Crosby, D.B.A. F and E Enterprises, with an address of 502%Z &tada Street,Englewood, FL 34223, LESSEE: Howard W. Woollard, with an address of P.O. Box 263,Barnstable, MA 02630, individually 2. PREMISES: That portion of Lot 2 as shown on a plan of land dated September 17, 1999 which consists of a building marked garage on said plan and all of the property that lies south of the lease line shown in said plan,outside of the access and utility easement,shown on said plan, copy of said plan is attached hereto as Exhibit A and the demised premises is so noted thereon. LESSEE shall also have the right to use the access and utility easement shown on said plan,for access to and from the land of the County of Barnstable out to Route 6A. 3. TERM: The term of this lease shall be for 20 years commencing on October 1", 2000 and expiring on September 30t',2020. The LESSEE shall have the right,for a period of 30 days after the expiration of the first year of the Lease,to cancel the Lease by written notice to the. LESSOR. 4. RENT: The LESSEE shall pay to the LESSOR at LESSOR'S address above, without demand, rent to be paid for the term of the Lease shall be as follows: 1. For the first year an annual rent of$400.00 per month,payable on the-first of each month. 2. The rent for the second year shall be $'400.00 per month, payable on the first of each month. 3. The rent for the third year through the tenth year shall be$500.00 per month,payable on the first of each month. 4.. The rent for the eleventh through fifteenth year shall be $550.00 per month,payable on the first day of each month. 5. The rent for the sixteenth year through the twentieth year shall be $600.00 per month, payable on the first of each month. 5. REAL ESTATE TAXES: THE LESSOR shall be responsible for and shall pay all Real Estate taxes levied by the Town of Barnstable on the Demised premises for year one. Each 1 , year thereafter, the LESSEE shall pay all the Real Estate taxes levied by the Town of Barnstable on the demised premises. 6. UTILITIES: LESSEE will be responsible for all utilities and upgrades. -- 7. USE OF DEMISED PREMISES:Office,builder.'s shop, storage,residential, and any other use permitted under the Barnstable Zoning Ordinance or by issuance of a Decision from the. Barnstable Zoning Board of Appeals, except a restaurant use or motor vehicle or repair garages. 8. COMPLIANCE WITH LAWS: The LESSEE agrees that no trade or occupation shall be conducted in the leases premises or use made thereof which will be unlawful, improper, noisy, or offensive, or contrary to any law or any municipal bylaw or.ordinance in force in the city or town in which the premises are situated. 9. FIRE INSURANCE: The LESSEE shall not permit any use of the leased premises which will make voidable any insurance on the property of which the leased premises are a part, or on the contents of said property, or which shall be contrary to any law or regulation from time to time established by the New England Fire Insurance Rating Association, or any similar body succeeding to its power. The LESSEE shall on demand reimburse the : LESSOR, and all other LESSEE'S, all extra insurance premiums caused by the LESSEE'S use of the premises. 10. MAINTENANCE OF PREMISES: The LESSEE agrees to maintain the leased premises in the same condition as they are at the commencement of the term or as they may be put in during the term of this lease, reasonable wear and tear, damage by fire, and other casualty only excepted. The LESSEE shall not permit the leased premises to be overloaded, damaged,stripped,or defaced nor suffer any waste. ALTERATIONS-ADDITIONS: The LESSEE .shall be permitted to make structural alterations additions to the leased premises, and may make non-structural alterations provided in either case the LESSOR consents thereto in writing which consent will not be unreasonably with held or delayed. All.such allowed alterations shall be at LESSEE'S expense and shall be in quality at least equal to the present construction. LESSEE shall not permit any mechanic's liens or similar liens.to remain upon the leased premises for labor and material furnished to LESSEE or claimed.to have been furnished to LESSEE in connection with work of any character performed or claimed to have been performed at the direction of LESSEE and shall cause any such lien to be released of record forthwith without cost to LESSOR. Any alterations or improvements made by the LESSEE shall become the property of the LESSOR at the termination of.occupancy as provided herein. The LESSOR may grant credit to the LESSEE.for any leasehold improvements made on the leased premises in 2 lieu of rent o_rent increase during the term of the lease. 12. LEASEHOLD MORTGAGES (a) LESSEE shall have the right, at any time and from time to time during the term of this Lease, to mortgage or.otherwise encumber LESSEE's leasehold interest in the leased premises or any part or parts thereof, including any and all improvements, appurtenances, rights,privileges and easements benefitting,belonging orpertaining thereto, and to renew, modify, consolidate, replace, extend or refinance any one or more of such mortgages, provided that-the LESSEE is not in default as of the date of recording of any such leasehold mortgage or other encumbrances. (b) If LESSEE shall mortgage this leasehold in accordance with the foregoing provisions, LESSOR agrees that so long as any such leasehold mortgage shall remain unsatisfied of record, and notice of such leasehold mortgage shall have,been given to LESSOR, the following provisions shall apply: (1) There