On this 9,950 sq. ft. parcel, exists at the present time, three structures. The corner cottage , it 72 Locust . Lane, was built as a dwelling place about 1935 , by the then owner. It has been used as a dwelling since construction. 2. The middle . cottage, l 74 Locust Lane, was built about 1925. Since my purchase of the property in 1963 , my family has used it exclusively as a dwelling. The building was improved from time to time . The plumbing was installed about January , 1964, by Albert Smith & Son, Reg. i13619, of Yarmouth Port , Massachusetts. The third building as shown on the plan, or the garage is used by the Turners and will not be rented. There are three buildings on the lot. The petitioner would like to demolish Locust Lodge and in its place, construct a year-round home. Elderly Mrs. McFarland, whose family once owned this property, gave a short summary of its historical background and said she would be pleased to have the Turners as neighbors since they planned to retire at Locust Lane, and they should be allowed to upgrade this property. The Turners' purchased the property in 1964. Mrs. George Raymond and Mr. Gerald Lyons spoke in favor of the petition. Those speaking in opposition to the project were: Fred Grosmith, Thomas VanBuren who said only one house should be allowed and Barbara Angs felt allowing the petition would be over- crowding the land. Robert Stewart said that three houses are using the same septic system and felt this should be looked into. The Board took the matter under advisement. Appeal 1978-51 Christine A. Roper The petitioner was represented by Jack Renzi who said they were asking for a variance from front setback requirements. Due to an error in pouring the foundation at Sail-A- Way in Centerville the foundation is 28.5 ft and 29.5 ft. from the front property line rather than the required 30 ft. for an RD-1 zoned district in which this property is located. No one spoke in favor of or in objection to the petition and the Board took the matter under advisement. • i - Cj0.4. UARD OF APPE S�M. S Minutes - Public Hearings - August 2, 1978 Appeal 1978-49 Christy's Market, Inc. Atty. Richard C. Anderson presented the petitioner and said the locus in question has a non-conforming status and they would like to change this. use to one not more detriment- al to the neighborhood. , The change would be from a gas station to a market and the sale of gasoline as one of the items to be sold. This property is in a residence B-1 zoned district. This market would be Christy's and they own and operate thirty convenience stores in southeastern Massachusetts. There is a Christy's on route 28 and Bearse's Way. There will be very little in the way of exterior change to the present structure since it is a substantial and attractive brick building and there will be no increase in the size of the building. The interior will be entirely renovated. Atty. Anderson submitted a floor plan of the interior of the building. The two existing gas pump islands will be removed and a single raised pump island will be constructed. Anti- freeze and motor oil will be sold but there will be no repair work done on the premises. Since this will not be a full service station, Section G. , subparagraph B. will be full complied with. The property is bounded by three heavily travelled streets with many varied business uses and therefore the proposed use would not be detrimental to the area. The hours of operation would be from 7:00 a.m. to 12:00 p.m. The parking area in the rear of the building is owned by the Telephone Company. Buford Goins asked who would pump the gas and Atty. Anderson said this would be done by a full time employee of Christy's Market. Only one other Christy's store has the arrangement of a market and a gas pump. Richard Scudder spoke in favor of the petition and said the proposed use would improve the appearance of the gas station as it now exists in an unsightly manner. Helen Wirtanen said this would be convenient for the neighborhood. Mrs. Wirtanen asked about egress and ingress to the market, outside lighting, ringing signal when someone wanted gas. Mr. Anderson said that ingress would be from Ocean St. and ingress and egress onto Old Colony and that there would be no disruption to the traffic pattern. The new lighting would be subdued compared to what exists there now. Mr. David Hasckel spoke in objection to the granting of the petition and said he does not want a grocery store in his neighborhood. Mr. Hasckel lives on Ocean Street and said he keeps his property in good repair and that it is a credit to the neighborhood. Mr. Hasckel felt that the market would be back for a beer and wine license and that eventually there would be beer cans and litter and that allowing the market would make the traffic which is already a problem,even worse. Mr. Hasckel said the grocery store is not needed since Charlies is within walking distance of this property and Charlies is a full grocery store, and is open evenings. Mrs. Strayer asked how many signs would be on the property and Mr. Anderson said there would be a sign on the building and one - other sign on the property. The 7:00 a.m. to 12:00 p.m. opening will be year-round. In rebuttal to the objections Mr. Anderson said the village of Hyannis had changed and Christy's should not be penalized for the growth in the village. Traffic will not be affected by Christy's. There is no intention of asking for a beer and wine license. The Board took the matter under advisement. Appeal 1978-50 John L. Turner • Mr. John Wolfe presented the petition for Mr. Turner who was in California.
