Procedural Summary: The application was filed in the office of the Town Clerk and at the Zoning Board of Appeals office on June 04, 1993. A public hearing, duly noticed under M.G.L. Chapter 40-A, was opened on July 8, 1993, at which time the hearing was closed and a decision rendered. The petition was heard. by Board Members: Ron Jansson, Emmett Glynn, Elizabeth Nilsson, Eugene Burman a-ld chairman Richard Boy. Attorney Michael Ford represented the petition before the Board and submitted to the Board a "Memorandum in support of Variance for Barbara Lewii. and James T. & Diane Reimer". He explained that sufficient width does exist on the lot in the location of the setback line but at that location topographic conditions exist that are not conducive to development. Attorney F3rd cited Exhibit 3 of the Memorandum, a topographic survey and location plan. He explained that the survey and plan illustrates a depression at the required setback distance. This depression would place the home vulnerable to flooding and initiation by run-off water. It would also locate the structure in closer proximity to Route 6A and limit vegetation screening. The proposed location of the dwelling is in an area with only a 140.15 feet of width. The location is dictated by existing topography that is more suitable f Degision and Notice Appeal No. 1993-39 for proper drainage and will meet all of the setback requirements for the district. This variance would allow the petitioner to site the house back up over the knoll where the high point is and achieve a view looking out the back and establish a deeper setback from historic Route 6A. The variance is only 9.9 feet from the width requirement. No one spoke in opposition to the request. Find of Facts Based upon the evidence presented and the testimony given at the meeting of July 08, 1993, the Zoning Board of Appeals unanimously finds as follows: 1. The topography and shape of the lot is unique in that it rises from the elevation of the road to a high point and then slopes off to the rear next to wetlands. 2. The topography dictates that the ideal setback for the proposed structure be as proposed. That is on the ,higher ground of the lot and not within the lower "hole" like area where it would be subject to drainage problems and possible flooding. This location also provides for privacy and limits noise from the highway. 4. Granting of the relief sought would not be detrimental to the public good, or would it derogate from the intent of the Zoning ordinance. 5. The 9.9 feet variance requested is minor, almost de minimis and would pose no impact on the character of the neighborhood. 6. The proposed location of the house is compatible with this residential neighborhood and contributes to the rural atmosphere of Route 6A. conclusion: Accordingly based upon the information supplied, a motion was duly made and seconded that, Appeal No 1993-39 be granted a variance as requested and in accordance to the plans presented, titled " Site Plan, Barnstable, (Cummaquid) , for Barbara Lewis" dated May 19, 1993 by Cummaquid Survey Inc. Lewis and James and Diane Reimer BACKGROUND and FACTS The Petitioner James and Diane Reimer are the record owners of a vacant lot shown on Assessor Map 351 as parcel 2 , Lot 1 and located at 4170 Route 6A in the Cummaquid area of Barnstable. This lot was one of two lots created for the estate of Helen F. Conway in 1987 by an ANR plan (recorded at the Barnstable Registry of Deeds in Plan Book 466 page 42) . (See Exhibit 11111 ) The Petitioner Barbara Lewis is a party to a Purchase and Sale agreement on this 1 .49 acre lot . In the process of siting (See Exhibit 11311 ) and designing the house, Ms . Lewis was informed that a variance from Section 2-3 . 2 (Conformance to Bulk and Yard regulations) would be required in order for her to site the house at the proposed location. Ms. Lewis plans to locate the proposed house near the highest elevation on the lot approximately 190 feet back from the streetfront (Route 6A) property line This petition for a Variance is under Section 2-3 . 2 and 3-1.3 (5) Bulk Regulations, minimum lot width, to allow the proposed Lewis house to be located on the aforementioned lot where the lot width is less than the required 150' . The Barnstable Ordinance requires the lot width to be measured where the proposed dwelling is sited on the lot . Section 7 of the Ordinance defines "lot width" as "the width of any lot shall be measured wholly within the lot at the building setback line along a straight line parallel to 2 i a line connecting the intersection of the front boundary with the lot side lines, except that an owner of land may establish his own setback line at a distance greater than that required and the lot width may be determined at the setback line so established. " This vacant lot is less than 150' in width at the proposed house location. It is approximately 142' in width at the front line of the proposed attached garage to this house. The lot is 155' in width at the road frontage and for approximately 80' into the lot . The width at the rear of this lot is 1461 . ARGUMENT With respect to the variance request, MGLc40A, Section 10 specifically provides the criteria for a variance : 1 . there are circumstances relating to soil conditions, shape, or topography of land and especially affecting said parcel but not affecting generally the zoning district in which it is located and a literal enforcement of the provisions of the zoning by-law would involve substantial hardship; and 2 . desireable relief may be granted a) without substantial detriment to the public good; and b) without nullifying or substantially derogating from the intent or purpose of the by-law. Specifically relating to this petition, in the following ways, the criteria can be met . A. THE CONDITIONS ESPECIALLY AFFECTING THE PARCEL SUCH THAT A LITERAL ENFORCEMENT OF THE PROVISIONS OF THE BARNSTABLE ORDINANCE WOULD INVOLVE SUBSTANTIAL HARDSHIP: 1 Conditions especially afflicting the locus with circumstances relating to the soil conditions, shape, or topography: The topography and shape of the lot is unique . The lot rises up from the elevation of the road to a high point and then slopes off the rear of the lot where there are wetlands . 3 2 . Substantial hardship: The topography makes the reasonable location of the house to be setback from the road and near the highest elevation of the lot . If the Ordinance is literally enforced, to locate the house otherwise, would be a substantial hardship. It would require a house to be located well forward on the lot and close to well travelled Route 6A where lack of privacy, continual traffic noise and lack of a view would all negatively impact the petitioners . B . DESIREABLE RELIEF MAY BE GRANTED 1 . Without substantial detriment to the public good: To be able to site a house on this lot in the proposed location will have a beneficial impact on the neighborhood, preserving a deep and vegetated front yard and retaining visual open space on this historic road. As the lot is approximately 142' in width at the house location and the house exceeds the required side yard set back by 10 feet on the easterly side and by more than 50' on the westerly side, there is minimal if any impact of this variance on abutting property. 2 . Without derogating from the intent of the Barnstable Ordinance. This minor (almost deminimus) dimensional variance has no impact on the character of the neighborhood. The proposed location for the house is compatible with this residential neighborhood and contributes to rural atmosphere of Route . 6A.
