Such signs shall not exceed one square foot in area, nor be more than three feet high. B. No more than four such signs will be allowed per site. Proposal & Hearing.Summary Variance Petition No. 2020-030 was filed at the Town Clerk's office on August 12, 2020 and office of the Zoning Board of Appeals on August 17, 2020. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters and interested parties in accordance with MGL Chapter 40A. The hearing was opened on September 9, 2020, at which time the Board found to grant the Variance subject to conditions. Board members deciding this petition were David Hirsch, Jacob Dewey, Mark Hansen, Todd Walantis, and Herbert Bodensiek. Attorney Andrew Singer presented the Petition before the Board. Also present was Chris Raber, Andrea Ponte and Bert Talerman from Cape Cod 5. Attorney Singer reviewed both Petition No, 2020-029 and No. 2020-030 as they are the same owner and use but separate lots. He described the'area as a campus for the bank involving.a branch on one lot and the headquarters on the other lot. Attorney Singer reviewed the criteria for the grant of a variance and stated both properties are unique in that they are unique in shape and size and have frontages on 2 sides, the hardship is a safety issue for the customers and employees. Signage is important to access the different areas and uses on the lots. The safety and efficiency will be improved with additional signage. Attorney Singer stated there will be no detriment to the public good or derogate from the purpose or intent of the Ordinance. He concluded that it will actually be an improvement. The Board agreed that given the scale of the campus, the additional signage is important for public safety. The Board questioned the future as a variance runs with the land. The Board was concerned that any future use could have the benefit of the additional signage. Elizabeth Jenkins, Page2of4 2 • Bk 33382 Pg156 #57551 Town of Barnstable Planning and Development Department Decision Variance 2020-030—Cape Cod 5 Cents Savings Bank Planning and Development, stated that in the draft conditions, it states the Board is granting a Variance to a specific business or a specific site for a specific signage package. Any modification would require Board approval. The Board Chair requested public comment. Robert Wilson spoke and is in support of the additional signage but questioned any light pollution from the signs. Chris Raber addressed the lighting question and stated the lighting can be controlled. Findings of Fact At the hearing on September 9, 2020, the Board voted and made the following findings of fact in Variance No. 2020-030, a request for additional signage at the Cape Cod Five Cents Savings Bank Branch at 1550 lyannough Rd, Hyannis. .. Owing to circumstances related to soil conditions, shape, or topography of such land or structures and especially affecting such land or structures but not affecting generally the zoning district in which it is located. The Board found that the lot is unique in shape and topography and that the lot has frontage on two sides. 2. A literal enforcement of the provisions of the zoning ordinance would involve substantial hardship, financial or otherwise to the Petitioner. The Board found that the hardship is public safety. 3. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. The Board found the additional signage would improve public safety. The Board voted to accept the findings as follows: AYE: David Hirsch, Jacob Dewey, Mark Hansen,Todd Walantis, and Herbert Bodensiek NAY: None Decision The Board voted to grant the requested Variance to the sign regulations with conditions as follows: 1. Variance No. 2020-030 is granted to The Cape Cod Five Cents Savings Bank at 1550 lyannough Road, Hyannis for one building sign 11.28 square feet, three freestanding signs 34.00 square feet each, and five directional/informational signs not to exceed 10 square feet each. 2. The signs shall be in substantial conformance with the sign specifications by Gensler Dl.3, DI.32, DI.33, and sign specifications by DCL Sheets 12-22. Any substantial changes to the signage authorized by this variance shall require review and approval by the Board. 3. The Applicant is required to obtain sign permits from the Building Division prior to installation. 4. This decision shall be recorded at the Barnstable County Registry of Deeds and copies of the recorded decision shall be submitted to the Zoning Board of Appeals Office and the Building Division prior to issuance of a building permit. The rights authorized by this variance must be exercised within one year, unless extended. Cl- Procedural & Hearing Summary Special Permit Application No. 2018-010 for a Special Permit pursuant to Chapter 240-93 Nonconforming buildings or structures not used as single or two-family dwellings and if necessary, pursuant to Section 240-25 (C) HB District to alter the lot line and parking/driveway configuration was filed at the Town Clerk's office and office of the Zoning Board of Appeals on January 22, 2018. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters and interested parties in accordance with MGL Chapter 40A. The hearing was opened on February 14, 2018, at which time the Board found to grant the Special Permit subject to conditions. Board members deciding on this application were David Hirsch, Herbert Bodensiek, Jacob Dewey and Paul Pinard. The hearing was opened on February 14, 2018 with Attorney Andrew Singer representing the applicant. Also present were Matt Eddy of Baxter Nye Engineering, Chris Raber of Cape Cod Five, and Kurt Raber from Brown Lindquist Fenuccio and Raber Architects. Attorney Singer gave a brief description of the intention of this application and stated the lot will be getting smaller but will still be a conforming lot. He concluded his presentation by describing the importance of this site as it is a gateway to Hyannis and the applicant is committed to create a more attractive, environmentally friendly, and functional corporate headquarters on these adjacent lots. The Board Chair asked for public comment and no testimony was given. Town of Barnstable Zoning Board of Appeals-Decision and Notice Special Permit No. 2018-010 Cape Cod Five Cents Savings Bank Findings of Fact At the hearing on February 14, 2018, the Board unanimously made the following findings of fact in Special Permit Application No. 2018-010, a request to alter the easterly lot line in order to convey a portion of the land to the property located to the east (1520 lyannough Rd) which will result in a change to the parking and driveway configuration and include a vehicular interconnection between the two properties: 1. The application falls within a category specifically excepted in the ordinance for a grant of a special permit. The proposed use is allowed under Section 240-25 with a Conditional Use Special Permit. 2. After an evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. The Board found this proposed altering of the lot line to have no negative impact to the overall project and would improve the visual impact of the parking garage. 3. A Site Plan has been reviewed and found approvable with conditions as evidenced by a letter dated February 7, 2018. 4.