shall be no termination, cancellation, surrender, acceptance of surrender or modification of this Lease without the prior written consent of each holder of a leasehold mortgage,provided,however that without the prior written consent of any holder of a leasehold mortgage this Lease may be terminated for default only upon compliance with all of the terms of this Lease, including, without limitation, this Paragraph 13. (2)LESSOR shall send each holder of a leasehold mortgage copies of all notices of default or termination or both given by LESSOR to LESSEE in accordance with any term or provision of this Lease or otherwise. If pursuant to any provision of this Lease or otherwise this Lease may be terminated without notice to LESSEE,no such termination shall be effective unless LESSOR shall have given each holder of a leasehcld mortgage written notice thereof at least thirty (30) days prior to the effective date of such termination-consistent with paragraph 13. In the event of any failure-3y LESSEE to perform, fulfill or observe any agreement by LESSEE herein or any breach by LESSEE of any representation or warranty by LESSEE, any such holder of a leasehold mortgage may at its election cure such failure or breach for and on behalf of LESSEE, and in such event LESSOR shall accept such performance., fulfillment or observance by such holder of a leasehold mortgage as if the same had been done by LESSEE. (3) For the purposes of this Paragraph 13, no failure or default on the part of LESSEE in the performance of work to be performed, acts to be done or conditions to be remedied shall be deemed to exist if steps shall in good faith have been commenced to rectify the same and shall be prosecuted to completion with diligence and continuity. (4) Any-thing herein contained notwithstanding, while such leasehold mortgage I 3 remains unsatisfied of record, if any event or events (including, without limitation, any default)shall occur which shall entitle LESSOR to terminate this Lease, and if before the expiration of thirty (30) days after the date of service of such notice of termination or notice of default, any holder of a leasehold mortgage shall have paid to LESSOR all rent and additional rent herein provided for and then in default and shall have complied or shall engage in the work of complying with all of the other requirements of this Lease, if any are then in default, then and in any such event, LESSOR shall not be entitled to terminate this.Lease and any notice of termination or default therefore given shall be void and of no effect. (5) If any matter giving rise to termination of this Lease or any default by LESSEE is, in either case, reasonably incapable of cure (such as LESSEE's bankruptcy or insolvency),the holder of a leasehold mortgage shall be required to cure such default or matter in order to avoid termination of this Lease, and termination of this Lease shall be postponed while any holder of a leasehold mortgage shall prosecute foreclosure proceedings(or actions to remove a stay thereof) or take other action to acquire LESSEE's interest under this Lease, provided such holder of a leasehold mortgage shall cure any then existing money failures or defaults and meanwhile pay the rent and additional charges then due. If such holder shall foreclose or otherwise acquire LESSEE's interest in this Lease, this Lease shall not terminate but shall continue in full force and effect, and such holder shall be deemed to have assumed all obligations of the LESSEE under the lease. (6) If any default by LESSEE cannot be remedied unless the holder of a leasehold mortgage shall have possession of the leased premises or shall have foreclosed such leasehold mortgage, then termination of this Lease shall be postponed while any holder of a leasehold mortgage shall prosecute foreclosure proceedings (or actions to remove a stay thereof)or take other action to acquire LESSEE's interest under this Lease and thereafter while such holder shall prosecute the cure of such default with reasonable diligence, provided that such holder of a leasehold mortgage shall cure any then existing money defaults and pay the rent and additional charges then due. If such holder shall foreclose or otherwise acquire LESSEE's interest under this Lease and shall complete such cure,this Lease shall not terminate but shall continue in full force and effect provided any holder of a Leasehold mortgage shall have paid to LESSOR all rent and.additional rent provided herein. LESSOR shall recognize any purchaser or assignee of a leasehold mortgage whose succession to the rights of LESSEE hereunder is acquired through foreclosure or otherwise. (7)If LESSOR shall elect to terminate this Lease by reason of any failure.or default of LESSEE, each holder of a leasehold mortgage shall not only have and be subrogated to any and all rights of LESSEE with respect to curing such defaults,but shall also have the right to postpone and extend the specified date for the termination of this Lease for a period of four (4) months, provided such holder of a leasehold mortgage shall cure.any then existing money failures or defaults and meanwhile pay the rent and additional charges and comply with and perform,all of the other terms, 4 conditions and provision of this lease on LESSEE's part to be complied with and performed which it can cure without taking possession or foreclosing and which are otherwise reasonably capable of cure,and such holder of a leasehold mortgage shall forthwith take steps to acquire LESSEE's interest in this Lease by foreclosure or otherwise. If