As you will see the pictures are of the outside of the building and the parking concerns you and I discussed. To my understanding the facts are as follows: 1) Landscaping was to be completed per plan submitted. 2) Parking was limited to fourteen(14) cars as facility is a drop off and pick-up location. 3) All roadwork was to be completed by the Vega's. To date the landscaping has not been completed to plan. I know you continue to work this issue and some progress has been made, but it's been over a year since this work should have been finished. In regards to the parking they continue to use the facility as a place to hold _ recitals, which is in violation of the agreement. I have enclosed pictures of the parking for a summer program put on just last week. This was a modified program and had approximately forty(40) cars parked on the street. This happened on five (5) separate occasions this summer. During the school year they put on major events in December and late May early June that has three times as many vehicles involved. Each time frame has at least five (5) days of programs taking place. This past spring the road was blocked and not passable for emergency vehicles or two-way traffic. They also blocked passage to Maggie Lane an adjacent street that added to the safety issues these events have caused. Add to that they have parked on our property causing damage to the lawn costing us out of pocket expenses to repair. The road to my understanding needs a final coat to be completed and the town is or was holding a bond in regards to this. We have had several conversations with the Vega's in regards to the above and they have assured us the work would be completed. The last conversation being about a year ago from this time frame and to date not much progress has been made. Our latest attempt to speak with the Vega's about the issues was ignored by them completely. I P' . It is for this reason we have come to the town for help.As homeowners we were required to meet certain obligations before we could receive occupancy to ourproperty. We are reasonable people but the time has come for the P p Cape Cod Ballet(Vega's)to do the same. Since we wrote this letter to you expressing our concerns about the Ballet Studio little has changed and in some cases the problems have gotten worse. Outside Maintenance: The upkeep of the grounds and outside building are non- existent. If it were not for Gail and I picking up the debris and mowing and trimming the lawn the facility would be more of an eyesore than it is today. Road Completion: It has been almost three years since the road was to be completed(final coat).Now as a result of it not being finished the town has ceased all upkeep of the street. Vehicle Parking: Cars are still parking on our property,which continues to cause damage to our lawn. There are also more cars parked at the studio than I believe the guidelines call for(14 cars). Street And Yard Litter: The patrons and their parents of the studio have little regard for what it tossed from their vehicles. Fast food containers and soft drink cups are scattered all along the road and lawns. One day both Gail and I observed an individual parked in the Ballet lot change her baby's diaper and discard of it on the lawn. She then proceeded to clean out her vehicle throwing assorted debris in the parking lot. Studio Use: I believe the facility was restricted for the use of ballet only. It is now being used for"Fencing" and I have read they are offering exercising classes now. Before we were allowed to move into our home we were held to strict guidelines by the town. The Cape Cod Ballet should be held to the same standards. Over the past three years they have made several promises to properly maintain this facility. Besides you working with them we had also met with Stephanie Burke and Beth Vega and were given their assurances that all of the open issues would be addressed. To date none of this has happened. The reason for this letter is to try to get an answer why the town decided after two years of plowing our street to stop the service this year. Both my wife and I have made several attempts to contact different town officials to get an answer but our efforts have not been successful. Our first attempt occurred on December 27th the first major snowstorm of the year. Along with the heavy snow we also had a power outage in our area. When the street wasn't plowed my wife called the town highway department asking when the road would be serviced. It was at that time we were informed that the town would no longer service our street. My wife expressed her concerns for our safety and that of our holiday guests. A very rude individual by the name of"Dupree "replied you'll just have to freeze if you can't get out and if I were you I wouldn't pay my taxes. The next course of action was to call the Town Councilman for precinct#11 Henry Farnham. We spoke with him on three different occasions regarding our problem. We asked him why and who would have authorized the plowing to stop. He stated there were some outstanding issues with the Cape Cod Ballet which is located on our street and that might be part of the problem. We asked for his help and intervention in resolving this matter and he said he would make some calls to try to straighten things out. We placed two follow-up calls to Mr. Farnham to see if he had made any progress and for the most part were given the run around without a definite answer as to why this had happened. I then tried to contact Mr. Mark Ells at the Public Works Department. I made three calls in an attempt to speak with him about this issue. The person I spoke to in this department was Brett and each time I called she said the message was given to Mr. Ells and he would be calling me back. To date there has been no reply. My questions and concerns are as follows. Why and who authorized the plowing of John Maid Rd. to cease? Is it normal practice for town officials and it's employees to ignore question from its residents and treat them with a lack of respect. { My family has been put in harms way regarding our safety and well being without any notice from the town of the actions being taken. It has also put a monetary burden on us to keep the road passable. If the town's dispute with the Cape Cod Ballet was the cause this matter we should not have had to suffer the retribution.
