Mr.O'Leary appeared before the Old Kings Highway committee on September 26, 1998 for an informal discussion of the plantings in order to receive some direction as to how to address this matter. Since the letter was addressed to the Commissioner,the committee decided to take no action or even render an opinion.. When Mr.O'Leary was speaking to them,he expressed how these plants were planted approximately 4 to 5 years ago. In checking with a few landscaping supply businesses,the right conditions being sun,soil,fertilization,it is very possible that these plants have grown 3 to 4 feet since being planted. If this is what has happened,then what Mr.O'Leary should have done is filed for a Certificate of Exemption. When this happened in the past and someone had proceeded without the proper paperwork being filed,the offending party had been required to file the appropriate forms to clear up the matter. As far as requiring someone to remove this hedge,something of this nature has not been done in the past. Trees such as these are going to grow and what we don't understand is,because of the amount of time these have been planted,why is this all of a sudden such a problem? We will instruct Mr.O'Leary to file the necessary paperwork and clear up this matter. If we can be of any further assistance,please do not hesitate to contact our office. The Fureys property is shown on the certified plot plan attached to this, letter as Exhibit A. I write to you in your capacity as the enforcing agent under the provisions of Chapter 470 of the Acts of 1973, as amended, the '!Old King's Highway Historic District Act" (the "Act") and specifically Section 10 thereof which confers upon you as Building Commission of the Town of Barnstable the power and duty to enforce the provisions of the Act. Said Section 10 provides in pertinent part as follows: "The building inspector in the affected town shall have the power and duty to enforce the provisions of the Act. " The violation about which I write .is an ongoing one being conducted on property immediately adjacent to and along the southerly border of the Furey premises. (See area of "Hedges" as shown on Exhibit A) Specifically, the owners of that property, Dr. and Mrs. O'Leary, have over the past two years planted a row of arborvitae trees immediately along the common boundary line between the southern portion of the Furey premises and the O'Leary premises. The planting has been undertaken in such a fashion as to provide a continuous wall now ranging in height from 7' to 9' consisting of over.. 45 to 50 trees forming a thick hedge' row. 'Hedge is defined as "a fence or boundary formed by a dense row of shrubs or low trees" . (Webster's Seventh New Collegiate Dictionary) t Page 2 - Ltr. to Ralph Crossen, Building Commissioner - 8/14/98 Under the provisions of the Act, Section 6: "No building or structure or part thereof . . . shall be erected within the district unless or until an application for a certificate of appropriateness . as to the exterior or architectural features shall have been filed with the committee. " (Emphasis added) Section 3 of the Act defines a structure as follows: "A combination of materials other than a building, sign, or billboard, but including stonewalls, flagpoles, hedges, gates,, and fences. " (Emphasis added) Therefore, it is clear that a hedge is a structure within the meaning of the Act. In order for a structure to be erected without the benefit of a Certificate of Appropriateness it must either have been exempted by the provisions of the Act (Section 7) or have been exempted by virtue of regulations promulgated by the Commission under the provisions of Section 7, Paragraph 3 and the issuance of A Certificate of Exemption. The current guidelines of the Commission regarding exempt features and activities, Paragraph C, Certificates of Exemption, exempts hedges provided that they are natural and do not exceed 4' in height. (Copies of the Guidelines are enclosed as Exhibit B. ) As a result, it is clear that the Act provides that hedges are treated as structures and require a Certificate of Appropriateness unless otherwise exempted. Hedges under 4' in height may be exempted upon issuance of a Certificate of Exemption by the Local Committee. Hedges over 4' in height require a Certificate of Appropriateness. A check at the files of the Local Committee reveal that no permission has ever been received by the O'Learys for the erection of the hedge at issue. When the hedge was first being planted, my clients attempted to resolve this matter with the O'Learys with no success. Subsequently, they retained me and I made efforts in contacting their legal counsel to resolve the matter. Again I have had no success in reaching a resolution. As a result, we are asking you in your official capacity as the Building Commissioner to take action. 4 I Page 3 - Ltr. to Ralph Crossen, Building Commissioner - 8/14/98 I would ask that you inspect the premises to verify the facts as set forth herein and issue the appropriate order to the O'Learys to have this unauthorized hedge removed.