at the end of such four(4)month period such holder shall be actively engaged in steps to acquire LESSEE's interest herein, such postponement and extension of the date for termination shall be extended for such period as shall be necessary to complete such steps. If such holder of a leasehold mortgage so acquires LESSEE's interest herein and cures all defaults which are reasonably capable of cure under the subparagraph hereof applicable hereto, this Lease shall not terminate but shall continue in full force and effect, and such holder shall be deemed to have assumed all of LESSEE'S obligations under the Lease. (8) LESSOR will from time to time upon not less than ten (10) days'prior written request by any holder of a leasehold mortgage deliver to such holder of a leasehold mortgage a written statement certifying whether or not this Lease is in full force and effect and stating(a)the last day to which the rent and other charges have been paid (b) whether or not this Lease has been amended, (c) whether or not LESSEE is in default hereunder or has any indebtedness to LESSOR for the payment of money and (d) if so, each such default or indebtedness. (9) LESSOR agrees that in the event of termination of this Lease by reason of any default by LESSEE,other than for nonpayment of the rent or additional charges and other payments herein provided for, LESSOR will enter into a new Lease for the leased premises with the holder of the then first mortgage on this Lease or with its nominee or designee, for the remainder of the term, effective as of the.date of such termination, at the rent and additional rent and upon.the terms and provisions as herein contained and subject only to the same conditions of title as this Lease was subject on the date of the execution hereof, and to the rights, if any, of any parties then in possession of the leased premises or any portion thereof,provided.any holder I of the Leasehold mortgage shall have paid to LESSOR all past due rent and i additional rent as provided in said Lease and (i)such holder shall request such new Lease within one hundred twenty(120) days after the date of such termination. (ii) such holder shall pay to LESSOR at the time of execution and delivery of such new Lease all sums as to which such mortgagee shall have been provided with prior notice and which would at the time of execution and delivery thereof be due under this Lease had it not terminated. In addition, such mortgagee shall pay any expenses,including reasonable attorney's fees, to which LESSOR shall have been subjected by reason of such default. (iii) LESSOR shall not warrant possession of the leased premises to the j lessee under the new Lease. i 5 ' III (iv) the lessee under such new Lease shall have the same right, title and interest in and to the leased premises as LESSEE had under this Lease. (10)Any Leasehold Mortgagee may become a legal owner and holder of this Lease. by foreclosure of its leasehold mortgage or as a result of the assignment of this Lease in lieu of foreclosure. (11) LESSOR agrees not to interfere with the exercise by any leasehold mortgagee of its rights under.this Lease. 13. LESSOR BORROWING The LESSEE and any leasehold mortgagee shall allow said LESSOR's mortgagee to record a mortgage or deed of trust or any other similar instrument provided that said mortgage deed of trust or any other similar instrument will be subject to and subordinate to this Lease and time to time upon not less than ten days prior written request by the LESSOR or its mortgagees deliver to said LESSOR a written statement certifying that the Lease is in full force and effect and stating (a) the last day to which the rent and other charges have been paid (b).whether or not the lease has been amended and (c) whether or not LESSEE is in default hereunder or has any indebtedness to LESSOR for the payment of money and(d)if, so, each such default or indebtedness. Notwithstanding the foregoing, no leasehold mortgagee shall be obligated to deliver such written statement unless such leasehold mortgagee has foreclosed its leasehold mortgage and taken possession. 14. SUBLET AND ASSIGNMENT: LESSEE shall have the right to sublet all or a portion of the demised premises and shall have the right to assign or transfer this Lease. 15. RIGHT OF WAY: LESSOR agrees to grant LESSEE Right of Way over LESSOR'S remaining land to Route 6A.provided LESSEE agrees to provide snow plowing of the Right of Way. 16.. LESSOR'S ACCESS: The LESSOR or agents of the LESSOR may, at reasonable times, enter to view the leased premises and at any time within three (3) months before the expiration of the term, may affix to any suitable part of the leased premises a notice for letting or selling the leased premises or property of which the leased premises are a part and keep the same so affixed without hindrance or molestation. 17. INDEMNIFICATION and LIABILITY: The LESSEE shall save the LESSOR harmless from all loss and damage occasioned by the use or escape of water or by the bursting of pipes,as well as from any claim or damage resulting from neglect in not removing snow and ice from the roof of the building or from the sidewalks bordering upon the.premises,unless such loss is caused by the neglect of the LESSOR. 