The subject lot is improved with one dwelling, one garage with an apartment above, a detached playroom, (Incorrectly shown as "cottage" on the plan filed with the Petition), and two sheds. The principal dwelling is three-bedrooms, 3,532 gross floor area (1,498 living area)and was constructed between 1930-1940 (The Assessors records show the date of construction was 1786, see"Other Approvals"for details). The second structure is a three-car garage with an apartment unit above, constructed in 1992. The lot is served by public water, gas, and septic. Special Permit No. 1992-04 allowed the owner to demolish the Hurricane damaged portion of the over 100-year old cottage and reconstruct and relocate the one-bedroom non-conforming apartment unit over a to-be-constructed garage in accordance with plans submitted. Procedural & Hearing Summary Special Permit Application No. 2019-037 to relocate an existing nonconforming residential structure and garage to a different location on the same property was filed at the Town Clerk's office and the office of the Zoning Board of Appeals on June 10, 2019. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters and interested parties in accordance with MGL Chapter 40A. The hearing was opened on July 10, 2019 at which time the Board found to grant the Special Permit subject to conditions. Board Members deciding this appeal were Alex Rodolakis, Herbert Bodensiek, David Hirsch, Jacob Dewey and Paul Pinard. . • Attorney Philip Boudreau represented the Heslinga's before the Board. The Applicants and family . members were also present. Alex Rodolakis disclosed that he had been represented by Attorney Boudreau in the past but there are no current legal matters. There were no objections to Mr. Rodolakis hearing and voting on this matter. Attorney Boudreau described the lot and current uses E Town of Barnstable Zoning Board of Appeals-Decision and Notice . Findings of Fact At the hearing on July 10, 2019, the Board unanimously made the following findings of fact in Special Permit Application No. 2019-037, a request to relocate an existing nonconforming residential structure and garage to a different location on the same lot: 1. The application falls within a category specifically excepted in the ordinance for a grant of a special permit. Section 240-92 (B) Nonconforming buildings or structures used as a single- and two-family residences, and 240-94 Nonconforming use allows for alterations. 2. Site Plan Review is not required for single family residential dwellings. 3. After an evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. The vote to accept the findings was: AYE: Alex Rodolakis, Herbert Bodensiek, David Hirsch, Jacob Dewey and Paul Pinard NAY: None Decision Based upon the findings a motion was duly made and seconded to grant the Applicant the relief being sought with the following conditions: 1.
