To: Roma, Paul Subject: Chimney inspection... Hi Paul, We have just finished building the chimney on the east elevation of our home at 4131 Main Street in Cummaquid. We'd like you to visit for the final inspection. I followed the stove (Morso) installation guide. The chimney is all brick on the outside with a clay flue running to the top. We have 24Gauge 6" pipe from the stove to the flue. there is cast iron cleanout on the side f the chimney. A hole was drilled throught the foundation on the side of the house and into the basement. The wall surrounding the pipe is brick and mortar 2'x2' around the pipe and foundation behind that into the flue. We have a laminate floor with a glass base (from Morso) under the woodstove. The destroyed house was built by Kenneth Jansson (Erica's father) in the early 1970's (prior to the inception of the Old Kings Highway Board). It was used as a commercial property and a private residence for the Jansson family. The home featured many commercial architectural features, plainly visible from the public way, that were clearly not in keeping with the Old Kings Highway design mandates. The original house also featured active and passive solar home components on the private, south-side of the house that were not visible from the public way, but were plainly visible to the abutters on either side of the house. Once we acquired the home in 2001 from Erica's widowed mother, Avis Jansson, we came before this board to seek approval to do extensive renovation, at considerable expense, to improve the look of the North, East, and West sides of the home. (See before and after photos). When the fire struck, the public sides of the house were clearly a far cry from the architectural demands of this board, and while our lawyer has advised us that we were certainly with our rights to repair/rebuild the existing house, we chose to completely alter the house to fit in with the architectural design you desire. We also, chose to retain the active/passive solar features of our home since they are not visible from any public way. The Board gave approval to our design in 2006 with no concerns. After construction began, we asked our contractor, St. Peter Builders, to enhance the passive solar performance of our house by adding more windows to the ground floor. Shortly thereafter the builder stated that he had obtained your approval for the modifications, and building commenced. The builder walked off the job, nearly a year ago, taking a significant portion of unearned money with him. It has taken us almost that long to restart construction. We were shocked to learn that the builder had lied about getting approval your approval for the basement floor modifications. While one board member stated in the March 12 meeting that it was our responsibility to secure prior approval for modifications, it is important for you to note that we never intended to deceive the Board or anyone else. You denied the plans we submitted for the private, back of the home (which is not visible from any public way) and stated that we would need to submit a new plan to be approved for an occupancy permit. Enclosed please find revised plans for the back of our property, modified from those presented at the March 12 meeting. At that meeting your board approved our plans for the front and both sides of our home. The alterations you demanded we make to the South side are unreasonable because: 1. The private, south side of the house is not visible from the public way so Old Kings Highway has no jurisdiction on the design to our private side. 2. The changes you demanded would destroy approximately 50% of the total solar gain of the house, and 100% of the solar gain in one fourth of the house. Your own guidelines clearly require you to consider alternative energy features in a different (more lenient) light. 3. The previous house had extensive solar features which we were in our rights to replace. 4. The previous house had extensive nonconforming features which we were in our rights to replace with the rebuild. As you know, one abutter, who can see the private back of our house from the middle of of her back yard, complained. We are very sorry that this situation has occurred—it was never our intent to deceive this Board or anyone else. The fact that you would deny our design for the private back of our house is ludicrous and in violation of our property rights. This abutter has no more right to demand changes in our private parts of our house, than we have to demand that she change the non-public exteriors of her house that we deem esthetically inappropriate (there are several). In spite of our position that we should not have to make any changes in the private, non- public, south side of our house we are willing to make the following changes to appease this abutter. We have added a significant number of window grates, a more traditional wooden deck railing (replacing the modern cable rail found on the original approved plan), and additional shrubs on the back of the house. This constitutes a great deal of mitigation on our part, at considerable expense, solely to appease this abutter. We are also prepared to erect a 6' fence on the east side of the property to block the offensive, private parts of the abutter's home from our view(and obviously