6 18. LESSEE'S LIABILITY INSURANCE: The LESSEE shall maintain with respect to the leased premises,land, and building,of which the leased premises are a part,comprehensive public liability insurance in the amount of$ 1,000,000.00 with property damage insurance limits of$25,000.00, in companies satisfactory to the LESSOR, insuring the LESSOR as well as LESSEE against injury to persons or damage to property as provided. The LESSEE shall deposit with the LESSOR certificates for such insurance at or prior to the commencement of the term,and thereafter,within thirty(30) days prior to the expiration of any such policies. All such insurance certificates shall provide that such policies. All such insurance certificates shall provide that such policies shall not be canceled without at least ten(10) days prior written notice to each assured named therein. 19. FIRE, CASUALTY, EMINENT DOMAIN Should a substantial portion of the leased premises, or of the property of which they are a part, be substantially damaged by fire or other casualty, or be taken by eminent domain, the LESSOR may elect to terminate the lease. When such fire, casualty, or taking renders the leased premises substantially unsuitable for their intended use,a just and proportionate abatement of rent shall be made, and.the LESSEE may elect to reminate this lease if- (a)The LESSOR fails to give written notice within thirty(30) days of intention to restore leased premises; or (b)The LESSOR fails to restore the leased premises to a condition substantially suitable for their intended use within ninety(90)days of said fire,casualty,or taking. The LESSOR agrees that to the extent that it secures indemnification under policies of Fire and Extended Coverage Insurance,should the demised premises be damaged,he waives his rights to recover damages from the LESSEE. The LESSOR reserves, and the LESSEE grants to the LESSOR, all rights which the LESSEE may have for damages or injury to the leased premises for.any taking by eminent domain,except for damage to the LESSEE'S fixtures,property or equipment. The LESSOR shall have no responsibility to maintain fire insurance on said leased premises. 20: DEFAULT AND BANKRUPTCY: In the event that: (a)The LESSEE shall default in the payment of any installment of rent or other sum herein specified, or such default shall continue for ten(10 days; or (b)The LESSEE shall default in the observance or performance of any other of the LESSEE'S covenants, agreements or obligations hereunder; or (c)The LESSEE shall be declared bankrupt or insolvent according to law, or, if any assignment shall be made of LESSEE'S property for the benefit of creditors, then the LESSOR shall have the right thereafter, while such default continues, to re-enter and take complete possession of the leased premises, to declare the term of this lease ended, and 7 1 .F remove the LESSEE'S effects,without prejudice to any remedies which might be otherwise. . .._ used for arrears of rent or other default. NOTICE: Any notice from the LESSOR to the LESSEE relating to the leased premises or to the occupancy thereof, shall be deemed duly served, if left at the premises leased addressed to the LESSEE, or, if mailed to the leased premises, registered or certified mail, ge perpaid, addressed to the LESSEE. Any notice from the return receipt requested, posta LESSEE to the LESSOR shall be deemed duly served, if mailed to the LESSOR by registered or certified mail, return receipt requested. postage prepaid, addressed to the LESSOR,at it's address given in the first paragraph of this lease or at such other address as the LESSOR may from time to time advise in writing. 22. SURRENDER: The LESSEE shall at the expiration or other termination of the lease remove all LESSEE'S goods and effects from the leasedpremises(including,without hereby limiting. the generality of the foregoing, all signs and lettering affixed or painted by the.LESSEE, either inside or outside the leased premises). LESSEE shall deliver to the LESSOR the leased premises and all keys and locks thereto, and other fixtures connected therewith and all alterations and additions made to or upon the leased premises, in the same condition as they were at the commencement of the term, or as they were put in during the term hereof, reasonable wear and tear and damage by fire or other casualty only excepted..In the event of the LESSEE'S failure to remove any of the LESSEE'S property from the premises, LESSOR is hereby authorized without liability to LESSEE.for loss or damage thereto, and without notice, and at the sole risk of LESSEE, to remove and store any of the property at LESSEE'S expense,or to retain same under LESSOR'S control or to sell at public or private sale,without notice, any or all of the property not so removed and to apply the net proceeds of such sale to the payment of any sum due hereunder,or to destroy such property. LESSOR shall have a security interest in all of such property as defined in the United Commercial Code to secure any unpaid rent,storage charges,or other expenses of LESSOR in connection with the lease. 