As per our conversation, I am actually a resident of Sandwich,Massachusetts and prior to our conversation, I was unaware of the existence of the Old King's Highway Regional Historic District Commission. Consequently, I was ignorant of the Commissions' work to preserve and maintain the district as a contemporary landmark compatible with the historic, cultural, literary and aesthetic tradition of Barnstable County,as it existed in the early days of Cape Cod, and through the promotion of its heritage. Hopefully,the maintenance which I recently performed on my property has contributed in some small way to toward preserving and maintaining the integrity of the district. Many of the neighbors have commented that,the maintenance which was performed at the property certainly made the property much more attractive. To the best of my knowledge,there has not been, any negative comments by any of the neighbors. For your information, I acquired the property about seven years ago as a simple real estate investment. The former owner,had experienced a downturn in his personal and business activities, and I actually acquired the property directly from the prior owner, as part of a financial reorganization in which the prior owner filed a chapter 11 business bankruptcy. As part of the transaction, I agreed to lease the property back to the former owner for a term of 10 years. 1 As the lease payments were made each month on time,and it was part of the agreement that,the tenant would be responsible for all of the maintenance of the property, I believe that,I visited the property only 2 or 3 times in 7 years. However, on a visit to the property in November 2004, I discovered that the tenant had approximately 14 cats and 8 dogs living in the house, and that virtually no maintenance was done at the property in 7 years. I therefore,was forced to require the tenant to move out of the home, and to immediately undertake the task of cleaning and repairing the property,both inside and out. As the basic tasks were"cleaning and repairing" it appears that both of these items fall under the category of either"Excluded or Exempted"as listed in the 2005 commission bulletin. Therefore,please accept this letter as my request for a finding of "Exclusion and/or Exemption as related to the maintenance which was performed at the property. Section 2:03 Exclusions: (a)Ordinary maintenance and repair that do not change the exterior architectural features: ➢ (a)Exterior shingles were replaced with the same materials. ➢ (b)The building was painted however,based upon information and belief the colors are the same colors which were used in 1984 when a major remodeling and addition was done at the property. Section 2:04 Exemptions: ➢ (a)Fences: Based on information and belief the fence meets all requirements of the exemption and it existed from the time the addition was made in 1984. The fence was virtually covered by plant growth, from years of neglect and no maintenance. ➢ (b)Hedges: In all material respects the hedges and other landscaping which required significant maintenance,existed for many years and certainly contributes to the natural beauty of the property.Planting of additional shrubs and literally one thousand(1,000)flowering bulbs will bring a smile to everyone's face in the spring. Owen, upon oath do depose and state as follows: 1) My mailing address is P O Box 819, West Barnstable, Massachusetts 02668. 2) 1 have been a resident of Barnstable, Massachusetts for sixty five (65) years. 3) 1 resided at 2670 Main Street (Route 6A)Barnstable continuously from approximately mid 1984 up to and including November 2004. 4) From 1984 up to approximately 1998, I was the owner of the property. 5) From 1998 up to November 2004, I was a tenant and the property was owned by James Norton. 6) 1 moved out of the property in November 2004. 7) The facts regarding the physical property(Capital improvements made and maintenance performed for the period 1984 up to and including the present date) located at 2670 Main Street, Barnstable are known to me personally. 8) The original home which exits today was constructed around 1860. 9) In 1984 and 1985 with proper permits being obtained from the building and other departments within the town of Barnstable, I personally undertook a major construction project at the property, which included but was not limited to the construction of a significant new addition which is attached to the original home. 10)This addition more than doubled the size of the original home. 11)In addition to the new construction, major renovations were made to both the interior and exterior of the original home. 12)These renovations to the original home included but were not limited to replacement of windows, doors, exterior siding,painting/ staining, roofing, landscaping, fencing and shutters. 1 L � 13)Windows were replaced in the 1860 part of the home where it was deemed necessary. The replacement windows contained y p removable wooden inserts. 14)After the addition and renovations were made in 1984/ 1985 there was virtually no maintenance performed to the exterior of the buildings or landscaping. 15)The lack of maintenance to the exterior of the building and landscaping for a period of more than 20 years caused the landscaping and grounds to become significantly overgrown. 16)The extent of the overgrowth was so significant, that even the original stone wall, fence and walkway in front and to the side of the home could not be identified with the naked eye. 17)The exterior shingles and trim of the home were full of mold, discolored, and in most arrears the exterior shingles and trim had lost their color and were in need of replacement. 18)A significant number of the wooden inserts to the windows were broken and or were missing. This damage to the inserts was caused over the years by pets which lived in the home. 19)In November 2004 James Norton consulted with me personally regarding maintenance which he intended to perform at the property. 20)I personally advised James Norton as to the original color stain,trim and shutter color and landscaping which were incorporated into the renovations which I made in 1986.
