As stated at the time of our renovation in 2012, my reason for purchasing this property in October 2011 and renovating was to have my son and other young people with disabilities move into the four bedroom home. Our goal has been to assist each young adult in achieving a meaningful and more independent life by creating a learning/working environment with the barn/shop. The work/teaching in the barn/shop has been a challenge for me financially. Capabilities approached me this week to see if I would be interested in having them take over this opportunity. They of course have the man power and the funding to benefit so many young people with disabilities that I am thrilled and honored for this opportunity. The shop/barn have been operated as a gift/antique shop for many years. Prior to my owning the property, it was called The Picket Fence. The goal has been to provide young adults with disabilities a wide variety of jobs and responsibilities and of course this is what CapeAbilities is known to do. According to the proposed architecture plans referenced above,the Gross Floor Area of the Second . Floor(floor immediately below the half story)is 1,640 s.f. and the Gross Floor Area of the proposed Finished Attic Area is 721 s.f., which is 44%of the gross floor area of the Second Floor,which is immediately below the attic floor. This ratio is less than the maximum limit of 66%under the Zoning Bylaws for"Half Story".I also verified that the gross floor areas of both second floor and attic floor are accurate as presented in the architecture plans. Therefore, I here certify that the Proposed Fished Attic Space is qualified as "half story"under the Barnstable Zoning Bylaw based on my above analysis/calculation against the applied Bylaw Review Section. The building permit does not list a use. However, I believe that the affidavit of Mr. French permits you, as the building inspector, to make a determination that, indeed, the 1967 building permit was issued for a use which is substantially identical to that carried on by the Winsors' currently. The Christies operated out of both the out-building and the barn shop for the sale of jewelry, pottery and rugs and various potpourri. The business carried on by the Winsors is virtually identical. As a result, it would appear to be in your discretion that permit No. 11333, duly issued by the then Building Inspector, Mr. Herbert Stringer, when viewed in light of the French affidavit, permitted not only remodeling of the barn but the use of the premises for commercial purposes. Reaching that conclusion, and applying the above quoted language from Chapter 40A, Section 7, by virtue of the passage of six years from the time of the issuance of Permit No. 11333 the use has become a protected use and able to be legally continued, notwithstanding the present provisions of the Barnstable Ordinance which classify this property as residential. As you are aware, under a letter dated September 5, 1987, the then Building Inspector, Mr. Daluz, reached the conclusion that this property could continue to be used for commercial purposes in the fashion that the Winsors' now operate it, in that they are operating it exactly as their predecessors in title, the Votolatos. The only changes are significant structural improvements to the Barn and the balance of the property at great expense to the Winsors. Therefore, I would ask that you review these materials and exercise your discretion to make a finding that this property is indeed protected by the applicable provisions of Chapter 40A, Section 7 when Building Permit No. 11333 is viewed in light of the accompanying materials particularly the Affidavit of Bertrand C. The locus and subject of the petition is a retail gift and antique shop commonly known as the"Picket Fence"that exists along Route 6. According to the Assessors Records, the lot is developed with a 3,434 sq.ft. two-family dwelling, a detached garage, and a 25 by 42 (1,050 sq.ft.)gift shop structure(the barn). The use of the barn as a gift shop does not comply with the requirements of the permitted uses in the zoning district. The use was initiated sometime in the early 1960's and should have had a permit from the Zoning Board of Appeals to be considered in conformance with the Zoning Ordinances. Today the applicants are before the Board to request a Use Variance to provide for the continuation of retail sales which have existed for some 35 years. Procedural Summary: This petition was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on April 21, 1995. A public hearing was before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A.'The hearing was opened on May 17, 1995, at which time the Board found to grant the use variance with conditions. Board members hearing the petition were: Ron Jansson, Richard Boy, Emmett Glynn, Thomas DeRiemer and Chairman Gail Nightingale. Attorney Michael Ford represented the petitioners and submitted a memorandum in support of the petition to the Board. He noted that he understood that a Use Variance is not often granted by the Board but would show that owing to certain conditions of this locus he could substantiate that the granting of relief would not be in derogation of the Zoning Ordinance. He cited Chapter 40A, Section 10, which specifies that conditions related to"land or structures" can warrant granting of a variance. In this particular case, the structures or buildings upon the lot are the factor that produces the unique conditions that can permit the granting of the use variance. The barn is an historic structure that has been renovated and maintained, although today the site is no- longer used for farming. It is a large barn and could not be utilized for residential purposes. To preserve this structure