23. The applicant seeks to utilize an existing one-story vacant garage of 9.36 sq.ft. for a builders'office and storage. The garage is one of four structures located on the 0.33-acre lot. The other uses and structures are a two-story 4,399 sq.ft. dwelling and store, a 13/4 -story 1,386-sq.ft. office building and a 1-story commercial building of 396 sq.ft. The Principal Structure on the site is addressed 3217 Main Street. This particular structure fronts to the rear of the lot that backs up onto Barnstable County Courthouse. This structure is accessed from the parking lot of the Courthouse. A `builders'office and storage'would be governed by Section 3-3.5-3(A) (G) of the Zoning Ordinance. That section reads as follows: .G. Place of business of building trades subject to the following: a) Not more than three (3) full-time employees shall be on the premises at any time; and b) Any outside parking of commercial vehicles or equipment shall be screened from view to a height of six (6) feet; and c) Any outside storage of materials or supplies shall be screened from view to a height of six (6) feet, and shall be stored to a height not exceeding six (6) feet. The proposal was before the Site Plan Review Committee and found approvilable by them on August 16, 2001 (see SPR application and August 24, 2001 Site Approval Letter). f Planning Division-Staff Report The applicant is scheduled for historic review by Old King's Highway Historic District Committee on October 24, 2001. His proposal is to remove the two garages doors and replace them with windows and a door. The applicant is also proposing to stucco the building and repair existing windows and doors. For standing,the applicant has submitted a copy of the lease. It should be noted that Paragraph 2 describes the area to be leased. The land area is very limited and,does not include the access and utility easements shown on the plan except to pass over for access. The easement area cannot be used for parking. History: The subject lot was issued a variance on February 14, 2000 to allow for a division and made the lot into two, each with less area than the district requirement of 10,000 sq.ft. minimum lot area. This division is not yet reflected in the Assessor's Maps. In issuing that variance,the Board also cited and found that the buildings are non-conforming in terms of setbacks (see Decision 2000-09 attached). In August of 1996, the Board issued a special permit for the subject building to be converted into a coffee and bagel shop. In that appeal the applicant, Thomas Austin produced documentation from the County Commissioners office that included a 1962 grant of access to and egress from the public parking lot, and an August 8, 1996 letter and vote citing that the Commissioners did not object to that bagel business using the county parking lot (see attached documents) It appears the applicant is relying upon the 1996 letter and vote to satisfy the parking requirements for his proposed office and business use of the property. Staff Comments: It should be noted that the garage has been underutilized and is in need of improvement. The applicant should be prepared to address the criteria for the granting of the.permit as itemized in Section 3-3.5-3(A) (G), cited above, and the need for parking and rights to utilize spaces within the county parking lot. The applicant desires to establish a tradesmen bay and office for his own use. Engineering had no comments. Health inquired about a dedicated septic system for this facility. The applicant replied that the building is connected to the town sewer. After some discussion regarding the sewer connection of all buildings on site, Mr. McKean required the applicant to submit confirmation of the corresponding connections. When asked about trash disposal, Mr. Woollard informed the panel that a dumpster would not be necessary. All waste is disposed of on the job site. Planning identified a previous ZBA decision granting a variance(2000-009). The applicant confirmed that no changes outside the footprint of the existing building had occurred or was intended to occur. Mr. Bill reminded the applicant that any exterior cosmetic changes are subject to OKH approval. The applicant acknowledged this. Mr. Bill inquired about the parking provisions for the existing on-site uses. "You show four spaces on county property". Mr. Bill declared. A convoluted discussion regarding parking transpired. Clarification requests prompted the Building Commissioner to arrange a site visit immediately after the hearing. Signage was discussed.No signage is proposed on the"double-door side"; identification for access was sufficient (rear door). Mr. Bill recommended that this application be referred to the ZBA for a change of use. Ed Barry, Board of Health, inquired about the nature of the trade and whether or not the use would generate hazardous waste. The applicant replied that no hazardous waste would be generated or stored. He is a custom cabinetmaker. "No storage of solvents?" Mr. Barry asked. "No."Mr. Woollard responded. The Building Commissioner informed the applicant that the Fire Department recommended an alarm. Mr. Woollard replied, "One is already there. There's a wireless system",he declared. At this time,Mr. Bill interrupted to inquire about the dumpster location which appeared to be on county property. Mr. Woollard replied, "I have nothing to do with the dumpsters". "You make cabinets in the garage. That generates waste,"the Commissioner stated. Mr. Woollard explained that the waste from his effort is either disposed of on the job site or transported to the dump daily. The Commissioner asked about the number of staff members. "Myself and my partner" Mr. Woollard answered. It was noted that two parking spaces would be required for the staff and typically there is no public or customer visitation. The nature of Mr. Woollard's trade requires him to perform much of his work on the job site. Conclusion: Continued pending a site visit. It was noted that final approval is subject to confirmation of town sewer connection for all buildings on site. It is anticipated that this application shall be referred to the ZBA for change of use approval. The Building Commissioner accompanied by Doug Bill of Planning and Robin Giangregorio (SPR i Coordinator) visited the site immediately following the hearing. General consensus agreed that the change of use would