I would like to create a commercial kitchen in the space that is currently being used as a seasonal gift shop. This commercial kitchen would give me the ability to serve my houseguests a full breakfast. I am presently limited to a continental breakfast because of the configuration of my current kitchen. We would also like to design it so that we have the ability to give cooking classing to our houseguests. While I anticipate that this will be a shoulder and off-season activity,I would like to explore the possibility of using the commercial kitchen for preparation of food for off-premise catering. A pervious surface such as gravel or stone is an option that would negate the need for zoning relief. However, the applicant is proposing paved parking for the safety and ease of patients,who are for the most part elderly or children. Groundwater Protection There is very little natural coverage on the property (approximately 4,1%). The majority of the proposed parking area consists of a grass surface with trees around the perimeter. The site is, therefore, nonconforming with respect to Section 3-5,2(7)(D)WP Well Protection Overlay District Regulations-Site Clearing,which requires that a minimum of 30%of the total upland area be retained in its natural state. Currently,the property is conforming with respect to the amount of impervious coverage,which is approximately 45.3%. Zoning: RF-2 Residential F-2 Zoning District Groundwater Overlay: AP Aquifer Protection District Background: The property that is the subject of this appeal consists of a 2.25 acre lot commonly addressed as 2504 Main Street(Route 6A),West Barnstable. It is improved with a relatively large(12,590 sq. ft.)one and a half story residential structure consisting of a principal residence, a gift shop and a 10 unit lodging house known as the Lamb and Lion Inn. The site is located within a RF-2 Residential F-2 Zoning District which only allows single-family residences as a principal permitted use of the land. The applicant is seeking to convert the property to a condominium form of ownership pursuant to Mass. General Law Chapter 183A. No change of use from what presently exists is being proposed. According to the applicant, the Condominium Master Deed will prohibit change of use from that which presently exists on the property and will specifically prohibit off season use of the 10 lodging units between December 01 of one year and March 01 of the next, excepting only holidays and occasional weekend use. The applicant was informed by the Building Commissioner(in a letter dated August 03, 1998 and a subsequent letter dated August 21, 1998)that such a conversion to a condominium form of ownership will require Zoning Board relief. The applicant is appealing this decision of the Building Commissioner. In the alternative, the applicant also applied for a modification to Use Variance Number 1996-02 to allow the existing inn to be converted to a condominium form of ownership. Prior ZBA Action: Appeal No. 1956-01 -the Zoning Board of Appeals granted a Use Variance to allow the conversion of a portion of the existing barn into a small apartment. At that time,the premises was known as the"Sand Dunes". It consisted of a main residence, two apartment units, an operating guest house and a gift shop. Appeal No. 1996-01 -the ZBA granted a Special Permit pursuant to Section 3-1.1(3)(A)of the Zoning Ordinance to permit the renting of rooms to no more than 6 lodgers. The petitioners applied for this relief to legitimize the existing operation of the property. Appeal No. 1996-02-the ZBA granted a modification of Use Variance No. 1956-01 to permit the continued operation of the existing 10 unit lodging house and gift shop. Both Appeal Nos. 1996-01 &02 were granted with the following conditions: 1. The inn is to be owner occupied. 2. The hearing was opened on January 10, 1996,at which time the Board found to grant the appeal with conditions. Board members hearing this appeal were Emmett Glynn, Gene Burman,Robert Thome,Elizabeth Nilsson,and Chairman Gail Nightingale. Both the Board and Attorney Thlbbitts agreed to have both appeals heard together. Attorney John F.Thibbitts represented the applicants David Joanne Rice. Attomey Thibbitts distributed a memorandum in support of these appeals. The name of the inn is the Lamb and Lion Inn and this use has been in operation since the late 1930s. A letter from Edith Merz was submitted which stated that she had operated a souvenir shop at this property starting in 1038. She also recalled there being a retail shop on this property for nearly the past 30 years,and from time to time,even earlier. A letter from Melody Trowbridge Ojala was submitted stating that during the summers of 1955 and 1956 she operated a retail use at the locus. David&Joanne Rice purchased the property in 1985, They have a Purchase and Sale Agreement pending and it was the potential buyers who were told that there was a question as to whether or not the inn is operating legally under the Town of Barnstable's Zoning Ordinance. In 1956,there were four kitchenstfour units that were permitted by a Variance. Also,at that time,six lodgers were permitted as-of-right. In 1967,the owner was issued it Building Permit for an addition and at that time 6 lodgers were still permitted as-of-right. The Use the petitioners are now seeking is the Use that has been In affect for the past ten years. In 1985. Building Commissioner Ralph Crosson stated that he has no problem with the Variance the petitioners are seeking and the only reason they are before the Board this evening Is to make the operation "legal"with regards to the Town of Barnstable's Zoning Ordinance.
