The current exemption for"homeowners" extended to include o v er-occupied dwellings of six units or less and to allow
homeowners to engage an individual for hire wh oes not possess license,provided that the owner acts as supervisor.

Person(s)who owns a parcel of land on which he/she rest o tends to reside,on which there is,or is intended to be, a one or two-
family dwelling, attached or detached structures accessory t use and/or farm structures. A person who constructs more than one
home in a two-year period shall not be considered a home er. • "homeowner"shall submit to the Building Official on a form

HOMEOWNER'S EXEMPTION
The ode states that: "Any homeowner performing^work for which a building permit is required shall be exempt
from the ovisions of this section(Section 109.1.1-Licensing of construction Supervisors); provided that if the homeowner
engages person(s)for hire to do such work,that such Homeowner shall act as'supervisor."
Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor ,
(see Appendix Q,Rules &Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often
results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot
proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is
ultimately responsible.
To ensure that the homeowner is fully aware of his/her responsibilities;many communities require,as part of the
permit application,that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page
of.this issue is a form currently used by several towns. You may care t amend and adopt such a form/certification for use in
your community.

a. From Tables 10 and 11 and location of wall sheathing and Building Aspect Ratio,determine Percent Full-Height
Sheathing and Nail Spacing requirements
b. Wood Structural Panels shall be minimum thickness of 7/16"and be installed as follows:
L Panels shall be installed with strength axis parallel to studs.
ii. All horizontal joints shall occur over and be nailed to framing.
iii. On single story construction, panels shall be attached to bottom plates and top member of the double
top plate.
iv. On two story construction, upper panels shall be attached to the top member of the upper double top
plate and to band joist at bottom of panel. Upper attachment of lower panel shall be made to band joist
and lower attachment made to lowest plate at first floor framing.
v. Horizontal nail spacing at double top plates, band joists, and girders shall be a-double row of 8d

Dear Mr.DaLuz:
I have received your letter of April 13,1984 regarding
the above-mentioned complaint.
To say the least,I am most unhappy,annoyed and dissatis
fied with your answer for this reason:As of this writing
the dumpster,which you claim had been removed,remains in
place as witnessed by me and by my secretary,Mrs.Patricia
Farley on 4/17/84.
I am sure it was not your intention to lie to me,or Mr.
MacSwan,or to lie to the Board of Selectmen,rather I am
sure that you were misinformed by your assistant building
inspector,Mr.Martin.Actually what you did,Mr.DaLuz,
was that you relied on a subordinate,in that sense you
failed because Mr.Martin's incompetence is a direct reflec
tion on you as his superior.
')?he purpose of all of this,Mr.DaLuz,is that the deterior
ation of the Picket Fence property has a real and significant
impact on the dollar value of my property.Therefore I ad
vise you that if you or the property owner in question,do
not comply with the zoning by-laws there will be legal
ramifications.
I ask you again,as I did in early March,please have the
dumpster removed.
In addition to that I am also not satisfied with your answer
or description of the parking lots and the number of vehicles

Dear Mr.DaLuz:
Thank you for your letter of March 6,1984..It is comfort
ing to know that you (the building inspector)and the
Historical Commission are on the job and that even the most
inconspicuous infraction does not escape your eagle eyes.
My compliments to you and the entire Historical Commission.
This is a letter of complaint and refers to the Swanson
property at 4225 Main Street,Cummaquid.Would you kindly
submit to me all of the forms which xvere filed and obviously
approved by you and the Historical Commision for said prop
erty,and in your response to this letter,would you please
explain the following to me:
1)Why and when you approved the parking lot expansion
on that property;
2)Why and when you approved the two-story addition to
the building in the rear;
3)Why you allow twelve (12)cars to park there daily;
4)Why you allowed the dumpster to be exposed;
5)Why you allow numerous commercial vehicles to be
parked there;
6) Why you allow trailer parking on the property.
Enclosed is an aerial photograph of the area which I had taken
a few years ago.When responding to the foregoing six questions
please return this aerial photograph to me.

Dear Mr.MacSwan;
Regarding our telephone conversation of March 1,1984...I
do not believe the story you gave me..."that you just
happen to have driven down Cove Lane and that you just
happened to notice,a hard to see fence,on my property
which was installed and not approved by the Historical Soc
iety.I have in fact,reason to believe that your knowledge
of the fence came from a third party.
As to the rest of our conversation...no doubt I could have
used a less common word to describe the degenerative condi
tions in the Cummaguid area...however,your magniloquent
attitude,and your inaccurate story seemed to call for such
a word.
It was most fortuitus that you should call me because it
gives me the opportunity to write and formally point out to
you the many areas which should have the attention of the
Historical Society.I am enclosing four snapshots which I
personally took that clearly demonstrate the creeping degener
ation of my neighborhood.
In particular,please note directly across the street from my
property,the Picket Fence which has recently expanded its
parking lot.Kindly submit to me all of the documents,
plans,etc.,regarding that expansion,and the date on which
you and the rest of the Historical Society approved that park
ing lot expansion.
Example 1:Location -The Picket Fence,6A between
Cove Lane and Keveney Lane.
Example 2:Location -Cove Lane and 6A,Camper
Storage.
Example 3:Location -Railroad Avenue,the Dump.