not adversely impact existing conditions. Final approval on 8/24/01 was granted upon confirmation of sewer connections for all uses on site. This application was referred to the ZBA. 2 T Town of Barnstable Zoning Board of Appeals Decision and Notice Appeal Number 2000-09-Crosby Variance to Section 3-3.5(5) Bulk Regulations Summary: Granted with Conditions Applicants: Freeman M. &Etta R. Crosby Property Address: 3217, 3219, 3221 &3223 Main Street/Route 6A, Barnstable Assessor's Map/Parcel: Map 299, Parcel 023 Area: 0.33 acre Zoning: VB-A Village Business A Zoning District Groundwater Overlay: AP Aquifer Protection District Background: The property consists of 0.33 acre lot that is presently improved with 4 buildings; a 2 story commercial/residential building with a gross floor area (GFA)of 4,399 sq. ft., a 1 3/4 story commercial building with a GFA of 1,584 sq. ft., a 1 story commercial building with a GFA of 396 sq. ft., and a 1 story commercial building with a GFA of 936 sq. ft. The property is located in a VB-A Village Business A Zoning District which requires a minimum lot size of 10,000 sq. ft., a minimum 10'front yard, 30' side yard (total)and 20' rear yard setback, a minimum lot width of 100', and a maximum building coverage of 25%. The applicant is proposing to divide the subject parcel into 2 lots. No new construction is being proposed, only the creation of a new lot line. In October of 1999, the Planning Board endorsed an Approval Not Required (ANR) plan for the division of this property. The new lot line creates 2 undersized lots and additional nonconformities with regard to the minimum required side yard setbacks. Currently, the property meets the minimum required lot size (being approximately 14,488 sq. ft. in area) but is nonconforming with regard to the required front yard, side yard and rear yard setbacks, and the maximum building coverage allowed. The applicant is applying for a Variance to Section 3-3.5(5) of the Zoning Ordinance to permit the property to be divided into two lots which do not meet the bulk regulations of the VB-A Zoning District. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on December 10, 1999. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened January 19, 2000, and continued to February 14, 2000, at which time the Board granted the appeal with conditions. Hearing Summary: Board Members hearing this appeal were Gene Burman, Gail Nightingale, Dan Creedon, Tom DeRiemer, and Chairman Emmett Glynn. Attorney Kirrane represented the applicant. This appeal was continued from January 19, 2000 because there were only four Board Members able to sit on the appeal that night and Attorney Kirrane requested a continuance to a time when five members would be present and able to vote. Present this evening were Mr. Crosby, the applicant's son, and Edward E. Kelley, Registered Professional Land Surveyor. Attorney Kirrane addressed the Board. The lot in issue is nonconforming because these buildings predate zoning. They are nonconforming in terms of lot frontage, lot width, current setback requirements, and lot coverage requirements. The lot also predates the Subdivision Control Law. Under MGL Chapter 41, Section 81 L the applicant went to the Planning Board and obtained an Approval Not Required Plan (ANR) dividing the lot. However the applicants also need a variance in order for the lots to stand separate and in order to be able to sell the lots individually, which is what the owners wish to do. Lot 1 will contain one Town of Barnstable-Zoning Board of Appeals-Decision and Notice Appeal Number 2000-09-Crosby Variance to Section 3-3.5(5)Bulk Regulations building and Lot 2 will contain the remaining three buildings. The applicants are in their retirement years and have a potential purchaser for Lot 1. The new owner would occupy the space of the building (on Lot 1)and as such would be able to maintain this historic structure. To maintain these historic sites by the current owners, at this phase in the lives, is now a hardship. There are no exterior changes proposed to any buildings. The Board asked about the access drive running between the two lots. Attorney Kirrane indicated a reciprocal driveway easement could be drafted (if vehicle access is needed) and would be put on record when the lot is sold. Mr. Kelley reported the access is already there from a gravel driveway. Emergency vehicles have access from either the rear or the front over this gravel driveway. There will also be reciprocal utility easements for sewer, gas and cables put on both lots. As to on-site parking. It is limited, but the County has allowed them the use of the county parking lot in the rear. Attorney Kirrane provided copies of letters from the Barnstable County allowing the site to use the parking. The letters date back to the 1960s. The access has been maintained since the 1957s. Although not formally marked, there is room in the front and on the side for parking. The current uses are nonconforming and no new uses are being created. The people now using these buildings have been using the parking on the street or in the rear county lot without problems. Only the ownership of the building is changing. Parking was a great concern of the Board. Access to this parcel is through the county parking lot however there is a curb cut on Route 6A that is assigned this lot and if the Board wanted the applicant could pursue opening up the curbcut. However, that is not an option they would like to pursue at this time. Public Comment: No one spoke in favor or in opposition to this appeal. Findings of Fact: At the hearing of February 14, 2000, the Board found the following findings of fact as related to Appeal No. 2000-09: 1. The applicants are Freeman M. & Etta R. Crosby. The property in issue is 3217,3219, 3221 &3223 Main Street/Route 6A, Barnstable, MA as shown on Assessor's Map 299, Parcel 023. The site is 0.33 acres and located in the VB-A Village Business A Zoning District and the AP Aquifer Protection Overlay District. 