Cotton, Jr. et al, recorded in Plan Book 556, Page 52 on April 28, 2000, the property was located in an RF Zone requiring 150 feet of frontage and a minimum area of 43 , 560 square feet . There is noted on the enclosed plan reference to Barnstable Board of Appeals Case No. 1999-135, copy enclosed, by which the Board of Appeals granted a variance from the lot frontage requirement to allow the creation of two buildable lots, each of which would have less than the minimum required frontage of 150 feet . The two lots are shown as Lots 1 and 2 on the enclosed plan. Also enclosed is a copy of the restriction document by which Robert T. Cotton, Jr. et al, the creators of the plan, restricted their remaining land in accordance with the requirements of the Variance Decision Authority, which said land is shown as "unbuildable" lying on the north side of the former railroad property, all as shown on the enclosed plan. The relief granted under the variance decision was duly exercised within the required year period by the recording of the variance, the recording of the division plan and the conveyance of Lot 1 as shown on said plan to a third party, copy of said deed is enclosed herewith. • In my opinion the lot meets the current area requirements, has the benefit of a variance for the frontage requirement and, assuming that a single family residence is located so as not to encroach into the sideline buffers, a single family residence may be built on said lot and used as such.
