068 addressed 1638 Hyannis Road,Barnstable,MA in a Residential F-2 Zoning District. 2. The property is a 0.61-acre lot that was originally developed in the 1900's with a one-storytwo-bedroom single-familydwelling of 898 sq.ft.of living area. According to the Assessor's record,the building is unoccupied and the utilities were disconnected in 1980. The existing structure is in a dilapidated condition and in need of being removed. 3. The dwelling is located in conformance to the required setbacks and outside of the 100-foot jurisdiction of Conservation Commission. 4. A Certificate of Demolition for the existing structure and a Certificate of Appropriateness for the new dwelling were issued by the Old King's Highway Historic District Commission on May 14,2003. 5. The proposed new dwelling does not intensify the alleged nonconformity and would not be substantially more detrimental to the neighborhood than the former dwelling. Decision: Based on the findings of fact,a motion was duly made and seconded to grant the permit for the demolition and reconstruction with expansion of a single family dwelling on an undersized non-conforming lot. The reconstruction shall eliminate all structure nonconformities and the new building shall conform to the required setbacks and is subject to the following conditions: 1. The dwelling shall be located and site improved as shown on a plan entitled" Site Plan Showing Proposed Dwelling of# 1638 Hyannis Road in the Town of Barnstable (Village)prepared for Steve& Lynn Heslinga" dated April 02,2003 and drawn by Down Cape Engineering,Inc. 2. The dwelling shall be built substantially in conformance to plans presented to the Board entitled "Heslinga Residence" as drawn by Maine Post&Beam of Cape Cod,and consisting of five sheets. Sheets AB &C showing proposed elevations and Sheets D &E showing proposed floor plans. 3. The principal structure shall be limited in that it shall not exceed that area represented in the above cited plan that is estimated at 1,900 sq.ft of living area. The total number of bedrooms shall not exceed two. 2 4. Demolition and reconstruction shall comply with Health Divisions regulations without variance and shall comply with all building codes. 5. This permit is subject to the issuance of a Certificate of Demolition and a Certificate of Appropriateness from the Old Kings Highway Historic District Commission. Full compliance with those certificates is required. The vote was as follows: AYE: Gail Nightingale,Richard L.Boy,Jeremy Gilmore,Ron S.Janson and Daniel M. Creedon NAY.
