Whitney Dear Ms. Coffey: Please be advised that I represent Patricia A. Whitney (hereinafter"Whitney") regarding the Residential Lease that you had her sign, on or about June 1, 2013, for the premises situated at 2187 Main Street, West Barnstable, Barnstable County, Massachusetts. This is a written demand for relief pursuant to the Attorney General's Regulations and the Massachusetts General Laws for the return of the first month's rent in the amount of one thousand seventy-five ($1,075.00) do11_azs AND the security deposit of one thousand five hundred ($1,500.00) dollars. The Residential Lease (hereinafter "Lease")that you presented to Ms. Whitney included numerous prohibited lease terms and statutory violations that require you return said monies. Any Lease agreement that includes a penalty provision for paying rent late, unless the late payment is in excess of thirty (30) days after the due date, is an unfair and deceptive practice pursuant to the Massachusetts Attorney General's regulations, see 940 C.M.R. § 3.17 and also a violation of M.G.L. c. 186, § 15B(1)(c). Your Lease clearly states that the rent is due the first (1 S)'day of the month(Lease paragraph 2) and that a late payment of$150.00 is charged if the rent is paid after the third (P) day of the month in which it is due (paragraph 24—hand written term 3).. Under the Massachusetts Consumer Protection Act, an illegal clause can subject the landlord to penalties under G.L. c. 93A, up to and including attorney's fees and treble damages. Mary Coffey July 9, 2013 Page 2 of 2 Furthermore, you violated multiple provisions of the security deposit statute. General Laws chapter 186, § 15B(1)(b)(iii) states that a security deposit can only be requested in an amount equal to the first month's rent, and only held.in the manner provided by statute with the tenant given a statement of conditions. First, the rent is only one thousand seventy-five ($1,075.00) dollars yet you illegally required a security deposit of one thousand five ($1,500.00) dollars. Secondly, you failed to provide Ms. Whitney the proper receipts for the security deposit at the time of receiving the security deposit and after the money was deposited. Additionally, you failed to provide Ms. Whitney with the statement of conditions required in the statute within ten (10) days of the commencement of the tenancy. Additionally, your handwritten provision in paragraph twenty-four(24) of the Lease that"[t]here is no return of 1500 dollar deposit if one year lease in terminated before June 1, 2014" is a clear violation of G.L. c. 186, § 15B(4). Under Massachusetts law,the security deposit is considered the tenant's money and can only be used to pay or re-imburse specific expenses. The security deposit cannot be used to punish a tenant for early termination of a lease. In Massachusetts, the tenant is entitled to the return of the security deposit to treble damages and attorney fees on Landlords who fail to comply with even one of the part of the law. Demand is hereby made upon you for a full return of the rent and security deposit. If you fail to do so with ten (10) days, my client will file suit to collect the first month's rent and security deposit, plus attorney's fees, costs, treble damages and interest. Time is of the essence. Please contact me upon receipt of this letter to advise as to how you wish to proceed. PETER A. LLOYD PAL/dh cc: Patricia A. Not only was she renting to too many people , she had a hallway blocked off at the bottom of the stairs with no window and a baby sleeping there. She also had an illegal apartment in the main house that she lives in when she rents out her primary residence for the Summer. If someone checked the street file they would have seen that this woman has been a repeat offender for over 15 years!!! Her own attorney the late John Alger states in a letter dated June 26, 1996, " I think the time has come for you to give up playing games and remove all of the stoves and all of the microwaves, except the kitchen, and do not try to put them back thereafter ." In March 1996 a building permit was applied for to restore this property to a single family home. Somehow there evolved 4 units and someone here gave her permission to have an Amnesty unit. Robin was with me and saw the violations. Once again I request that her Amnesty Certificate to be rescinded. This file is in my"follow up" pile. I would like it resolved. 1 Amnesty Apartments Last Name COFFEY First Name MARY LOUISE 2nd Owner 2nd Owner Last Name First Name Map Parcel 237038 Property No 2187 Property Street MAIN STREET Village BARNSTABLE State FA Zip 02630 Status Certificate of Compliance Action Required Monitor Assessors Use Group Two Family. Town of Barnstable Zoning Board of Appeals Comprehensive Permit Decision and Notice Appeal 2007-052—,Coffey Decision - Chapter 40B Comprehensive Permit Applicant: Mary Louise Coffey, Trustee of the Mary Louise Coffey 1994 Revocable Trust Property Address: 2187 Main Street,Barnstable,MA Assessor's Map/Parcel: Map 237,Parcel 038 Zoning: Residential F Zoning District Applicants: The applicant is Mary Louise Coffey, who resides at 2187 Main Street,Barnstable,MA. Ms. Coffey was granted title to the property by deed recorded in the Barnstable County Registry of Deeds on January 24, 2002 as recorded in Book 14738,Page 161. Relief Requested: The applicant has applied for a Comprehensive Permit under Chapter 40B of the General Laws of the Commonwealth of Massachusetts, and in accordance with Article I1 of Chapter Nine of the Code of the town of Barnstable, more