Dear Mr. Chesley, In your latest e-mail regarding drainage at the above referenced addresses,you write that, 'My fear is no action will be taken (sic) building department." Nothing could be further from the truth.Action was taken when you wrote your letters of December,2016 and January,2017.Action was taken based upon your e-mails of April 5, May 19, May 30, and June 9 and your many phone calls to this office.Action was taken during the meeting and phone calls with Mark Lapoint,the state inspector to whom you complained on numerous occasions.Action was taken by the inspectors(myself,Jeff Lauzon, and Bob McKechnie)who made dozens of site visits. Lastly,action was taken in the numerous e-mail exchanges between this office and the pool installers/landscapers to make sure that work being done complied with approved plans. There is no need of further action to be taken by this office. In 2007 a site survey shows the natural topography of your common boundary at 14', 15', 16';a survey dated June 1,2017 shows the natural topography of this same area at 14', 15' 16'.These surveys show no change in topography,therefore 780 CMR section R401.3 does not apply because no construction caused the slope that exists between both properties.There is a natural pitch down to the boundary line from each yard. Lastly, no further action need be taken because the landscaping, including water absorbing trees and mulch planted at the common boundary, has water diversion/drainage to the rain garden from both the pool patio and the area between the pool wall and the newly planted tree line.The rain garden is on the opposite side of the yard at 22. The plans waiting for review(dated Feb. 16,2017)are specifically the pool plans.As you have noted,those plans do not address the drainage problems associated with the "sump pump overflow grate". There will be more grading and plantings that are not shown on that plan. When I start the review process I will require more information about the sump pump drainage issue. Also, a plan for the drainage of the hardscape around the pool area is not required by the Residential Building Code. It is treated like any hardscape on a site development plan (i.e.: a driveway,a patio,a parking area,or a walkway)which is not regulated by the Residential Building Code. Incidentally, if such a plan was required then you would have had to submit a plan and obtain approval for the drainage located on your property along the property line in the same area. 2.) You are correct in stating that the setbacks for all structures is 15' from the side yard property line. However, a patio is not considered a structure..A retaining wall,such as the one shown on the plan, is regarded much like a fence. Historically, retaining walls have been allowed up to the property line. Also, many walls in the historic district define the property lines. I understand your concern however I feel that discussion before the review is started is premature. I won't be able to discuss issues that have not been addressed or considered by the parties proposing the work. I will suggest that those parties discuss with the property owner all issues or concerns that you have. It seems that the communication between you and anyone hired by the property owner be addressed with the property owner or their agent I will be in touch when I have more knowledge of the plan.
