Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q, • Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by several towns. You may care t amend and adopt such a form/certification for use in your community. As you are aware, the Old Kings Highway Committee is an elected Committee specifically elected by the residents in the district, and this Committee sets forth in accordance with the Acts of 1973, Chapter 470, as amended. This is a regulatory Committee of the Town and as such has the authority to act on appropriateness within the district. On or before February 19, 1998, the Old King's Highway Historic District sent a letter to you regarding the appropriateness of the color of your mailbox and since no action was taken by you, your neighbors legal counsel sought a solution through the enforcement officer of the Town.When issues as these are brought before the Building Commissioner, as a result of a regulatory Board, it is the position of the Town to enforce all and such decisions, however, you have the right of appeal to the courts. In closing, Ms. Santos, the problem is with you and the members of the District, so therefore, I suggest that you take up your complaints with the members of the Old King's Highway Committee. Since your letter to me dated March 17,1998, indicated to me that your office was taking direct action on my mailbox, I feel it is only appropriate for you to follow through on this issue. Your action has opened the door for new interpretations of a very GRAY area in the OLD KING 'S HIGHWAY DISTRICT ACT. I have requested a meeting with you, Mr. Al Martin, and the OKH committee to discuss this issue and I find it extremely offensive that you have turned down my request on two seperate occasions. The latest one being today when you had your secretary call me and ask me to REDUCE my comments to writing. Even though I feel it should be my right to be able to speak with a town commissioner face to face as a taxpayer, and a citizen who has been singled out by this town, I am once again complying with your request and am putting my thoughts and questions to you in writing. * As I stated to you on March 24, 1998 I feel that the actions you took by writing your March 17, 1998 letter have singled me out for no apparent reason. There are many mailboxes in the OKH district that are various shapes, sizes, colors, and themes, and , since those residents haven't recieved the same letter from you, I have indeed been singled out and this action has violated my civil rights. My property isn't even on a main road in the OKH district. I want to know in writing,how and why this happened? I would also appreciate a written apology. Your fine of $100 a day seems a bit steep for such a minor issue. * I was also deeply offended by the action of your secretaries flicking the lights on and off and clapping their hands saying • it 's time to leave, promptly at 4: 30 pm, right in the middle of our conversation. HOW RUDE! In my profession I deal with the public frequently, and they would be appalled if I treated them with such disrespect and insignificance. * What was the result of your visit to see the fence placed in view of a public way on Kehtean Drive after our March conversation? * The "setting" has been changed once again. This time by the other party involved. The display includes hot orange, yellow, and bright red PLASTIC flowers, attached to a mailbox. Since these flowers are part of a setting and not listed as an exempt item, they should also be subject to review. I would like your office, since it has been so interested in the past, to enforce the SAME action to this violation. * An enormous pile of brush and rubbish bags displayed in the "setting" need to be removed as they pose a fire hazard and leave the "setting" inappropriate and unattractive. How will these violations be addressed?? * The discussion that I wanted to have with you and the OKH directly related to making sure that your office and the OKH would not be regulating my mailbox or any other citizens mailbox in the future. I would appreciate a direct response as to how your office, and the OKH will stand on this issue in the future? * Finally I would like you to investigate the inappropriate actions and involvement in my mailbox issue, and other matters around Barnstable Village involving Trish Savage an OKH committee member. Her request to tie together my mailbox with the hearing on my sunroom addition still puzzles and upsets me. Ms. Savages ' persistence at the OKH meeting on March 18, 1998 at the very least seemed peculiar, thank goodness her comments were ruled out of order by the chairman. It is my understanding that you believe there may be a zoning issue raised by this application for a building permit and this letter is written to address that concern. I would like to call your attention to the fact that the Santos application is for a lot that was duly created by the Planning Board on 10/18/89. A copy of said plan is attached for your reference. I see no reason why a building permit can not be issued for this lot as the Planning Board has determined that at the time of its creation it is a legal lot having the required square footage and frontage. Any issue relative to the zoning status of lots 1, 2 and 3 have been addressed by the Board of Appeals in a variance recorded at the Barnstable County Registry of Deeds in Book 9146, Page 187, a copy of which is also attached hereto. If it is not your intention to issue a building permit on this parcel, would you please so advise as to the reasons in writing so that I might discuss the matter with Mr. Santos and determine his remedy, if any. Joseph and Mary Dugas . through Attorney Richard Currey , petitioned the Board for a Variance from Section 3- 1 . 3 ( 5 ) . Bulk regulations of the Zoning Bylaw to allow three ( 3 ) separate non-conforming lots . The petitioners ' property is located at 1527 Hyannis Road . Barnstable and is shown on Assessors ' Map 298 as lot 8 . it is in the Residence G Zoning District . An Aoprovai Not Required Plan prepared by Cummaauid Survey . Inc . , dated Septemoer 18 . 1989 was submitted to the Board . This plan snows the present parcel divided into four ( 4 ) lots . Lots 1 . 2 , and 3 nave structures on them . Lot 4 contains 8 . 154 acres and is considered "back" land . The ANR Plan was endorsed by the Planning Board on October 18 , 1989 . Attorney Curley suggested that the petitioners are entitled to relief under Section 81L of iv1GL Chapter 41 . ! t was stated that the petitioners ' ownership of the property dates back to 1941 . The three ( 3 ) separate dwellings located on the property were all built prior to 1950 and tnerefore prior to the adoption of the Subdivision Control Law in Town . Ail three ( 3 ) dwellings are independent residences . Mr . Edward Kelley , Registered Land Surveyor , stated that the dwellings on lots 1 and 2 of the submitted Plan are served by the Town Sewer and the dwelling on lot 3 has its own septic system . A letter from the Barnstable Fire Department was submitted to the file . The letter expressed concern over access to lot 4 if that lot should ever be developed . The Fire Department would like to see access from the two roads to the north . Dorcas Drive and Kehtean Drive , as well as turn grounds at the end of each of these roads . Mr . Ed Kelley . FINDINGS OF FACT: • Based on the information presented , the • Zoning Board of Appeals made the following findings of fact : The structures shown• • on lots 1 , 2 and 3 of the submitted• Plan were erected during the 1940s and therefore predate the adoption of the Subdivision Control Law in the Town ; 2 . in view of the fact that the petitioners have an ANR Plan which was endorsed by the Planning Board and in view of the fact that the structures on the site predate zoning , a hardship would be created if the Board were not to grant the relief requested : 3 . The lot is unique due to the location of the three ( 3 ) structures within close proximity to each other ; and 4 . in view of the fact that the structures on the three lots already exist and in view .of the fact that two ( 2 ) of tne structures are connected to the Town Sewer , the .:: rant of this Variance would not be in derogation o : ne spirit and intent of the Zoning Bylaw.