is costly and a hardship if the locus is only usable for residential purposes. In 1987 the Winsors financed the site for$540,000 dollars and that represents a sizable investment by them. Zoning Board of Appeals • Decision and Notice Appeal Number 1995-32--Burke Adaptive reuse of the barn, as it has been used for during the last 35 years, has been of a benefit to the neighborhood in that it preserves an historic structure within the Old Kings Highway Historic District. It has not been a detriment to the neighborhood but rather an assets. A petition was circulated to all of the abutting property owners in support of the application for the Use Variance and all have signed it. A copy was submitted to the Board with 22 signature in support. The use of the structure has been limited to use as a"home business", with the owner of the business living on site in the home. The Board requested public comment, and an abutter, Robert Stewart, Willard Sheppard, Edythe Gingerich and the James Hinkle spoke in favor of granting the Use Variance. No one spoek in opposition. Finding of Facts: Based upon the testimony given during the public hearing on this appeal, the Board unanimously found the following findings of fact 1. Appeal 1995-58 has requested a use variance to Sections 2-3-1 and 3-31.1(1). The granting of Use variances is authorized by Section 5-3.2(5) of the Zoning Ordinance. 2. The property has been consistently used since at least 1960 for some form of commercial use and granting of this petition does not represent a drastic change in the use or development on lot 3. The applicant has substantiated that the structure upon the lot does present a unique situation that warrants the granting of the relief and constitutes variance conditions under Chapter 40A, Section 10. 4. Granting of the relief requested would not be detrimental to the neighborhood. Decision: Based upon the positive findings, a motion was duly made and seconded to grant a Use Variance as requested in Appeal No. 1995-58, with the following conditions: 1. In the present case, we conclude that York is not barred from relitigating the finding of illegality by reason of two interrelated pol- icy considerations. First, and of critical importance, is the uncertain status of York's right to obtain judicial review of the 1992 finding by the board. York might have been dissuaded from appealing because of the likelihood that the board's alternate finding (that the expansion would be substan- i . tially more detrimental to the neighborhood) would be upheld,9 and the i ' finding crucial to York not even reached. Moreover, in the circumstances, an appellate court might well have deemed such an appeal frivolous. See , 4 note 6, supra. 1 Second, York had no reason to foresee that seeking a special permit to extend its present parking use which had continued without interference for more than thirty years (taking into consideration the use by York's predecessor in title), would endanger that use without an opportunity to ob ain a full adjudication of that issue. The abutting property that I owned since the 1940's permitted me to mace daily observations of the Winsor property. ,w 3. In the early 196o's, the Christie, operated a business from the out buildings and barn located on the Winsor site. 4. In 1967 the Chrietiea applied for a building permit for the express use of remodeling the barn and using the barn and out building,' for business purposes. .*. S• 1 organized a petition effort in the neighborhood to verily the past business uses of the property in support of the Christie,' application for a building permit for a business use. 6. The petition was presented to the then Town of Barnstable r. Building Inspector, Mr. Stringer, who informed the Christie, that no formal hearing would be needed as he would issue the building permit for the renovation of the barn and the use of the barn and out buildings for business purposes. 7. These statements are made of my own personal knowledge and our based upon my best recollection of the events. I understand that they are being provided to the current building inspector of the Town of Barnstable in an effort to clarify the business use currently being conducted at the Winsor property. A. Picket Fence. I have been requested by the current owners David and Mary Ann Winsor to transmit the following information regarding the above referenced property. My family owned this property for approximately 12 years from 1948-1960. At that time the farmstead included the main dwelling house, a large barn with double hay lofts, 2 carriage sheds(one completely open on one side and the other partially enclosed-used as a smokehouse at one time), various small outbuildings(chicken coop, pig pen, etc.) and approximately 50 acres of land. My parents thought this property would be ideally suited to raising their family and growing vegetables and flowers and having a few amimals for pleasure and consumption (until my sister and I refused to eat our pets, so they were allowed to die of old age). At one time my Dad thought of raising angora rabbits for sale until he discovered he had two male rabbits. That ended that. To my knowledge my parents never had a business on this property, however, I do know that Anna and Frank Christie, subsequent owners, did make and sell jewelry, pottery and weavings. I recall visiting Mr. Christie in one of the converted carriage sheds where he made and sold his jewelry. Since that time subsequent owners have run a variety of businesses at this property. The current owners Mr.and Mrs. Winsor received a preservation award from the BHC in 1990 for their outstanding restoration of the C.1855 Nathan Edson Barn and for their commitment to saving an historic outbuilding.
