With all due respect, my complaint at no time was about the painting being a sign or a mural, but rather the fact that the property owner did not seek approval from the Old Kings Highway District Commission ("OKH") for making an alteration to the exterior of his building. Pursuant to the rules and regulations of the OKH " the OKH reviews applications for any change in the exterior of buildings and structures, fences and signs " and " all applications are reviewed for general design, proportion of building elements , texture , materials and color ". It is very clear that the painting of the exterior of this particular structure from what it had been certainly constitutes a change and as such is subject to the approval of the OKH. If it were not then a property owner could conceivably paint the exterior of his/her structure any color without approval of the OKH which would defeat the purposes for which the OKH has been established.Again, my complaint is not about whether this is a sign or a mural but rather that it is a change in the exterior of a structure and as such requires approval from the OKH. I respectfully request that you reconsider your decision as it does not address the underlying basis for my complaint. Not to do so would set an unfortunate precedent which would encourage others to make exterior changes, including the painting of the exterior of a structure. without the approval of the OKH.. Your denial, once again, is on a matter that I did not base my complaint on. It has nothing to do as to whether it is mural or a sign. My complaint is based on the fact that the owner changed the exterior of his building with out obtaining approval from the OKHDC. Under the rules and regulations of the OKHDC a change to the exterior of a structure includes the painting of the structure. fie in fact painted the exterior of his structure. It matters not how and what he painted. This is not about a mural or a sign. It is about his failure to conform with the rules and regulations of the OKHDC which requires approval when an owner changes the exterior of his/her structure. This is not a building code violation nor is it about freedom of speech. It is a violation of the rules and regulations of the OKHDC and,it is my understanding that any such violation is to be enforced by your office. If I am incorrect in assuming that your office is responsible for the enforcement of violations of the OKHDC please so inform me. Once again, my complaint is not about a mural or a sign as you seem to base your decisions on. It is on a change to the exterior of a structure which includes the painting of the exterior side wall. I respectfully request that you review my complaint and enforce the violation of the requirements of the OKHDC. I prefer not to bring a formal appeal or complaint against your decision as you indicate I have the right to do. However, with all due respect you have not addressed the basis of my complaint. In your correspondence you request again that I enforce against the owner of 3075 Main Street for having a mural painted on the side of their accessory structure. You cite the irrelevance of whether or not the mural is a sign (based on my previous response) and insist that enforcement is required due to a change in appearance of the structure. What you fail to cite are the other two reasons for my denial of enforcement: I. Building permits are not required for a mural. 2. The mural is protected speech and not subject to enforcement Based on my findings and conclusion in my previous correspondence to you I am not swayed that enforcement is appropriate and will not take action as requested. In my previous correspondence I advised you of the remedies that are available to you in the event that you have been aggrieved. Those remedies are still available to you. As I noted in my letters, the complaint is not based on whether it is a sign or a mural but rather that it is a change in the painting of the exterior of the building which is within the jurisdiction of the OKH. It is interesting to note that the owner of this building is an alternate member of the OKH and, as such, is fully aware of the requirement of submitting an application for approval to the OKH prior to making any such change to the exterior of the building. My understanding is that your office is responsible for overseeing and enforcing violations of the rules and procedures of the OKH. As previously requested, please issue an order requiring him to remove this violation until such time as lie follows the procedure requiring an application and obtaining approval from the OKH. In your response to me of July 7,2020 you denied my complaint based on your interpretation that my complaint was based on a sign or a mural painted on the structure and therefore was permitted With all due respect that was an erroneous interpretation of my complaint. My response to you on August 5,2020 (attached hereto) Was that my complaint had never been about a mural or a sign as such but rather that the owner painted/ changed the exterior of the structure without seeking approval from the OKHDC. The Regulations of the OKHDC clearly state that any changes to the exterior of a structure, "including painting" is within their jurisdiction. My complaint is not about a sign or a.mural. It is specifically about someone having changed the exterior of his structure without seeking approval. I am requesting once again that, as the enforcement officer of the Town, you issue an order requiring the Owner to restore the exterior siding of the structure to what it was prior to his unauthorized actions and if the owner wishes to change the painting then he must follow the rules as does everyone else and apply to the OKHDC for approval to do so. Failure to take said action will encourage others to make exterior changes, including changing the exterior paint, without seeking the required approval from the OKHDC.i You t ly Jose .