2. All buildings on this site predate zoning and have existed prior to the acceptance of the Subdivision Control Law. 3. The applicant is seeking a Variance to Section 3-3.5(5) of the Zoning Ordinance to permit the property to be subdivided into two lots which do not meet the bulk regulations of the VB-A Village Business A Zoning District. 4. There are no exterior changes proposed to the existing buildings. All buildings will remain as they currently are and if any further changes are proposed it would require the approval of Site Plan Review at which time parking would be addressed. At the time, with no changes proposed, the parking is not under the justification of the Zoning Board of Appeals. 5. The unique conditions affecting the locus are the fact that the buildings are existing and have been in existence, in the current configuration, since before zoning. 6. The buildings on the lot are all nonconforming. 7. The locus has the benefit of an approved ANR plan entitled "Plan of Land in Barnstable, MA for F and E Enterprises", dated September 17, 1999 and endorsed by the Planning Board on October 18, 1999. 8. The applicant has agreed to submit reciprocal easements over the property so that the owners of Lot 1 and Lot 2 will both have access to the property from Route 6A/Main Street. 9. They are allowed one curbcut, presently not in existence, but they have the right to reopen it. 10. The relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. The property.is owned by Freeman Crosby and contains a 936 sq.ft. garage leased to the applicant as well as two office buildings and an antique shop. The bagel shop is proposed to occupy the garage. The lot is shown on Assessor's Map as Map 299, Lot 23. It is located in the VB-A(Village Business-A)zoning district. The garage is now vacant, built of concrete block which is proposed to be covered in clapboards with windows and an entrance added where the garage doors are now located. The applicant has been before Site Plan Review and was advised of the need to request the reduction in parking requirements for this proposal. His plans have been approved by Old King's Highway Historic District Committee. This request is for two forms of relief each specific onto itself, one request is for a Special Permit for the Conditional Use of a Restaurant(Section 3-3.5 3A(A))which was granted. The second request was for a reduction in the required parking (Section 4-2.8). This request was Withdrawn Without Prejudice (see Appeal Number 1996-106 - Part B) Restaurants and food-service establishments are permitted as conditional uses in the VB-A District under Section 3-3.5 3A)A). The locus has the benefit of Town sewers. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on July 12, 1996. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened August 21, 1996, at which time the Board found to grant the appeal for the Special Permit pursuant to Section 3-3.5 (3A)(A). Mr.Austin indicated the bulk of his clientele will be those people who use the court house complex. Besides himself, there will be one other employee. There will be a trash container outside for refuse. Public Comment: John Wasierski, owns a restaurant in area and was concerned about parking. He did not feel the county parking lot should be used by this bagel shop, even though the Commissioners have given him permission. Also speaking in opposition was Joseph Ferraro who stressed there is a tremendous parking problem. No one else spoke in favor or in opposition. In rebuttal, Mr.Austin indicated that he thought his clientele would be people coming to the village anyway and therefore would already be using the available parking lot. Findings of Fact: Based upon the testimony given during the public hearing on this appeal, the Board unanimously found the following findings of fact: 1. -The applicant,Thomas Austin, is seeking a Special Permit to operate a coffee and bagel shop at 3219 Main St., Barnstable Village. 2. The property is owned by Freeman Crosby and contains a 936 sq. ft. garage leased to the applicant as well as two office buildings and an antique shop. The bagel shop is proposed to occupy the garage. The lot is shown on Assessor's Maps as Map 299, Lot 23. It is located in the VB-A(Village Business-A)zoning district. The garage is now vacant, built of concrete block which is proposed to be covered in clapboards with windows and an entrance added where the garage doors are now located. 3. The applicant's plans have been approved by Site Plan Review and approved by Old King's Highway Historic District Committee. 4. Thomas Austin has permission in a letter dated August 8, 1996, from the Barnstable County Commissioners, allowing him to use the parking facilities at the county parking lot. 5. Under VB-A and VB-B Business Districts, Section 3-3.5 (3A) Conditional Uses, Subsection (A) Restaurants and food-service establishments, but not including drive-in restaurants, are permitted in this district. 