vice-versa). As stated above, Old King's Highway Board has no jurisdiction over the back of our home which is not visible from a public way. Beyond that,the board's own guidelines require reasonable consideration of alternative energy features. Our new home is in keeping with the character of the Old Kings Highway and has received hundreds of complements from people who have passed by it. I downloaded the Old King's Highway video from the Town of Barnstable website and I must clarify my position. The first change to the original plans was to swap out four(4)awning windows for four(4)double hung windows. I submitted a minor modification application,went before the board,and was granted the changes.This took approximately 3'/2 weeks.As the frame was coming together, Erica Brown began taking solar energy classes and recognized that the lower level could become more living area and provide more solar. Discussions to change the lower level for more passive solar gain evolved into loading the wall with four(4)12'sliders. At this time 1 advised the Browns that I had to go back to Old King's Highway for a modification. Mrs. Brown told me that they could not afford another four week set back and the rear elevation was not visible from 6A. She told me to order the doors and not apply for modifications. Addressing the Certificate for Occupancy,you and I had a discussion just prior to my frame inspection in early 2007.At that time you informed me that you could not issue me a Certificate of Occupancy due to numerous changes to the original plan and that you needed a new plan reflecting all changes so your file was accurate. I informed the Browns to this request but apparently the updated plan took over a year to secure. In conclusion I would like a copy of this letter forwarded to the Old King's Highway Board. I have been in business over thirty years. I go before the various Town OKH boards numerous times per year. I know what the Boards expect and require and advise my clients accordingly. Substantial work has been done on the house, not in conformance with the plans approved by the.Olds Kings Highway Committee, Certificate of Appropriateness dated May 10, 2006, plans last revised 4/10/06. The Building Inspector for the area had notified the builder over an approximately one- year period that the construction was not in conformance with the Certificate of Appropriateness and that revised plans needed to be submitted to the Old Kings Highway. An application for a new Certificate of Appropriateness was submitted February 19, 2008. At the Old Kings Highway meeting of March 12, 2008, the Committee reviewed the application to modify previously approved plans. The Committee reviewed the revised plans as constructed and voted to approve the Certificate of Appropriateness for the east &west sides of the house only; the fenestration was (deemed) more appropriate than the prior approved plans. The applicant.stated he would build the south elevation of the house according to the original Certificate approved May 10, 2006. No approval was given for any re-design of the rear elevation. The rear elevation had been changed to increase the number and dimensions of sliders, increase the number of skylights on a wing from four to six, and changed the style of seven of the windows and three doors from divided lights to clear panes without any dividers. Other features were changed or eliminated. The Committee did indicate however, that the owner could submit other, revised plans for the rear elevation at a later date (i.e. within the time limit allowed by the Building Permit pending resolution of the legal action between the owner and the builder). The first change to the original plans was to swap out four(4)awning windows for four(4)double hung windows. I submitted a minor modification application,went before the board,and was granted the changes.This took approximately 3%weeks.As the frame was coming together, Erica Brown began taking solar energy classes and recognized that the lower level could become more living area and provide more solar. Discussions to change the lower level for more passive solar gain evolved into loading the wall with four(4)12'sliders. At this time I advised the Browns that I had to go back to Old King's Highway for a modification. Mrs. Brown told me that they could not afford another four week set back and the rear elevation was not visible from 6A. She told me to order the doors and not apply for modifications. Addressing the Certificate for Occupancy,you and 1 had a discussion just prior to my frame inspection in early 2007.At that time you informed me that you could not issue me a Certificate of Occupancy due to numerous changes to the original plan and that you needed a new plan reflecting all changes so your file was accurate. I informed the Browns to this request but apparently the updated plan took over a year to secure. 'in conclusion I would like a)copy of this letter forwarded to the Old King's Highway Board. I have been in business over thirty years. I go before the various Town OKH boards numerous times per year. I know what the Boards expect and require and advise my clients accordingly. If a client wishes to make decisions against my advice,this then releases me and exposes the client to potential repercussions.