commonly termed the"Accessory Affordable Apartment Program." The zoning relief necessary for this Comprehensive Permit to be issued is that of a variance to Section 9- 14 of the Code—Amnesty Program to permit an accessory apartment unit within a multi-family owner- occupied residential dwelling. The issuance of this Comprehensive Permit would allow for an accessory affordable apartment unit in the lower level of the principal residence. Locus and Background: The property at issue is a 1.97-acre lot located at 2187 Main Street in Barnstable. The lot was developed in 1950 with a colonial style home. The effective living area of the main residence is 3,539 square feet. The accessory apartment is a one-bedroom unit located in the lower level of the principal residence. The square footage of the rental area is approximately 600 square feet. The lot is served by public water and on-site septic, and is located within an Aquifer Protection Overlay District. The Town of Barnstable's Public Health Division reviewed the application, and on April 23, 2007, approved a total of five (5)bedrooms at the property, provided the existing septic system is upgraded. Procedural Summary: A site approval letter was issued for the property by Town Manager John Klimm on April 27, 2007, in accordance with MGL Chapter 40B and 760 CMR. Notice of the site approval letter was sent to the Department of Housing and Community Development in accordance with the requirements of CMR 760. An application for a Comprehensive Permit was then filed at the Town Clerk's Office and the Offic_- of the Zoning Board of Appeals. A public hearing before the Zoning Board of Appeals Hearing Officer was duly advertised in the Barnstable Patriot on June 15, 2007 and June 22, 2007, and notices were sent to all abutters in accordance with MGL Chapter 40B. On July 11, 2007 Hearing Officer Gail Nightingale presided over the public hearing. The applicant, Mary Coffey, was present at the hearing. Madeline Taylor of the Growth Management Department was also present. Ms. Nightingale reviewed the file with the applicant to assure compliance with all of the program requirements. Findings of Fact on the Comprehensive Permit: At the hearing on July 11, 2007 the Hearing Officer made the following findings of fact: 1. The applicant is Mary Coffey who resides at 2187 Main Street, Barnstable,MA. She is requesting a Comprehensive Permit to convert an existing unpermitted one-bedroom unit in the lower level of the principal residence into an accessory affordable apartment. The conversion of the unit to an accessory affordable unit within a multi-family owner-occupied residential dwelling qualifies for the "Accessory Affordable Apartment Program." 2. Ms. Coffey was granted title to the property by deed recorded in the Barnstable Registry of Deeds on January 24, 2002 as recorded in Book 14738, Page 161. 3. On April 27, 2007 a site approval letter was issued for the property by Town Manager John Klimm, in accordance with MGL Chapter 40B and 760 CMR.Notice of the site approval letter was sent to the Department of Housing and Community Development, in accordance with the requirements of CMR 760, and no issues were communicated from the Department on this particular application. 4. The proposed accessory affordable unit is approximately 600 square feet, and is located in the basement of the principal dwelling. 5. The applicant is aware that the unit must meet all applicable building codes to be occupied and that the Building Division and Fire Department will also be inspecting the unit for compliance with all applicable building and fire codes. 6. The house is served by public water and private on-site septic and is in an identified Aquifer Protection Overlay District. The proposal has been reviewed by Thomas McKean,Health Director, and he has approved a total of five (5)bedrooms at the property, provided the existing septic system is upgraded. 7. On February 12, 2007 the applicant signed an Accessory Affordable Apartment Program Agreement Affidavit that commits, upon the receipt of a Comprehensive Permit,to the recording of a Regulatory Agreement and Declaration of Restrictive Covenants at the Barnstable Registry of Deeds. That document will restrict the unit in perpetuity as an affordable rental unit and requires that the dwelling be owner-occupied as her principal residence. 8. The applicant understands that the affordable unit will be rented to a person or family whose income is 80% or less of the Area Median Income (AMI) of the Barnstable Metropolitan Statistical Area (MSA) and further agrees that rent(including utilities) shall not exceed 30% of the monthly household income of a household earning 80%of the median income, adjusted by household size. In the event that utilities are separately metered, the utility allowance established by the town of Barnstable shall be deducted from rent level so calculated. 