6. Granting the relief being sought to allow the bagel shop would not be in derogation from the spirit and intent of the Town of Barnstable Zoning Ordinance, nor would it be detrimental to the neighborhood affected. Decision: Based on the findings of fact in Appeal Number 1996-106, a motion is made to grant the Special Permit with the following conditions: 1. The Special Permit is limited to the use of 936 sq.ft.for a coffee and bagel shop. Full course meal service is not permitted under this special permit. 2. The maximum number of seats shall be 5. 3. Restaurants and food-service establishments are permitted as conditional uses in the VB-A District under Section 3-3.5 3A)A). The locus has the benefit of Town sewers. Section 4-2.8 permits reduction of parking requirements under a Special Permit if the Zoning Board of Appeals finds lesser parking to be adequate given certain specified circumstances. The property where the bagel shop is proposed is in Barnstable Village, adjacent to the Barnstable Superior Courthouse. The clientele will probably include many of those employed or served by the court and surrounding offices, who will be walking to the site. There may be less need for strict compliance with the parking requirement here than in other areas. Limiting the number of seats will ensure a limited need for parking. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on July 12, 1996. This appeal was continued from January 19,2000 because there were only four Board Members able to sit on the appeal that night and Attorney Kurane requested a continuance to a Tune when five members would be present and able to vote. Present this evening were Mr.Crosby,the applicant's son,and Edward E.Kelley,Registered Professional Land Surveyor. Attorney Kirrane addressed the Board. The lot in issue is nonconforming because these buildings predate zoning. They are nonconforming in terms of lot frontage,lot width,current setback requirements,and lot - a ®K 12903 PG20S 1 ?r 3 o ,Town of Samstabie-Zoning Board of Appeals-Decision and Notice Appeal Number 2000-09-Crosby Variance to Section 3-3.5(5)Bulk Regulations coverage requirements. The lot also predates the Subdivision Control Law. Under MGL Chapter 41, Section 81 L the applicant went to the Planning Board and obtained an Approval Not Required Plan(ANR) dividing the lot. However the applicants also need a variance In order for the lots to stand separate and in order to be able to sell the lots Individually,which is what the owners wish to do. Lot 1 will contain one building and Lot 2 will contain the remaining three buildings. The applicants are In their retirement years and have a potential purchaser for Lot 1. The new owner would occupy the space of the building(on Lot 1)and as such would be able to maintain this historic structure. To maintain these historic sites by the i current owners,at this phase in the lives,is now a hardship. There are no exterior changes proposed to any buildings. The Board asked about the access drive running between the two lots. Attorney Kirrane indicated a reciprocal driveway easement could be drafted(if vehicle access is needed)and would be put on record when the lot is sold. Mr.Kelley reported the access is already there from a gravel driveway. Emergency vehicles have access from either the rear or the front over this gravel driveway. There will also be reciprocal utility easements for sewer,gas and cables put on both lots. As to on-site parking. It Is limited,but the County has allowed them the use of the county parking lot in the rear. Attorney Kirrane provided copies of letters from the Barnstable County allowing the site to use the parking. The letters date back to the 1 M. The access has been maintained since the 1957s. Although not formally marked,there is room in the front and on the side for parking. The current uses are nonconforming and no new uses are being created. The people now using these buildings have been using the parking on the street or in the rear county lot without problems. Only the ownership of the building is changing. Parking was a great concern of the Board. Access to this parcel is through the county parking lot however there is a curb cut on Route 6A that Is assigned this lot and If the Board wanted the applicant could pursue opening up the curbcut. However, that is not an option they would like to pursue at this time. Public Comment: No one spoke in favor or in opposition to this appeal. Findings of Fact: At the hearing of February 14.2000.the Board found the following findings of fact as related to Appeal No.2000-09: 1. The applicants are Freeman M.&Etta R.Crosby. All buildings on this site predate zoning and have existed prior to the acceptance of the Subdivision Control Law. 3. The applicant is applying for a Variance to Section 3-3.5(5)of the Zoning Ordinance to permit the property to be subdivided into two lots which do not meet the bulk regulations of the VB-A Zoning District. Staff Review: There is a minimum lot width requirement of 100' in the VB-A District. The assessor's map indicates a lot .width of 107'for Lot 23. However, the approved plan of land shows a lot width of approximately 99'. Whether or not the existing lot conforms to the minimum required lot width, the new lot line creates 2 nonconforming lots with regard to the lot width. Lot 1 has a lot width of approximately 67' and Lot 2 has a lot width of approximately 32'. 'According to assessor's records dated 01/06/2000 Town of Barnstable-Planning Department-Staff Report Appeal Number 2000-09-Crosby Variance to Section 3-3.5(5)Bulk Regulations There is a maximum building coverage of 25% in the V3-A District.. The property is currently nonconforming with regard to this bulk regulation, having a coverage of about 33%.
