Background Information:
Anne Barrett, Trustee, has petitioned the Zoning Board of Appeals for a Variance to Section 3-1.1(5) Bulk Regulations
Minimum Lot Frontage Requirement of the Zoning Ordinance. The property is addressed as 2262 Main Street, (Route 6A)
Barnstable, MA in Residential F2 and F-1 Zoning Districts. This relief is being sought in the alternative to Appeal No.
1995-166.
The locus of this appeal is just north of Route 6A and south of the railroad tracks in Barnstable Village. This lot is 3.85
acres and the surrounding lots are 1 acre or more and residential in nature. The only access to this lot is via 40 foot"right-
of-way"off of Route 6A. The right-of-way appears on the Assessors map to run through parcel 43. Subject lot is
addressed as 2262 Main Street, (Route 6A) Barnstable, MA in both the RF-2 and RF-1 Zoning Districts which today
requires 20'frontage. The applicant wishes to construct a single family dwelling on the lot.
Procedural Summary:
This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on November 3, 1995. A
Public Hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with
MGL Chapter 40A. The Hearing was opened on December 13, 1995 and continued until January 10, 1996, at which time
the Board found to grant the appeal with conditions. Board members hearing this appeal were Emmett Glynn, Ron
Jansson, Gene Burman, Elizabeth Nilsson, and Chairman Gail Nightingale.
With regards to the Variance, the sole issue is that the lot lacks frontage. Attorney Schilling requested that this
requirement should be waived.. His reasoning is that although the lot does lack frontage, the 40 foot Right-of-Way should
be considered as frontage. The Assessor's map shows the unique shape of the property, and that it abuts the railroad
tracks in the rear, Also, it is a very large(3.85 acres) lot. There are no similar sized lots in the immediate area. The owner
will not subdivide the lot. There are no drainage problems. There are no other uses for this lot other than a single family
residential lot. If this Variance is not granted it would be a great hardship. Part of the hardship refers to the shape which
was created by the highway in front and the railroad track in back. The lot is irregularly shaped due to haphazard
development in the area. The lot was bought with the understanding that the lot was buildable. The hardship also relates
to the topography in which there is a large swell in the lot. Also the railroad tracks are impassable.
The public was asked to testify. Scott Bearse and Neil Ringler both spoke in favor. No one spoke in opposition.
Finding of Facts:
Based upon the testimony given during the public hearing on this appeal, the Board found the following findings of fact:
1. The property is located in an RF-2 and an RF-1 Zoning District off of, but does not have actual frontage on, Route 6A.
2. The lot consists of 3.85 acres which is beyond the requirements of the Zoning Ordinance of the Town of Barnstable
with regards to area.

3. At the time of the lot's creation there was no requirement under the Town of Barnstable Zoning Ordinance for frontage
listed in the Zoning regulations.
The plan of land was accepted and approved under an ANR plan by the Planning Board onMay 10, 1978 and that plan
has not changed.
4. The lot abuts an existing 40 foot wide Right-of-Way which exists for the purposes of servicing this lot.
5. At the time of the creation of this lot, there was no definition for frontage under the Town of Barnstable Zoning
Ordinance.
6. The purpose of the Zoning Ordinance is, among other things, to prevent chaos and confusion in matter which could
impact upon public safety.
7. The Petitioners having a Right-of-Way over a 40 foot easement servicing this 3.85 acre lot would in fact address the
issues for which we have been authorized to have a Zoning Ordinance.
8. There is sufficient frontage upon the Right-of-Way.
9. There are Variance conditions in the form of the irregular shape of the lot. Also, the swell of the land, the railroad
tracks, and the wetlands all lead to the Variance conditions.
10. The granting of this relief would not be detrimental and would be in keeping with the spirit and intent of the Zoning
Ordinance of the Town of Barnstable.
Vote:
AYE: Emmett Glynn, Elizabeth Nilsson, Gene Burman, and Chairman Gail Nightingale.
NAY: Ron Jansson.
Decision:
Based upon the positive findings a motion was duly made and seconded to grant a Variance as requested in Appeal No.
1995-167 with the following conditions:
1. The lot may not be subdivided.
2. Adequate access and turning area must be provided for emergency vehicles.
3. A vegetated buffer must be maintained between the railroad tracks and the location of the home.
4. The entrance to the Right-of-Way shall remain paved as it is presently.
5. All necessary drainage shall be provided so as not to run off.into the public Right-of-Way onto
Route 6A.
6. The lot shall comply with all other regulations in the Town of Barnstable.
Vote:
AYE: Emmett Glynn, Elizabeth Nilsson, Gene Burman, and Chairman Gail Nightingale.
NAY:. Ron Jansson.
Note: Ron Jansson explained that his reason for voting against the Variance is that the lack of frontage of this lot does
not have anything to do with soil conditions, shape or topography.
Order:
The Variance in Appeal Number 1995-167 has been Granted with Conditions. This decision must be recorded at the
Registry of Deeds for it to be in effect. The relief authorized by this decision must be exercised in one year.
Appeals of this decision, if any,shall be made to the Barnstable Superior Court pursuant to MGL Chapter 40A, Section 17,within
twenty(20)da s after the date of the filing of this decision in the office of the Town Clerk. .