9. According to the Massachusetts Department of Housing and Community Development, as of July 11, 2007, 6.63% of the town's year round housing stock qualifies as affordable housing units. The town has not reached the statutory minimum of affordable housing under MGL Chapter 40B Section 20-23 or its implementing regulations. The Town of Barnstable's Local Comprehensive Plan encourages the use of existing housing to create affordable units and the dispersal of these units throughout the town. 2 r Finding Summary: Based upon the findings, the Hearing Officer ruled that the applicant has standing to apply for a Comprehensive Permit under MGL Chapter 40B and the Town of Barnstable's Accessory Apartment Program. The proposal is also deemed consistent with local needs because it adequately promotes the objective of providing affordable housing for the town of Barnstable without jeopardizing the health and safety of the occupants provided all conditions of the Comprehensive Permit are strictly followed. Ruling and Conditions: Based upon the findings, a ruling was made to grant the Comprehensive Permit in accordance with MGL Chapter 40B to the applicant, Mary Coffey. It is issued to allow for a one-bedroom accessory affordable apartment unit in accordance with the following conditions: 1. Occupancy of the affordable unit shall not exceed two (2)persons. 2. The total number of bedrooms on the property with the existing on site septic system shall not exceed five (5). 3. This unit shall not be occupied by a family member of the owner(s). 4. All parking for the accessory apartment and the main dwelling shall be on-site. 5. To meet the requirements of affordability, the cost of housing (including utilities) shall not exceed 30%of 80% of the median income for a single individual for the Barnstable MSA. In the event that utilities are separately metered, the utility allowance established by the town of Barnstable shall be deducted from rent level so calculated. 6. All leases shall have a minimum term of one year. 7. The Growth Management Department shall serve as the monitoring agent for the accessory apartment. 8. The applicant must apply for a building permit for the accessory unit, whether the unit is new or pre-existing. Before securing an occupancy permit and certificate of compliance, the Building_ Commissioner must determine that the unit conforms with the approved plans as submitted with the building permit application and meets state building and fire codes. The Health Division must determine that the dwelling is in compliance with applicable on-site wastewater discharge requirements. 9. The applicant may select her own tenant provided the tenant meets the requirements of the program as cited above and provided that person's income is reviewed and approved by the Growth Management Department of the town of Barnstable as a qualified individual. The applicant will be required to work with the town to provide information necessary to document that the tenant qualifies. The unit shall be rented on an open and fair basis to an income eligible individual or family. Whenever a vacancy occurs, notice must be given to the Growth Management Department and the unit must be listed with the Town. 10. Every twelve months the applicant shall review the income eligibility of the individual occupying the unit. No later than a year from the date of issuance of this Comprehensive Permit, the applicant shall file with the Growth Management Department of the town of Barnstable an annual affidavit 3 listing the rent charged and income level of the occupant of the unit. The applicant shall provide the town any additional information it deems necessary to verify the information provided in the affidavit. Upon any report from the town that the terms and conditions of this permit are not being upheld, the Zoning Board of Appeals or it's Hearing Officer shall have the ability to hold a hearing to show cause as to why this permit should not be revoked. 11. This Comprehensive Permit shall not be transferable to any other person or entity without the prior approval of the Hearing Officer or Zoning Board of Appeals. This decision, the Regulatory Agreement and Declaration of Restrictive Covenants and all other necessary documents shall be filed at the Barnstable County Registry of Deeds. If the ownership of the property is transferred, the Growth Management Department of the town of Barnstable shall be notified within 60 days of the name and address of the new owner. 12. This Comprehensive Permit must be exercised and the unit occupied within 12 months of its issuance or it-shall expire. Ordered: Comprehensive Permit 2007-052 has been granted with conditions. A written copy of this decision shall be forwarded to the Zoning Board of Appeal as required by the Town of Barnstable Administrative Code Chapter 241, section 11. If after fourteen(14) days from that transmittal the Members of the Zoning Board of Appeals takes no action to reverse the decision, this decision shall become final and a copy shall be the filed in the office of the Town Clerk. Appeals of the final decision, if any, shall be made to the Barnstable Superior Court pursuant to MGL Chapter 40A, Section 17,within twenty(20) days after the date of the filing of this decision in the office of the Town Clerk. The applicant has the right to appeal this decision as outlined in MGL Chapter 40B, Section 22. In accordance with Chapter 241, section 11 of the Town of Barnstable Administrative Code, the hearing officer transmitted a written copy of the Comprehensive Permit decision to the Zoning Board of Appeals on July 11,2007. In the meantime, the cottage must not be occupied. If you are not willing to comply with that requirement then, in my opinion, he will not allow the cottage to be occupied and you will not be able to obtain a variance. Should you try to overrule the building inspector, the other violations will be brought up. I think the time has come to give up playing games, remove all of the stoves and all of the microwaves, except the kitchen, and do not try to put them back thereafter. If you are willing to live with the conditions I have outlined above, I would strongly suggest that you go to the building inspector's office and, in conjunction`with him, prepare the application for the building permit and get directly froa.