Box 1630 Hyannis, MA 02601-1630 RE: Supply New England (Barnstable - Independence Park) Commission Project Number— EX05009 Dear Attorney Butler: This letter is being sent to you as the Applicant's contact on the above project, and as a follow-up to.an April 1,2, 2005 meeting between yourself, Attorney Liza Cox of Nutter, McClennen.& Fish and Cape Cod Commission (Commission) staff. concerning preliminary application materials fled by you on behalf of JDJ"Housing Development, LLC'for a Development of Regional Impact Exemption(DRI" Exemption). The project in question, as shown on site plans, involves the' construction of 26,000 square foot building to house a heating/plumbing supply business at 755 Independence Park Drive in.Hyannis, Massachusetts. Under the Commission Act, the Commission is required to complete its review of the project, including.holding a public hearing, within forty-five (45) days of the receipt of a complete DRI Exemption application: No municipal permits may be issued unless the Commission completes its review and issues an approval. As was noted during our meeting, the DRI Exemption application is not complete. At a minimum, to satisfy the basic submissions described in the Enabling Regulations, the application needs a completed Application Cover Sheet, a corrected Abutters List certification, and a USGS quadrangle map of the area containing sufficient information for the Commission to locate the site of the proposed development. k With respect to ownership of the project.site, I understand that the parcel in, question is part of the.Enoch Cobb Trust, and that the project involves:a long term ground lease. The-:Commission's application forms call for submission of a, 2 true copy of a deed or other instrument showing of ownership of the property. However, in cases where the Applicant is not the owner, the owner of record must endorse and acknowledge the application in writing. On a related matter, as you know, the Commission and Town of Barnstable have a Memorandum of Understanding regarding a voluntary scoping session at the local level for projects undergoing Commission review. Please clarify if the Applicant would like to proceed with this voluntary scoping session. Finally, the cover letter you provided with the DRI Exemption application notes it will be filed with the Town of Barnstable. Please note that the Commission will need evidence that the application materials have been filed with the DRI Liaison, Town Clerk, Building Inspector and any Municipal Agency(ies) before which development permits are pending.
