The current exemption for"homeowners"w*a`s extended to include owner-. cupied dwellings of six units or less and to allow
homeowners to engage an individual for hire v�ho does not possess a lice'.e,provided that the owner acts as supervisor.

Person(s)who owns a parcel of land on which he/she resides or intends o reside,on which there is,or is intended to be,a one or two-
family dwelling,attached or detached structures a,cessory to such use :8 d/or farm structures.'A person who constructs more than one
home in a two-year period shall not be considered homeowner. Su ., "homeowner"shall submit to the Building Official on a form
acceptable to the Building Official,that he/she shall a responsible it all such work performed under the building permit. (Section
109.1.1)

HOMEOWNER'S EXE ff'TION
The Code states that: "Any homeown6 performing work for • hich a building permit is required shall be exempt
from the provisions of this section(Section 109 .1-Licensing of constru tion Supervisors); provided that if the homeowner
engages a person(s)for hire to do such work, at such Homeowner shall : t as supervisor."
Many homeowners who use this exe ii ption are unaware that they ar. assuming the responsibilities of a supervisor
(see Appendix Q,Rules &Regulations for L' ensing Construction Supervisors, ection 2.15) This lack of awareness often
results in serious problems,particularly wh i the homeowner hires unlicensed p- sons. In this case,our Board cannot
proceed against the unlicensed person as it • ould with a licensed Supervisor. The i I meowner acting as Supervisor is
ultimately responsible.
To ensure that the homeowner is fully aware of his/her responsibilities,many c: is munities require,as part of the
permit application,that the homeowner certUy that he/she understands the responsibiliti:, of a Supervisor. On the last page
of this issue is a form currently used by several towns. You may care t amend and adopt s h a form/certification for use in
your community.

Hello, my name is Deacon Crocker. I'm writing on behalf of the estate of the
"Deacon William Crocker House." Some land just east of ours has recently been sold by
the children of the late Peter Toennies formerly of 2150.Main Street Barnstable(west)-to
a party unknown to me. It appears that the only way to access the property would be from
Pilots Way which we own and have the deed to. If any matter comes up pertaining to
rights to use our road the estate requests that we are notified so that we can be heard and
or attend any meetings on the matter. You can contact me directly by phone or e-mail