► i31.,.i,i.V1'hut nli3St be done 1^. o:uEC tG Vent the cottage separately. We have been abuttors to the Coffey property since our ownership of the old Niskala property starting in 1966 . At that time Mr. and Mrs . Coffey, parents of the present owner, Mary Coffey, had subject apartment in use. We, Amy C. Knott and Wm. Daniel Knott of 2211 Main St. abuttors to the subject property have no objection to the on-going use of the garage apartment as a rental unit. Respectfully, Vm. 'e not and Amy C. Knott June 21 , 1996 Ms . Mary Coffey 2187 Main Street Barnstable, MA 02668 Dear Mary, It was a pleasure speaking with you today. Many memories about your home, one that has been part of both our lives , were rekindled. I know that the home was constructed by Frank Wirtanen, but I cannot state, with any certainty, in what year. It certainly was after the end of World War II , since Mr. Wirtanen did not begin building homes until he returned from his tour of duty in the service. I believe that my parents , Russell and Joyce Sturgis , bought the home from Mr. Wirtanen, who, to the best of my knowldge, was the only previous owner and occupant . At the time of purchase by my parents the apartment over the garage was in place and, indeed, as a producer of rental income, was a factor in their decision to purchase the home. Mr. Wirtanen had a steady summer rental in the person of a catholic priest , Msgr. John Butler, archdiocese of St . . Louis , MO, and asked that my parents continue to rent to him. This they did for the month of August each year until my father died in May, 1953. While there were many summer rentals for one and two week periods , I do not recall whether my mother kept a ledger as documentation. If so, I do not know of its whereabouts . There was nothing in her personal effects at the time of her death that would lead me to believe that she did. The only tenant that lived in the apartment for an extended period ( including the winter) , was Weston Elliot , who, I believe , lives now in Maine. I may be able to track him down if you feel it is necessary to obtain his verification of tenancy. Please let me know if I can be of additional help. I wish to confirm our conversation in which you inform me that it is correct for Mr. Bernie O 'Reilly to remove the one electric and ,one gas meter for the cottage above the garage and have everything run off only one electric meter and one gas meter for the entire property in order for the place to be in compliance with a si4gle family residence. It was also told me that in order to be in compliance with the law I -need to remove the stove which is located downstairs in -the: house..,, You also stated-I must remove the chef '.-.s unit upstairs and- open the doorway between the "new additiort' built in the 601s. ' You also suggest that I add the egress to the cottage before taking a request to be able to use it as a rental to the Board,-.'. of Appeals. I believe you would agree that I would need to have a ceiling built in the garage and remove the hot water heater as .well? . I am referring here to the hot water heater in the garage. Bernie O 'Reilly will begin to make the meter changes at once. He will then remove the stove and chef 's,_unit for me. I will get someone to open the doorway between the 1960 ' s addition and the old home. I would very much appreciate a response to this letter so that I am sure we are in agreement, as I would like to clear this up and :be in agreement with your office and the law as it applies today,. Please be advised that since writing you on 2/9/96, my tenant Mary McHugh, has agreed to live in my home and will move from the cottage next weekend. You will note in my letter dated 1/30/96 to you that all of the tenants have moved and I am now. permitting Mary- McHugh to move into the home until things are brought to the 'Board=' of Appeals for its examination; and an appeal to be allowed to continue its use as rental property, as it was before I purchased it in June of 1994. Mary McHugh called you today to let you know she would move into my single-family home from the cottage which has been cited as "an illegal dwelling. " She states you as saying, "you cannot live in the house because Mary Coffey is not allowed to rent the property--except to a blood relative who would need to sign an affidavit. " I find this statement as well as the general harrassment of rr.y tenant by you as offensive and defaming my character and integrity to do the right thing. I would request that you act in accordance with your duty as an Enforcement Officer for the town of Barnstable and work in cooperation with those of us who -have received some kind of citation and who are trying to be in compliance with the law. Your letter of 1/18/96 states ,,- the reason for this order is that a recent inspection has revealed the fact that .you are illegally using the building as a four-unit dwelling, where only single family units are allowed. Rui Miranda, who was living in the space downstairs, has also moved to Fall River, MA. There are no roomers or tenants renting the property. My intention is to complete a 30-year teaching career in Cali- fornia and return to the.. Cape and live at 2187 Main Street. My plan is to teach for two more years and return to the Cape first to do a counseling internship somewhere on the Cape, obtain my license, work for the. schools and/or agency and operate a small inexpensive practice out of my home.
