A family apartment is permitted as-of-right,provided the unit meets all of the requirements of that section. Subsection (A)(1) requires the unit to be less than 800 square feet or 50% of the square footage of the principal dwelling. A unit up to 1,200 square feet may be permitted with a special permit finding from the ZBA. The proposed unit is-1,205 square feet, in addition to a 220 square foot garage. As the proposed unit exceeds the 1,200 square foot threshold permitted by special permit,the applicant filed a variance request. Shufelt, William H. Newton,Michael P. Hersey, Craig G. Larson, and Alex M. Rodolakis. The applicant, Anthony Franze, represented himself before the Board. Mr. Franze presented the request to establish a family apartment in an existing detached structure. Mr. Franze testified that his parents will reside in the apartment. He stated the apartment would.be built on the existing footprint, plus he would construct a 100 square foot addition. Mr. Franze indicated he wanted to reuse the existing structure for cost-efficiency and because it was a green construction practice, He stated that having to construct a new structure or addition would be a financial hardship and because of the layout of the lot and the location of the septic system, he had very limited options for situating the apartment on the property. The Board questioned the Applicant about the adequacy of.on-site parking and the existing capacity of the septic system. The building elevations were discussed• Mr. Franze confirmed that the improvements had been approved by the Old Kings Highway Regional Historic District Commission. First of all,apparently comments were made that perhaps need clarification and for that reason I can now understand some of your frustrations.In order for a zoning complaint to be fully understood it must be made in writing.A written complaint serves as a basis for an investigation and may also be used in Court proceedings as the reason certain action was taken. The question of inactivity is another area which must be explored and the answer is not necessarily "yes"or "no". You mentioned the Town issuing a "seven (7)day cease and desist order".This is the first I have heard of this statement.However,allow me to answer the valid questions you raise. First,the question of the landscaping business at this location.It is not a permitted use because it introduces an activity which had never been performed from this location as a business.Mr.Baker sent in his letter and he was so informed that such activity was not permitted and must cease,although this is only one phase of his general contracting business. Second,you have raised the issue of large,noisy trucks that come and go all day.I requested and received a letter from Mrs.Nickerson dated October 7, 1985 explaining the activities conducted from this location.I also requested and received a letter from Richard Nickerson dated October 20,1985 explaining his activities from this location. I do not argue the point that trucks are noisy and perhaps should not be in a residential neighborhood.You state that you have lived in the area since 1978 and there had not been any evidence of such a business.However,Mrs.Nickerson and her son signed letters stating that a business known as the W.M.Nickerson Company did exist.As I stated to you,the difficulty is with the conflicting letters and statements.May I also refer to our conversation about abandonment. There are case laws where this issue proved most difficult.That is not to say your concern could not be pursued. It is my unbiased opinion,that there does exist a non-conforming business use by W.M.Nickerson Company which is not limited to W.M.Nickerson but the use. It is also my opinion that the Nickersons should consider the change in our en vironment and do all that is possible to phase out all business activity or at least do all that is possible to consider their neighbors.Mrs.Nickerson did inform me in her letter and in my office that she would do everything possible to screen the area.The same statement was made at the site.Mrs.Nickerson told me that the business was her late husbands and she wanted to keep it. Town Counsel,Mr.Baker,and the Nickersons.At our last meeting on March 7,1986,the Nickersons and Mr.Baker agreed to screen the property with trees in April.This has not happened.It is now June and from a recent telephone conversation with Mr.Baker in May I am now led to believe he has no intention of following through with his promise to try and alleviate the "eye sore"this property is to my husband and me as abutters at 2286 Main Street,West Barnstable.I can still view,from my kitchen window, workmen urinating alongside the garage.In addition,Mr.Baker's promise of a Spring clean-up has not materialized;if anything the property is looking worse. As it appears things may come to further action with additional town boards due to David Nickerson's plans for the future,I must insist upon receiving your zoning determination in writing.(You may recall I requested this at our last meeting on 3/7/86). I appreciate that you are a busy man with many serious town problems to attend to but this is very important to me and it has now been almost one year since I first asked your office to look into this matter.I think you have tried the best you can to try and help two neighbors get along but promises have been broken and things continue to be at an impasse. I still can't believe this can happen on historic,scenic Route 6A in a town that on the surface seems to be concerned about the future of its villages and how zoning affects the quality of life on Cape Cod.I just can't ignore something that has a negative impact on my family and neighborhood daily.
